Regulation 4 (9) of the 2006 Transfer of Undertakings (Protection of


Employment) Regulations protects employees against dismissal if the
transfer involves a “substantial change in working conditions”. In
Tapere v South London and Maudsley NHS Trust, the Employment
Appeal Tribunal said that the test as to whether the change was to the
employee’s detriment must be a subjective one. More ...

OF NO BENEFIT

The Local Government Pension Scheme Regulations state that


members are entitled to additional benefits if they can show they are
“permanently incapable” of doing their job. In Booth v Oldham MBC,
the Court of Appeal said that it would be difficult (although not
impossible) to show permanent incapacity if the member failed to
establish that they were disabled under the 1995 Disability
Discrimination Act. More ...
