PROJECT TOPIC: INTERCOUNTRY ADOPTION

Synopsis: The project has been divided into 6 headings. 1. Introduction: In this heading we have dealt with the capacity of a person to adopt. We have also with the roman concept of adoption and the de facto adoption of England. The different conditions which need to be fulfilled before adoption can be made in England. 2. English law: We have dealt with the two different types of adoption in England, which are ordinary and exceptional jurisdiction. We have also talked about provisional adoption order and the consequences of this order. 3. Indian law: This heading deals with the jurisdiction of Indian courts. We have also discussed certain provision of the Hindu adoption and maintenance act, 1956. The basic prerequisites of adoption are also mentioned and effect of adoption in India. 4. Recognition of foreign adoptions: We have mentioned about the provisions regarding recognition of foreign adoptions under common law and discussed certain case laws. The adoption act, 1968 also deals with certain provisions relating to foreign adoptions. We have also discussed the case of Re valentines Settlement. 5. Adoption by foreign parents: We have discussed the case of Laxmi Kant v. Union of India and K. S. council for children welfare v. Society of Sisters of C. S. G. Convent. We have also talked about the guidelines laid down by the Government of India for inter-country adoption. (1995)
