AFFILIATION BYE-LAWS
CHAPTER -I
! S"ort Title and #efinition$
1. These Bye-laws shall be called Central Board of Secondary Education Affiliation Bye-laws.
2. They are effective from 28th January !88 with modifications"amendments from time to time.
3. #n case of any dis$ute%s& re'ardin' the withdrawal or not 'rantin' affiliation or any other matter
$ertainin' to u$ 'radation and"or any matter arisin' in res$ect of anythin' $ertainin' to
affiliation with any school and"or any other $erson( society( com$any or or'ani)ation( the courts
and tribunals at *elhi shall have the e+clusive ,urisdiction to entertain such dis$utes.
%! #efinition$
. #n these Bye-laws( unless the conte+t otherwise re-uires.
i) /Affiliation/ means formal enrolment of a school amon' the list of a$$roved schools of
the Board followin' $rescribed"a$$roved courses of studies u$ to class 0### as well as
those $re$arin' students accordin' to $rescribed courses for the Board1s e+aminations.
ii& /Affiliation Committee/ means Affiliation Committee of the Board.
iii& /Board/ means the Central Board of Secondary Education.
iv& /Chairman/ means the Chairman of the Central Board of Secondary Education.
v& /Secretary/ means the Secretary of the Central Board of Secondary Education.
vi& /E+amination/ means e+aminations conducted by the Board.
vii& /E+tension/ means e+tension of 2rovisional"3e'ular affiliation 'ranted to the
by the Board.
viii& /Affiliation 4ee/ means char'es $ayable by the schools to the Board in connection
with affiliation.
i+& /School 5ana'ement Committee/ means the committee mana'in' the school.
+& /6overnment Aided School/ means school receivin' 'rant-in-aid from the 7nion
6overnment"Administration of 7nion Territory"State 6overnment.
+i& /6overnment School/ means a school run by the *e$artment of Education of the
7nion Territory"State 6overnment.
+ii& /6rants-in-aid/ means aid in the form of maintenance from the Central 6overnment
or State 6overnment or 8ocal Authority or Administration of 7nion Territories( as
the case maybe.
+iii& /9ead of #nstitution/ means the 2rinci$al"9eadmaster of a Senior Secondary or
Secondary School affiliated with the Board or a 5iddle School a$$roved by the
Board.
+iv& /9ealth :fficer/ means a$$ro$riate authority of the 8ocal 5unici$ality" 5unici$al
Cor$oration"8ocal Body to loo; after the health and sanitary conditions of the area.
+v& /#ndian *i$lomatic 5ission/ means the Embassy"9i'h Commission " Consulate
6eneral of #ndia in the relevant country.
+vi& /#nstitution/ means an educational institution affiliated to the Board.
+vii& /<endriya 0idyalaya/ means a school run by <endriya 0idyalaya San'athan( an
autonomous :r'ani)ation under the 5inistry of 9uman 3esource( *evelo$ment of
the 6overnment of #ndia.
+viii& /Jawahar =avodaya 0idyalaya/ means a school run by the =avodaya 0idyalaya
Samiti of the 6overnment of #ndia.
+i+& /5iddle Class Syllabus>( means syllabus a$$roved by the Board for classes u$ to
0### on the $attern of syllabus"'uidelines for these classes 'iven by =.C.E.3.T.
++& /=o :b,ection Certificate/ means a letter issued by the a$$ro$riate authority of the
Education *e$artment of the State"7nion Territory in res$ect of School situated in
the State"7.T. for affiliation of the school to the CBSE.
++i& /2arents- Teachers Association?1 means an association of the $arents and teachers
of a $articular school.
++ii& /2rivate 7naided School/ means a school run by a Society"Trust duly constituted
and re'istered under the $rovisions of Central"State Acts not 'ettin' any re'ular
'rant-in aid from any 6overnment source%s&.
++iii& /3eserve 4und/ means fund created by the school authority as $er re-uirement of
the Board( in a 2ost :ffice"=ationali)ed Ban; in the ,oint names of the Secretary(

Central Board of Secondary Education"*irector %Education& of State"7.T. and the
5ana'er of the school concerned.
++iv& /Senior Secondary School/ mean school $re$arin' students for both the Secondary
%Class-@& and Senior School Certificate %Class-@##& E+aminations of the Board or for
Senior School Certificate %Class-@##& E+amination only
++v& /Secondary School/ mean school $re$arin' students for the Secondary School %Class
@& E+amination of the Board.
++vi& /School run by 2ublic 7nderta;in'/ means a school run by the 2ublic Sector
7nderta;in' wholly financed by that underta;in'.
++vii& /Com$osite Affiliation/ means affiliation from Class # to @ or # to @##.
++viii& /Session/ means the $eriod of twelve months duration( when instruction is $rovided to the
students( normally A$ril to 5arch.
++i+& /Teacher/ means a $erson in the em$loyment of an institution affiliated with the Board
for teachin' $ur$oses.
+++& /7$'radation/ means u$'radation of secondary school to senior secondary sta'e i.e.(
Classes-@# and @##.
2. Aords im$ortin' the sin'ular number also include the $lural number and vice-versa.

