FACTS
Heard today dated 13.2.2013. Appellant not present. The
Plant is represented by Shri T. Gautaman, Sr. Manager (CPIO), Shri J. P.
Ambrose, Sr. Manager (Pers.) and Shri A. Gurumoorthy.

It is noticed that in the RTI application dated 25.7.2012, the
appellant had sought huge information running into 19 paras. In the first para,
he had sought list of the JOTs of 10th & 12th batch. In second para, he had
sought the pay scales of the JOTs of these two batches. In third para, he had
sought information about the anomalies in the pay scales of the JOTs and so on.
The CPIO had refused to disclose information on paras 1 & 2 of the RTI
application u/s 8 (1) (j) of the RTI Act.

Suffice to say that the CPIO has not taken a legally correct
view in the matter. In my opinion, this information is fully disclosable to the
appellant. I am deliberately not discussing the rest of the paras in this order as I
deem it expedient to remand the matter to the CPIO with the direction to revisit
the matter and provide para-wise information to the appellant as per law. A
personal hearing to the appellant, I am sure, would prove helpful and satisfying
to the appellant.

Besides, the CPIO is also expected to study the RTI Act
with greater care and adopt a positive and helpful attitude towards the
information seekers.

Appellant in this case is S. Chinnadurai. He has raised the
same queries as were raised by Shri Madhesh in the preceding case. The ratio of
the decision in the preceding case applies in the present case also. The matter is
decided accordingly.
