organisation, institution
and government body is
bound by the principles
prescribed in
constitutional law.
The Australian Constitution
is supreme and all laws of
the nation draw their
authority from it
Constitutional Rules
Prevent government bodies exceeding the
powers they are given as prescribed in the
constitution
Protect the rights and liberties of the individual
Australian Citizen.
Equality before the law
Government institutions must all keep the
equality of individuals as their #1 priority.
The powers government bodies exercise must
uphold the rights of the people, and no section of
the community, or individual must be
discriminated against.
Parliaments must not make laws that will prevent
the government from keeping equality a priority



No one is above the law
whatever their social,
economic or political
position.
(Yes, even the Prime Minister is subject to the law like you
and I)
Existence of Fundamental Human Rights
ALL institutions must exercise power on the
assumption that individuals retain certain
fundamental rights at ALL times, under ALL
circumstances.

arbitrary arrest

Courts > Resolve disputes by observing fundamental
rights of the individual > presumption of innocence