CHAPTER-II
&! Nor'$ for Affiliation
1. The Board may affiliate several cate'ories of schools all over #ndia and abroad( as for e+am$le.
%i& 6overnment or 6overnment aided schools?
%ii& Schools run by autonomous :r'ani)ations under the 6overnment li;e <endriya
0idyalaya San'athan %<0S&( =avodaya 0idyalaya Samiti %=0S&( Central Tibetan Schools.
:r'anisation %CTS:&( Saini; Schools Society etc?
%iii& Schools run by 6overnment *e$tt. directly li;e *efence( 3ailways etc.
%iv& Schools mana'ed directly by 2ublic Sector 7nderta;in's or by re$uted societies for
2ublic Sector 7nderta;in's under the financial control of such 2ublic Sector
7nderta;in's or by Societies formed by such underta;in's.
%v& 2rivate( unaided schools established by Societies re'istered under the Societies
3e'istration Act 8CD of the 6overnment of #ndia or under Acts of the State
6overnments as educational( charitable or reli'ious societies havin' non-$ro$rietary
character or by Trusts.
2. A$$lications for affiliation may be considered under the followin' four cate'ories.
%i& A$$roval of middle class syllabus.
%ii& 2rovisional affiliation of a secondary school.
%iii& 7$'radation"$rovisional affiliation of a school for senior secondary sta'e.
%iv& 3e'ular affiliation to schools run by the 6ovt."6ovt. Aided"<endriya 0idyalaya San'athan
%<0S&"=avodaya 0idyalaya Samiti %=0S&"Central Tibetan Schools :r'ani)ation %CTS:&.
%v& 2ermanent Affiliation.
Note( The Board may 'rant Affiliation in vocational courses only as $er $rovision contained in clause
B.!.
3. Any educational institution in #ndia or outside #ndia which fulfils the followin' essential
conditions %without which the case cannot be $rocessed& can a$$ly to the Board for affiliation.
%i& The School see;in' 2rovisional Affiliation with the Board must have formal $rior reco'nition of the
State"7. T. 6ovt. #ts a$$lication either should be forwarded by the States 6ovt. or there should be a
=o :b,ection Certificate to the effect that State 6overnment has no ob,ection to the affiliation of the
school with the C.B.S.E. 1=o :b,ection Certificate1 once issued to any school will be considered at
$ar even if it $rescribes a s$ecific $eriod unless it is withdrawn. Condition of submittin' a =o
:b,ection Certificate will not be a$$licable to cate'ories B. %i& to %iv&.
EEE%a& The School"Society Trust( or the Con're'ation or other 3eli'ious Body controllin' the Society"Trust
mana'in' the school must have about two acres %or as otherwise $ermitted measurement& of land and a buildin'
constructed on a $art of land and $ro$er $lay'rounds on the remainin' land.
EE 2rovided that the school may be 'raded as Cate'ory AF( Cate'ory A G Cate'ory B
School as $er the followin' criteria.

Cate'ory A F School - 2rovisionally affiliated school with land of at

ade-uate buildin' and arran'ement with other institution"or'ani)ation for im$artin' 2hysical G 9ealth Education
and for conductin' 'ames( to the satisfaction of the Board. #n case of lease( it will be acce$ted if it is for at least BD
years $rovided further that in case of any $ortion which is leased out below BD years( such case may be
considered $rovided that land has been allotted by the 6ovt. or 6ovt. A'encies audit is as $er the 8aw of the land.
#n all such cases school should have at least one acre of land by ownershi$ or by lease for BD years and in all case
that total land area should not be less than about 2 acres.

%c& #n hilly areas( the land should not be less than one acre. The norms as $rescribed by
the 2lannin' Commission shall be a$$licable for determinin' the hilly areas.

the year !!C under the %rela+ed condition of land re-uirement under cate'ory /B/ or
/C/ may be considered for u$'radation to F2 sta'e $rovided. that they should have
atleast one acre of land.
EE 2rovided further that such school will have only two sections at F2 level $referably one for non-
vocational stream and one for vocational stream with the $rovision that the number of
candidates shall not e+ceed LD in each section.
2rovided further also that if the school is found to have o$ened more than two sections it will
attract violation of $rovisions of Affiliation Bye-8aws of the Board.

The Trust or Society"5ana'ement runnin' the school should be of non-$ro$rietary character.
The list of members with their addresses( occu$ations( -ualifications and an affidavit from the
Chairman"Secretary statin' how the members are related to each other or they are not related
to each other duly attested by first class ma'istrate should be submitted. The school should
have well -ualified staff as $er the norms of the Board 'iven in Cha$ter #@.
The school in #ndia must $ay salaries and admissible allowances to the staff not less than the
corres$ondin' cate'ories of em$loyees in the State 6overnment schools or as $er scales etc.
$rescribed by the 6overnment of #ndia. The schools outside #ndia should $ay salaries not lower
than those of the teachers in 'overnment schools in that country or not less than the salaries
and forei'n allowances $ayable to <0S teachers if officially $osted to that country. A certificate
to this effect should be obtained from the #ndian *i$lomatic 5ission.

