RE: John Bior Deng death investigation
‘Dear Ms. Lyness:
On the evening of Fuly 24, 2009, Johason County Deputy Sheriff Terry Stotler,
hile on duty, and inthe line of duty, shot and killed John Bior Deng. That same
evening, an investigation of this incident was initiated by the Towa City Police
Department, assisted by the Iowa Division of Criminal Investigation.
‘On July 27, 2009, you referred this matter to the Attorney Generel. During the
ensuing days and weeks, we have consulted with the investigating detectives, visited the
soente of the shooting, and reviewed a vatiety of investigetive materials including
videotaped juterviews, witness statements, reports of interviews, transcripts of interviews,
911 audiotapes, squad car videos, an autopsy report, and crime lab reports, This week we
received a final written report and final bricfing on the results of the investigation. Today
‘we report our findings and conclusions.
‘THE INCIDENT
Deputy Terry Stotler’s assignment is “civil deputy.” His duties eopsist primacily
of serving civil process pepers throughout Johnson County. As required, Deputy Stover
cives oa unmarked sherif's vehicle and works in plain clothes. He wears a fanny pack
jn which he camries a cell phone, « departineat-issued handgun and a wallet containing his
badge and identification. i
Shortly after 7:00 pm. on Friday, July 24, 2009, Deputy Stotler attempled service
of process at an edarese on South Lucas Street in Iowa City. He then left shat location to

Proceeding wesi-bound, downhill on Prentiss from Gilbert at approximately 7:15
pan, Deputy Stotler observed pessons standing on either side of Prentiss Street. On the
eputy’s left be saw two adult males engaged in 2 physical altercation in the parking area
immediately in front of City Bieciric, 2 business located at 315. Prentiss Street. He
‘observed a white male (later identified as John Bohnenkamp) with a large blood stain on
kis shirt and a black male (later identified as Joh Deng) with a knife in bis and. Deputy
Stotler execuied.a U-turn. As hie turned, be radioed a report to the Johnson County *
dispatcher stating that he was dealing with a fight at that location. He parked and exited
hisear. He removed his handgun and yeiled, “Sheriff's Office!" as he approached the
two individuals.
White Deputy Stotler was altempting service of process on South Lucas Stree,
Jotn Bobnenkanmp and his wife were exiting Hawkeye Hideaway, a tavom on Prentiss
Street. They walked atoss Prentiss Street te the area in front of City Blecttic where the
Bohnenkamps" vehicle was parked. At that sate time, John Deng was walking across
{he street in the same direction, approximately half a block to the east of the
‘Bohnenkamps, caxrying four gubage begs filled with empty cans and bottles.
As Deng walked across the street, bottles began to spill frovt one of his bags.
Bobnentcemnp notioed this and shouted al Deng. He approached Deng, complained about
the bottles spilled on the street, and told Deng to pick thom up. The two confronted ome
another. Deng opened a small knife.
