THE CRIMINAL LAW AMENDMENT ACT, 1961 An Act to supplement the

criminal law.
Be it enacted by Parliament in the Twelfth Year of Republic of India as
follows : ?
1. Short title and extent. ? This Act may be called the Criminal Law
Amendment Act !"#!$
%&' It e(tends to the whole of India e(cept the )tate of *ammu and
+ashmir$
2. Questioning the territorial integrity or frontiers of India in a
manner prejudicial to the interests of safety and security of
India. ?

[1],%!' -hoe.er by words either spo/en or written or by
si0ns or by .isible representation or otherwise 1uestions the
territorial? inte0rity or frontiers of India in a manner which is or is
li/ely to be pre2udicial to the interest? of the safety or security of
India shall be punishable with imprisonment for a term which may
e(tend to three years or with fine or with both$3

[2],%&' -hoe.er publishes a map of India which is not in conformity
with the maps of India as published by the )ur.ey of India shall be
punishable with imprisonment which may e(tend to si( months or
with fine or with both$
%4' 5o court shall ta/e co0ni6ance of an offence punishable under sub7
section %&' e(cept on a complaint made by the 8o.ernment$3
3. Statements, etc., in a notified area prejudicial to
maintenance of public order, etc., therein or to safety or
security of India and regulation of entry of persons in such
area. ? %!' If the Central 8o.ernment considers that in the interests
of the safety or security of India in the public interests it is necessary
or e(pedient so to do it may by notification in the 9fficial 8a6ette
declare any area ad2oinin0 the frontiers of India to be a notified area:
and thereupon for so lon0 as the notification is in force such area
shall be a notified area for the purposes to this section$
%&' -hoe.er ma/es publishes or circulates in any notified area any
statement rumour or report which is or is li/ely to be pre2udicial to
the maintenance of public order or essential supplies or ser.ices in the
said area or to the interests of the safety or security of India shall be
punishable with imprisonment for a term which may e(tend to three
years or with fine or with both$
%4' 9n and after such day as may be specified in and sub2ect to any
e(emptions for which pro.ision may be made by a notification issued
under sub7section %!' no person who was not immediately before the
said day a resident in the area declared to be a notified area by the
notification shall enter or attempt to enter that area or be therein
e(cept in accordance with the terms of a permit in writin0 0ranted to
him by a person not below the ran/ of a ma0istrate of the first class
specified in the said notification$
%;' Any police officer not below the ran/ of sub7inspector of police
may search any person enterin0 or attemptin0 to enter or bein0 in or
lea.in0 a notified area and any .ehicle .essel animal or article
brou0ht in by such person and may for the purpose of the search
detain such person .ehicle .essel animal or article :
Pro.ided that no woman shall be searched in pursuance of this sub7
section? e(cept by a woman authorised in this behalf by the police
officer$
%<' If any person is in a notified area in contra.ention of the pro.isions
of sub7section %4' then without pre2udice to any other proceedin0s
which may be ta/en a0ainst him he may be remo.ed there from by or
under the direction of any police officer on duty in the notified area
not below the ran/ of sub7inspector of police$
%#' If any person enters or attempts to enter a notified area or is
therein in contra.ention of any of the pro.isions of sub7section %4' he
shall be punishable with imprisonment for a term which may e(tend to
one year or with fine or with both$
. !o"er to declare certain publications forfeited and to issue
search "arrants for the same. ? %!' -here any newspaper or boo/
as defined in the Press and Re0istration of Boo/s Act !=#> %&< of
!=#>' or any other document where.er printed appears to the )tate
8o.ernment to contain any matter the publication of which is
punishable under )ection & or sub7section %&' of )ection 4 the )tate
8o.ernment may by notification in the 9fficial 8a6ette statin0 the
0rounds of its opinion declare e.ery copy of the issue of the
newspaper containin0 such matter and e.ery copy of such boo/ or
other document to be forfeited to the 8o.ernment and thereupon any
police officer may sei6e the same where.er found and any ma0istrate
may by warrant authorise any police officer not below the ran/ of sub7
inspector to enter upon and search for the same in any premises
where any copy of such issue or any copy of such boo/ or other
document may be or may be reasonably suspected to be$
%&' The powers conferred by sub7section %!' on the )tate 8o.ernment
may also be e(ercised by the Central 8o.ernment$
%4' In sub7section %!' ?document? includes also any paintin0 drawin0
or photo0raph or other .isible representation$
#. $pplication to %igh &ourt to set aside order of forfeiture. ?
%!' Any person ha.in0 any interest in any newspaper boo/ or other
document in respect of which an order of forfeiture has been made
under )ection ; may within two months from the date of such order
apply to the ?i0h Court to set aside such order on the 0round that the
issue of the newspaper or the boo/ or other document in respect of
which the order was made did not contain any matter of such a nature
as is referred to in sub7section %!' of )ection ;$
%&' The pro.ision of

Procedure !="= %< of !="='3 shall apply in relation to an application
under sub7section %!' as they apply in relation to an application under
)ection ""B of that Code and the reference in )ection ""A to seditious
or other matter of such a nature as is referred to in sub7section %!' of
)ection ""A of that Code shall be construed as reference to any matter
of such a nature as is referred to in sub7section %!' of )ection ; of this
Act$
%4' 5o order passed or action ta/en under )ection ; shall be called in
1uestion in any court otherwise than in accordance with the pro.isions
of this section$