)A* Pro+i$ional Affiliation(
Those schools which fulfill the essential conditions of the Affiliation Bye-8aws may be
considered for 2rovisional Affiliation for a $eriod of three years sub,ect to fulfillin' all the norms
and conditions of the Affiliation Bye-8aws with in this $eriod. #n case the school%s& do not fulfil
the norms and conditions of the affiliation due to some $rudent reasons the Board may 'rant
e+tension of $rovisional affiliation 'ranted for a further $eriod of B years to J years sub,ect to
fulfill the conditions of affiliation in the e+tended $eriod.
)B* Re,ular Affiliation(
The schools run by 6ovt." 6ovt. Aided"<0S"=0S"CTS: will be 'ranted one time re'ular
affiliation sub,ect to satisfyin' and fulfillin' all the norms"conditions of the Affiliation Bye - 8aws
includin' of the land etc. Such school need not a$$ly for e+tension of affiliation( but they have to
remit annual fee as may be $rescribed.
EE%C& Per'anent Affiliation
I. Schools mana'ed directly by the 2ublic Sector 7nderta;in's %2S7s& or by re$uted societies of
2S7s under financial control of such 2S7s or by societies formed by such underta;in's( and
$rivate( unaided schools established by societies"trusts as $er Affiliation Bye-laws may a$$ly for
2ermanent Affiliation.
##. Those schools which have been 'ranted 2rovisional Affiliation may be considered for
$ermanent affiliation after the e+$iry of $eriod of $rovisional affiliation of B years or such
e+tension of $rovisional affiliation as the case may be sub,ect to fulfillment of all the norms and
conditions of the Affiliation Bye-8aws in force by the Board.
2rovided further that $reference may be 'iven to such schools that have been $rovisionally
affiliated with CBSE for a $eriod of D years or more and satisfyin' all the conditions of
Affiliation Bye 8aws.
2rovided further also that in case of non"$artial fulfillment of conditions as mentioned in various
cha$ters of Affiliation Bye-8aws( the a$$lication will be summarily re,ected.
iii. The school see;in' $ermanent affiliation must also satisfy the followin' conditions.
%a& Infra$tructure
The infrastructure facilities should be as follows.-
%i& Class rooms - minimum si)e should be 8 m + C m %a$$ro+ JDD. s-. ft.&.
%ii& Science 8abs. %Com$osite for Secondary or"and se$arate 2hysics( Chemistry
and Biolo'y for Senior Secondary&- minimum si)e should be ! m + C m each %a$$ro+
CDD s-. ft& and fully e-ui$$ed.
EE 3ule added in the Affiliation Committee1s meetin' held on 2D"DC"2DDJ and a$$roved by the
6overnin' Body at its meetin' held on 2K"DC"2DDJ.
%iii& 8ibrary- minimum si)e should be L m.+ 8 m. fully e-ui$$ed and with readin'
room facility.
%iv& Com$uter 8ab. and 5ath 8ab. - =o minimum si)e is $rescribed( however( the
school should have se$arate $rovision for each
%v& 3ooms for e+tra curricular activities - either se$arate rooms for music( dance(
arts G s$orts or one multi $ur$ose hall for all these activities should be available.
)-* .eneral
Besides fulfillin' the other conditions( the school must satisfy the followin'.-
%i& All admissions and. withdrawal re'isters are $ro$erly maintained.
%ii& The Service records of teachin' and non-teachin' staffs are duly maintained and
u$dated.
%iii& =o teachers are a$$ointed on ad-hoc basis
%iv& Teachin' G non-teachin' staff are a$$ointed on $rescribed $ay scales G no staff are
a$$ointed on consolidated $ay. They are also $aid *A G admissible other allowances as
$er Central or res$ective State 6ovt. rates.
)c* /uality of Education
The school see;in' $ermanent affiliation must be -uality driven and must strive for e+cellence
in all as$ect of its activities. #t must satisfy the board1s direction re'ardin' no school ba' and no
homewor; to the students u$ to class ##( Continuous and Com$rehensive Evaluation %CCE& in
$rimary classes with no $ass-fail criterion and also e+tension of CCE 'radually u$ to class 0###.
2rovided also that the school see;in' $ermanent affiliation must im$lement the academic
initiatives li;e #ntroduction of Alternative to 9omewor; from class III to 0( #ntroduction of 8ife
S;ills Education for classes 0# to 0###( and maintenance of 2ro$er records of internal
assessment from classes 0# to @ .The avera'e result of the school in the last three years must
not be less than the Board1s avera'e in class @ and @## e+aminations.
iv. A$$eal a'ainst re,ection
%a& The school whose a$$lication has been re,ected will have the o$$ortunity to
a$$eal a'ainst such re,ection to the A$$ellate Authority after $ayment of an A$$eal 4ee.
The A$$ellate Authority shall consist of Chairman of the Board and two other members
as may be nominated by the Board.
%b& The school whose re-uest has been re,ected by the A$$ellate Authority also(
will be eli'ible to a$$ly only after two academic years( e+cludin' the academic year in
which the a$$lication has been re,ected. The fee( includin' the fee for A$$eal( once
de$osited shall not be refunded under any circumstances.
v. 5iscellaneous
vi. %a& The 2ermanent Affiliation will be 'ranted after $hysical ins$ection of the school
and satisfaction of the Board that it is meetin' with all the conditions $rescribed for the
same.
%b& The ins$ection of schools re-uestin' 2ermanent Affiliation will be conducted by a
Committee consistin' of three members( at least one of which. must be an academician
of re$ute to loo; into the academic activities.
%c& #t is the res$onsibility of the school to ensure that it is satisfyin' all the conditions laid
down in the Affiliation Bye-8aws duly su$$orted with documentary evidences in the
$rescribed formats. #n case an a$$lication is re,ected due to non-fulfillment of all the
conditions"non furnishin' of documentary evidences( the fee de$osited will not be
refunded even if the school has not been ins$ected.
%d& The schools which are $ermanently affiliated will be re-uired to remit annual fee at an
amount to be $rescribed from time to time. The annual fee will be de$osited alon' with
annual e+amination fee.
%e& The schools which are $ermanently affiliated( will observe various 1*os1 and 1*on1ts1
mentioned in Cha$ter ## Bye-8aws B of Affiliation Bye-laws All other condition of
Affiliation Bye-laws of the Board will also be a$$licable 1mutatis-mutandis1.
%f& The $ermanent affiliation 'ranted to schools shall not be treated as absolute. The
Board has the ri'ht to ins$ect such schools as deem fit so as to ensure that the norms"
conditions laid down in the bye-laws in force are strictly com$lied with.
%'& Such schools which are"would be $ermanently affiliated with the Board may be
$ermitted to introduce additional sub,ects as and when they li;e but before introduction
of additional sub,ects they may remit the re-uisite fee and su$$ly the necessary
information with re'ard to infrastructure made available in the school and staff $rovided
for the sub,ect under introduction.
0! La$t #ate for Su-'i$$ion of A11lication$
1. A$$lication /:n 8ine/ for %a&a$$roval of middle class syllabus( %b& $rovisional affiliation of a
secondary school( %c& u$'radation of the school for senior secondary sta'e as the case may be(
alon' with the $rescribed fee should reach the Board1s office latest by BDth June of the year
$recedin' the session from which a$$roval of syllabus"$rovisional affiliation"u$'radation is
sou'ht. The re-uest for a$$roval of middle class syllabus should be made only when the school
has reached at least Class 0#.
2. #n the case of institutions situated outside #ndia( the a$$lication should be accom$anied by a
letter of recommendation from the #ndian *i$lomatic 5ission.
3. The Chairman of the Board may entertain an a$$lication after the last date if the reasons are
stron' enou'h to warrant such e+tension.
2! Society3Tru$t runnin, t"e Sc"ool
1. #n case of schools belon'in' to cate'ory B%& %v& there should be a $ro$erly constituted
3e'istered Society Trust. #t should be of a non-$ro$rietary character and its constitution be
such that it does not vest control in a sin'le individual or members of a family. The aims of the
society"trust should be as laid down under section !%& and %2&.
2. 4ormation of the Society Trust should also conform to the State 6overnment rules in which the
school is located.
3. The Board may in s$ecial circumstances e+em$t schools from o$eration of the above clause in
res$ect of schools set u$ in forei'n countries where societies" trust in the name of #ndians
cannot be re'istered under any law or enactment.
4! Sc"ool 5ana,e'ent Co''ittee
Sub,ect to relevant $rovision in the Education Act of the State"7.T. Concerned( every affiliated school
e+ce$t schools run directly by the Education *e$artment of the 6overnment of the State"7.T. should
have a scheme of mana'ement a$$roved by the Board. #t should also have a School 5ana'in'
Committee as laid down under section 2D%& %2&( %B& and 2.
6! Financial Re$ource$
1. The school must have sufficient financial resources to 'uarantee its continued e+istence. lt
should have $ermanent source of income to meet the runnin' e+$enses of the school so as to
maintain it at a reasonable standard of efficiency( to $ay salaries to teachers and other
cate'ories of staff re'ularly at least at $ar with the corres$ondin' cate'ories in the State
6overnment Schools and to underta;e im$rovement" develo$ment of school facilities. ln case of
institutions which are in the recei$t of 'rant-in-aid from the State 6overnment"7.T. the
$ermanent Source of income shall include the amount of 'rant-in-aid also
2. =o $art of income from the institution shall be diverted to any individual in the Trust"
Society"School 5ana'ement Committee or to any other $erson. The savin's( if any( after
meetin' the recurrin' and non-recurrin' e+$enditure and contributions to develo$mental(
de$reciation and contin'ency funds may be further utili)ed for $romotin' the school. The
accounts should be audited and certified by a Chartered Accountant and $ro$er accounts
statements should be $re$ared as $er rules. A co$y each of the Statement of Accounts should
be sent to the Board every year.
3. The channelin' of funds by the mana'ement to $erson %s& or enter$rise other than for furtherin'
education in the school will contravene the rules 'overnin' affiliation and call for a$$ro$riate
action by the Board.
7! P"y$ical Facilitie$
1. #n addition to the basic re-uirement of Section B %B&( the institution should have other facilities
commensurate with its re-uirements. #t should satisfy the minimum conditions laid down by the
Board for school buildin'. Classrooms should be ade-uate in si)e. The minimum floor s$ace
should at least be s-. metre $er student. .
2. Every institution will $rovide $ro$er facilities li;e ram$s toilets for wheel chair users and auditory
si'nals in elevators in lifts in accordance with the $rovisions laid down in 2A* Act( !!J.
3. The school has suitable furniture in the classrooms and office e-ui$ment and furniture
commensurate with the stren'th of students and the staff.
4. The school should have the needed e-ui$ment and facilities %at least the minimum $rescribed
by the Board& for Sciences( 9ome Science( Technical sub,ects( 0ocational sub,ects and various
activities under Aor; E+$erience and Art Education.
8ist of minimum e-ui$ment $rescribed for Science sub,ects for Secondary"Sr. Secondary
School can be had from the Board a'ainst $ayment.
The school should scru$ulously observe $rescri$tion from the 5unici$al Authority re'ardin'
drin;in' water and fire safety $recaution in the school. A certification from the 5unici$al" 4ire
Authorities re'ardin' sanitary conditions and water"fire safety should be submitted alon' with
the a$$lication. A fresh certificate re'ardin' fulfillment of these re-uirements should be obtained
and submitted to the Board every five years.
6. The School should have ade-uate facilities for $rovidin' recreation activities and $hysical
education as well as for conduct of various activities and $ro'rams for develo$mental education
and for the social( cultural and moral develo$ment of the students and for safe'uardin' their
health.

8! Li-rary
1. The 8ibrary should be well e-ui$$ed and s$acious. #t should have at least five boo;s %other than
te+t boo;s& $er student in its stoc; sub,ect to a minimum of JDD at the be'innin'. #t shall not
stoc; notes( e+amination 'uides or ;eys of any ;ind. #n the selection of boo;s( norms or
'uidelines $rovided by the Board should be followed and $urchases should be made in
consultation with the sub,ect teachers.
2. The school should subscribe to sufficient number of news$a$ers and ma'a)ines. At least J
ma'a)ines suitable for students and $rofessional needs of teachers should be subscribed to.
3. The 8ibrary shall not contain any boo; or other forms of literature that es$ouse or $ro$a'ate
communal disharmony or casteism or discrimination based on reli'ion( re'ions or lan'ua'e etc.
The school should not stoc; in the library any boo; disa$$roved by the 6overnmentM Board.
9! Staff and Ser+ice Condition$
1. Besides the minimum re-uirements for salaries as laid down in Section B%B&( the school should
have ade-uate teachin' staff $ossessin' the necessary -ualification laid down for various
$osts"sub,ect teachers by the Board. The $u$il teachers ratio should not e+ceed BD. Also there
must be 1/2 teachers $er section to teach various sub,ects.
2. Salary should be $aid throu'h Account 2ayee Che-ues drawn on a scheduled ban;( from the
date of first a$$ointment of the teachers on $robation.
3. The school should have well defined conditions of service as $er norms of State"7.T.
6overnment and should issue letters of a$$ointment to the em$loyees at the time of ,oinin'
service and should also si'n a contract of service. The contract should be similar to the format
'iven in A$$endi+1/ in these Bye-laws or in the form $rescribed by the State"7.T. 6overnment( in
case the act of the State"7.T. 2rovides so. The $eriod of $robation should normally be one year
e+tendable for another year. #n case the mana'ement is not satisfied with the $erformance( the
same should be brou'ht to the notice of the em$loyees concerned in writin'. 2robation should
not be e+tended beyond two years and the 5ana'ement should arrive at a decision to confirm
the teacher or not before the end of the $robationary $eriod.
4. The school should have Contributory 2rovident 4und and 6ratuity or 2ension( 6ratuity and
6eneral 2rovident 4und as retirement benefits. These schemes should be as $er 6overnment
rules of the State"Centre. #n addition( it will also consider $rovidin' other welfare measures li;e
free children education( leave travel concession( medical benefits( leave encashment etc.
5. =ormally a teacher should be en'a'ed as a whole time em$loyee e+ce$t in s$ecial cases
where wor;load does not ,ustify a whole time teacher. =o teacher( teachin' the Secondary(
Senior Secondary classes shall be re-uired to teach more than B"L of the total $eriods in a
wee;.
6. The number of students in the class should not be very lar'e. The o$timum number in a section
of a class is LD.
7. Every school should ta;e ste$s to $rovide reorientation to all its teachin' staff( at least once in
five years. Such orientation may be or'ani)ed by the school itself or in collaboration with other
schools or by the State or 3e'ional #nstitutions or by the Board or by a =ational A'ency.
8. The 5ana'ement of the schools shall not retain the ori'inal de'ree"di$lomas certificates of the
teachers and other em$loyees of the school with them. The ori'inal certificates etc. ta;en for
verification shall be returned at the earliest after verification. 2hotostat co$ies may be obtained
from the em$loyees and ;e$t in their $ersonal files.
9. Chec; 'ender s$ecific violence( strictly com$ly with the 'uidelines and norms $rescribed by the
9on1ble Su$reme Court of #ndia in the writ $etition %Criminal& no. CCC-KD of !!2 0isha;a and
others 0 "s State of 3a,asthan and others delivered on B-8-!!K for $rotection of women from
se+ual harassment at the wor; $lace.
11. Fee$
12. 4ees char'es should be commensurate with the facilities $rovided by the institution.
4ees should normally be char'ed under the heads $rescribed by the *e$artment of Education
of the State"7.T. for schools of different cate'ories. =o ca$itation fee or voluntary donations for
'ainin' admission in the school or for any other $ur$ose should be char'ed " collected in the
name of the school. #n case of such mal$ractices( the Board may ta;e drastic action leadin' to
disaffiliation of the school.
2. #n case a student leaves the school for such com$ulsion as transfer of $arents or for health
reason or in case of death of the student before com$letion of the session( $rorata return of
-uarterly"term"annual fees should be made.
3. The unaided schools should consult $arents throu'h $arents1 re$resentatives before revisin'
the fees. The fee should not be revised durin' the mid session.
%! Ad'i$$ion of Student$
Admission in the school affiliated to the CBSE shall be made without any distinction of reli'ion( race(
caste( creed( $lace of birth or any of them. As re'ards reservation for SC"ST students is concerned( it
shall be 'overned by the Education Act"3ules a$$licable to the State"7.T. where the school is situated.
&! 5i$cellaneou$
1. The school see;in' Board1s affiliation"already affiliated to it shall be o$en to ins$ection by the
#ns$ection Committee de$uted by the Board or the Education *e$artment of the State"7nion
Territory in which it is situated.
2. The Schools situated abroad shall also be o$ened to ins$ection by the #ns$ection Committee
de$uted by the Board. The Board will $ay the TAIDA and other allowances admissible as $er
6ovt. of #ndia a$$roved rate includin' air$ort ta+ and local trans$ort conveyance for such
ins$ection.
3. The school shall su$$ly information and returns called for by the Board"State or Central
6overnment within the $rescribed time 'iven for its furnishin' to the authority concerned.
4. The buildin' and furniture of affiliated #nstitutions shall be $laced at the dis$osal of the Board for
conductin' any e+amination and s$ot evaluation free of char'e. The 5ana'ement and the
2rinci$al shall coo$erate with the Board in the conduct of e+aminations and evaluation of scri$ts.
#f as;ed by the Board( the school shall $rovide atleast one e+aminer in each sub,ect offered by
the school and more than one( if more than 2DD students have been sent for the e+amination. #n
case they fail to do so( the
Board shall have the ri'ht to ta;e a$$ro$riate action includin' initiatin' action for disaffiliation of
the school. 9owever( the si)e of the school will be ta;en into account before such a condition is
im$osed in order to avoid disru$tion of academic wor; in the school.
5. The school shall maintain records of attendance of all students in Secondary" Senior Secondary
classes for $ur$oses of admission to the Board1s e+aminations. The entries in these re'isters
shall be $ro$erly chec;ed at the end of each session and si'ned. The attendance re'isters shall
be o$en to ins$ection by the officers of the Board #ns$ection Committee.
6. The school shall arran'e the medical chec;-u$ of the students at least once a year and ;ee$ a
$ro$er record of the same.
7. The school shall ta;e ste$s to see that value education with $articular em$hasis on =ational
#nte'ration is im$arted to students throu'h teachin' various sub,ects and activities in the school
curriculum.
8. #nstitution affiliated to the Board shall not in 'eneral send candidates for 1e+amination of any other
Board"7niversity. #t shall $re$are candidates for the Secondary and Senior Secondary
e+aminations of the CBSE only. The 'eneral $rinci$le that may be followed at that affiliation for
classes hi'her than Senior Secondary may be allowed with another 7niversity but for lower
classes i.e. for Secondary classes this should not 'enerally be allowed. The affiliation of
vocational courses may be done as $er the re-uirements of the institutions offerin' them.
9. #n the interest of 2romotin' 0ocational Courses( schools"colle'es may be $ermitted to have
limited affiliation to the Board for vocational courses only. This would be sub,ect to the condition
that they would fulfill the other conditions of the Affiliation Bye-8aws includin' the curriculum
$rescribed by the Board.
2rovided further that the school will im$art education on 0ocational Courses in collaboration with
such or'ani)ations"industries that are directly concerned with the $articular 0ocational Courses
of study and are available at reasonable distance.
10. The Board may conduct an audit of the funds of the school as and when it thin;s necessary to
ensure that.
i& The funds"fee collected by the school authorities are not diverted?
ii& The staff is $aid salaries as $er the Bye-8aws?
iii& Any other financial irre'ularity.
! Board:$ E;a'ination$
i) #t is mandatory for a school affiliated to Board to follow the E+amination Bye-
laws of the Board in toto?
ii& =o affiliated school shall endeavor to $resent the candidates who are
not on its roll nor shall it $resent the candidates of its unaffiliated Branch"School to
any of the Board1s E+aminations.
iii& #f the Board has reasons to believe that an affiliated school is not followin' the Sub-
Section G 2 of this Section( the Board may resort to $enalties as $rescribed here
under.
Every affiliated school shall $resent a list of number of students and their $articulars in res$ect of
Classes #@( @( @# G @## at the time of be'innin' of an academic session.
6enerally( there shall be no variation between the said lists of candidates submitted at the time of filin'
of a$$lications for the Board1s e+aminations. 9owever( 'enuine variations( if any( shall be brou'ht to the
notice of the Board well in advance and in any case not later than Se$tember BDth of the academic session.
Such variation duly allowed by the Board shall be included in the list of candidates.
PENALTIES
Summary disaffiliation for five years and forfeiture of fees( if any. 3eaffiliation shall be considered on merits
after a fresh a$$lication is filed. 3e$etition of violation of any Bye-8aws shall lead o $ermanent
disaffiliation.

the Board at its ne+t meetin' to decide whether the school be 'ranted affiliation" a$$roval etc.( as the case
may be. The decision about 'rant of affiliation etc. will be communicated to the school immediately after
the a$$roval of Affiliation Committee. #n case of emer'ency( this $ower may( however( be e+ercised by the
Chairman.
6. The 'rant of a$$roval of syllabus of 5iddle Classes does not in any way im$ly any obli'ation on the $art of
the Board to affiliate the school for secondary classes and( similarly a Secondary School for Senior
Secondary Classes.

2. A school shall be eli'ible for consideration for the 'rant of autonomous status if it satisfies the

v) Sufficient administrative( academic and financial $owers should be with the

3. The schools satisfyin' the above conditions may a$$ly in the $rescribed form for 'rant of
autonomy that shall then be considered by the Board.

5. The Board may withdraw autonomy if it is not satisfied with its o$eration or if the school ceases
to satisfy any of the conditions for the 'rant of autonomous status.

rivalries within the school mana'ement.
viii& Absence of a$$roved terms and conditions of service( or fre-uent dismissal of teachers
from service.
i+& 2oor academic $erformance of the school for three consecutive years in not bein'
able to ;ee$ at least JD $er cent of $asses of the 'eneral $ass $ercenta'e.
x) =on-availability of $ro$er e-ui$ment"s$ace"staff for teachin' a $articular sub,ect.
+i& Any other misconduct in connection with the admissions"e+aminations"any other area
which in the o$inion of the Board warrants immediate disaffiliation of the school.

b. /:nce 2rovisional"3e'ular"2ermanent Affiliation 'ranted to the school is withdrawn by the
Board on establishment of serious irre'ularities which amount to cheatin' the Board"causin'
embarrassment to it( the Board may Blac; 8ist such a school to debar it from see;in' re-
affiliation in future.
3. The Board shall $rovide ade-uate time and o$$ortunity to the 5ana'ement of the school
served with a 1Show Cause =otice1( u$to a ma+imum of one year for ade-uate com$liance"
removal of defects failin' which the Board may declare the institution disaffiliated. Such
decision by the Board shall be final and bindin'. The ma+imum $eriod of 1Show Cause =otice1
due to clause K%2&%+i& may not e+ceed one month
4. #n case a school see;s le'al redressal from the Court a'ainst the decision of .the Board( the
,urisdiction of the court of 8aw shall be 7nion Territory of *elhi only and not any other $lace.
7! Wit"dra<al of Per'anent3Re,ular Affiliation
%& Aithin the 'eneral framewor; of Section K of this cha$ter( the Board reserves the ri'ht to
withdraw re'ular affiliation in the event of a school failin' to observe affiliation norms and rules
and"or the $ass $ercenta'e in most of the sub,ects 'oes lower than the $ass $ercenta'e of
each sub,ect at the e+aminations of the Board( continuously for three years. The Board will as;
such a school to rectify the deficiencies and 'iven ade-uate time %C months to one year&. #f the
school fails to show im$rovement( it will lose the status of a re'ular affiliation school and will
revert to a $rovisionally affiliated school status.
%2& #n the event of a school failin' to maintain the $rescribed norms for re'ular affiliation for
affiliated schools and"or rules of the Board and"or the school deteriorates in standards of
$erformance( the Board will as; such a school to rectify the deficiencies and come u$ to Boards
e+$ectations within a $eriod not e+ceedin' one year. #f the school fails to show im$rovement it
may lose the status of a re'ular affiliation school and will revert to a $rovisionally affiliated
school or even may be disaffiliated( if considered necessary by the Board.
EE%B& 2roceedin's for withdrawal of 2ermanent Affiliation may be initiated a'ainst such $ermanently
affiliated schools that are found 'uilty of the irre'ularities mentioned in Clause K of Cha$ter ##(
or of non -observance of other a$$licable conditions.
EE%L& The $rocedure etc. for withdrawal of 2ermanent Affiliation will be same as that mentioned in
Clause K.
EE%J& :nce 2ermanent Affiliation 'ranted to a school is withdrawn by the Board the school will not be
eli'ible for re-affiliation for at least 2 academic years includin' the year in which it was
withdrawn.

SOCIETY ITR?ST R?NNIN. THE SCHOOL 8!
Role3Ai'$ of Society3Tru$t
. The Society " Trust runnin' the school has a critical and ;ey role to $lay in $rovidin' a 'ood and
healthy climate to the school to fulfill its aim and ob,ects( to enable the staff $rovide -uality education and
to be a center for educational e+cellence. To achieve this aim( the role and res$onsibilities of the Society"
Trust are defined as under.
i) #t should ensure that the school 'ets $ro$er land( buildin' e-ui$ment( furniture and -ualified staff
at least as $er norms of the Board.
ii& #t shall ensure that the school is run as a community service and not as a business and
that commerciali)ation does not ta;e $lace in the school in any sha$e whatsoever.
iii& #t shall ensure that the funds accruin' from the school are s$ent for the benefit of the
school and for its e+$ansion.
iv& #t shall safe'uard the autonomy of the 2rinci$al and $rovide him total su$$ort e+ce$t
when the 2rinci$al 'oes a'ainst the established and clear directives laid down by the
mana'ement.
v) #t shall have control over the school mana'ement committee and shall a$$rove the bud'et"tuition
fees and annual char'es etc.( for the school.
vi& #t shall have control over any ca$ital e+$enditure i.e.( on land and the construction of
buildin'( its e+$ansion and $rocurement of ma,or e-ui$ments for the school.
vii& #t shall 'enerate funds for the needs of the school whether it is recurrin' or non recurrin'.
viii& #t shall ensure that the school has the basic essential facilities such as 8aboratory
e-ui$ment( e-ui$ment for 'ames and s$orts and other co-curricular activities( 8ibrary boo;s etc.
i+& #t shall have the $owers to constitute Selection Committee"*e$artmental 2romotion
Committees for various cate'ories of staff.
x) #t shall have $owers to lay down conditions of service as $er norms of CBSE" 6overnment( and to
a$$rove $romotion"a$$ointment"termination of the em$loyees as well as to 'rant s$ecial
increments or rewards to the staff.
2. The Society"Trust will ensure that the school is runnin' as $er the $rovisions of the Education
Act"affiliation norms and shall be committed to $rovide -uality education to the children and for this shall
ta;e necessary ste$s as $er its needs.

1. Schools other than 6overnment Schools affiliated with the Board shall have a school mana'in'
committee.
2. The school mana'in' committee should consist of the followin'. -
%a& The mana'in' committee of a reco'ni)ed aided school shall consist of not more than
fifteen members? and the mana'in' committee of a $rivate unaided school shall consist
of not more than twenty one members? (
%b& sub,ect to the total number of members s$ecified in clause %a&( every mana'in'
committee shall include the followin' namely.-
%i& the 9ead of the school. 9e will be a 5ember Secretary of the School 5ana'in'
Committee?
%ii& two $arents of students in the school?
%iii& two teachers of the schools?
%iv& two other $ersons %of whom one shall be women&? who are( or have been(
teachers of any other school or of any colle'e( to be nominated by the Trust"
Society"Board?
%v& two members( from out of a $anel recommended by the Trust"Society to be
nominated by the Board. #f the 2anel is not acce$ted fresh $anel may be as;ed. The
names recommended should not below the ran; of a 2rinci$al of a Sr. Sec. School?
%vi& the remainin' members to be nominated or elected as the case may be( in
accordance with the rules and re'ulations of the society or trust by which the school is
run.
%vii& =ot more than two members may be nominated as $er the conditions( if any(
laid down in the /=o :b,ection Certificate/.
2rovided further that the above $rovisions shall be im$lemented with immediate effect
and those affiliated earlier and not com$lyin' with above $rovisions shall be re-uired to
ta;e remedial measures with suitable -ualified substitutes within a year $ositively.
%viii& E=o 9ead 5aster"2rinci$al shall be a$$ointed in the school that is related to
any member of the School 5ana'in' Committee.
%i+& 4or the $ur$ose of this rule( the relation includes the followin' Brothers( Sisters(
9usband( Aife( Son( *au'hter( Son-in-law( *au'hter-in-law. 2rovided further that any
violation of rules will lead to the disaffiliation of the school.
The term of the members of the 5ana'in' Committee shall be three years. A member can be renominated for
another term but a member cannot remain in office for more than two consecutive terms e+$ect e+-officio

other teachin' aids and the re-uisite s$orts material in ade-uate -uantity and on time.

+ii& #t shall have $owers to sanction leave to the 9ead of the #nstitution includin' casual
leave.
+iii& #t shall ensure that no financial irre'ularity is committed or any irre'ular $rocedure with
re'ard to admission"e+aminations is ado$ted.
+iv& #t shall have the $ower to $ro$ose to the Society rates of tuition fees and other annual
char'es and also review the bud'et of the school $resented by the 2rinci$al for
forwardin' the same to Society for a$$roval.
+v& The 5ana'in' Committee will meet at least twice in an academic session.

Po<er$ and Re$1on$i-ilitie$
i) The 5ana'er " Corres$ondent will be an im$ortant and necessary lin; between the Trust "
Society and the school.
ii& 9e should ensure that the directions from the Society are conveyed to the School
5ana'in' Committee and to the 9ead of the #nstitution $ro$erly.
iii& 9e will e+ercise 'eneral su$ervision over the school( sub,ect to the control of the
5ana'in' Committee.
iv& 9e shall e+ercise such financial $owers as are $rescribed in the Scheme of
5ana'ement and dele'ated to him.
v) 9e shall si'n on the a$$ointment letters( letters for disci$linary action a'ainst the staff and
termination( and sus$ension letters etc. on behalf of the 5ana'in' Committee.
vi& 9e shall not interfere with the 9ead of the school in dischar'e of his res$onsibilities and
duties.
vii& All letters concernin' affiliation"reco'nition shall be countersi'ned by him.
%&! Head of t"e Sc"ool- #utie$@ Po<er$ and Re$1on$i-ilitie$
i) 9ead of the School"2rinci$al will be the e+-officio. 9ony. Secretary of the School 5ana'in'
Committee.
ii& Aill function as( the 9ead of the office of the school under his char'e and carry out all
administrative duties re-uired of a head of office.
iii& Be the drawin' and disbursin' officer for the em$loyees of the school e+ce$t that in the
case of an unaided school( he may $erform only such function( as drawin' and disbursin'
officer as may be s$ecified in the instructions issued by the Society.
iv& Be res$onsible for the $ro$er maintenance of accounts of the school( school records(
service boo;s of teachers( and such other re'isters( returns and statistics as may be s$ecified
by the Society"Board.
v) 9andle official corres$ondence relatin' to the school and furnish( within the s$ecified dates( the
returns and information re-uired by the State 6overnment"Board.
vi& 5a;e all $ayments %includin' salaries and allowances of teachers and other non
teachin' staff& in time and accordin' to the instructions 'overnin' such $ayment.
vii& Ensure that the tuition fees( as levied( are reali)ed and a$$ro$riately accounted for and
duly a$$ro$riated for the $ur$ose for which they were levied.
viii& 5a;e $urchases of stores and other materials re-uired for the school in accordance
with the rules 'overnin' such $urchases and enter all such stores in stoc; re'ister and shall
scrutini)e the bills and ma;e $ayments .
i+& Conduct $hysical verification of school $ro$erty and stoc; at least once a year and
ensure the maintenance of stoc; re'isters neatly and accurately.
+& Be res$onsible for $ro$er utili)ation of the 2u$ils 4und.
+ii& 5a;e satisfactory arran'ements for the su$$ly of 'ood drin;in' water and $rovide
other facilities for the $u$ils and ensure that the school buildin'( its fi+tures and
furniture( office e-ui$ment( lavatories( $lay 'rounds( school 'arden and other
$ro$erties are $ro$erly and carefully maintained.
+ii& Su$ervise( 'uide and control the wor; of the teachin' and non-teachin' staff of the
school.
+iii& Be inchar'e of admission in the school( $re$aration of school timetable( allocation of
duties and teachin' load to the teachers( and shall $rovide necessary facilities to the teachers
in the dischar'e of their duties and conduct of school e+amination in accordance with the
instructions issued by the overnment/!oard from time to time? and he shall dischar'e these
duties in consultation with his collea'ues.
+iv& 2lan the year1s academic wor; in advance in consultation with his collea'ues and hold
staff meetin' at least once a month( review the wor; done durin' the month and assess the
$ro'ress of the $u$ils.
+v& 9el$ and 'uide the teachers to $romote their $rofessional 'rowth and actively
encoura'e their $artici$ation in courses desi'ned for in service education.
+vi& 2romote the initiative of the teachers for self-im$rovement and encoura'e them to
underta;e e+$eriments which are educationally sound.
+vii& Su$ervise class room teachin' and secure co-o$eration and coordination amon'st
teachers of the same sub,ect areas as well as inter sub,ect coordination.
+viii& Arran'e for s$ecial remedial teachin' of the children belon'in' to the wea;er sections of the
community also of other children who need such remedial teachin'.
+i+& Arran'e for informal and non-class room teachin'.

assi'nment and ensure that the assessment and corrections are carried out timely and

2. Service Contract will be entered with each em$loyee as $er the $rovision in the Education Act

%& All a$$ointments to all cate'ories of em$loyees e+ce$t 6rou$ 1*1 em$loyees as $er 6overnment
of #ndia 'radation shall be made by 5ana'in' Committee either by direct recruitment or by
$romotion throu'h a Selection Committee constituted by the School SocietyM Trust and in
accordance with and u$on such conditions as the 5ana'in' Committee may decide( which
shall be consistent with the norms of the Board"6overnment if statutory $rovision e+ists.

%L& The a$$ointment of every em$loyee of a school shall be made by its mana'in' committee.
%J& Ahere any selection made by the Selection Committee is not acce$table to the mana'in'
committee of the school( the mana'in' committee shall record its reason for such non
acce$tance and refer the matter to the trust or society runnin' the school and the trust or
society( as the case may be( shall decide the same.
%C& Em$loyees shall be a$$ointed sub,ect to the $rovisions of this a'reement and they shall have to
com$ly with all the re-uirements of the $rovisions contained herein.
%4! 5edical Certificate and C"aracter Certificate etc!
1. Every em$loyees shall be re-uired to $roduce the followin' certificates on a$$ointment in the
school.
a) 5edical certificate of fitness from a hos$ital established or maintained by the
6overnment or local authority.
b) Two certificates from educationists or any other res$ectable members of Society( not
related to the candidate( certifyin' the character and conduct to the satisfaction of the
school authorities.
c) :ri'inal de'ree"di$loma( certificates alon' with certificate%s& of e+$erience( if any? with
attested $hotoco$ies thereof. :ri'inal certificates will be returned after verification.
%6! Pro-ation
1. E+ce$t in the case of a $urely tem$orary vacancy or leave vacancy or for a s$ecific $ost of
tem$orary nature( every em$loyee shall on initial a$$ointment be on $robation for a $eriod of
one year from the date of his"her ,oinin' the duties. The $eriod of $robation may be e+tended by
the 5ana'in' Committee by a further $eriod not e+ceedin' one year. Services of an em$loyee
durin' $robation may be terminated by the 5ana'in' Committee without assi'nin' any reason
by 'ivin' one month1s notice in writin' or one month1s salary includin' all allowances.
2. #f an em$loyee desires to be relieved durin' the $eriod of $robation( it will be necessary for him
to 'ive one month1s notice in writin' or one month1s salary includin' all allowances unless and
otherwise the 5ana'in' Committee $ermits (rela+ation under s$ecial circumstances.
%7!Confir'ation
1. #f the wor; and conduct of an em$loyee durin' the $eriod of $robation are found to be
satisfactory( he"she will become eli'ible for confirmation on the e+$iry of the $eriod of $robation
or the e+tended $eriod of $robation as the case may be( with effect from the date of e+$iry of
the said $eriod $rovided he"she fulfils the other re-uisite conditions.
2. The em$loyee shall be informed of his confirmation within B months of the com$letion of
$robation $eriod.
%8! Ter'ination of Ser+ice due to A-olition of Po$t$ etc!
1. #f an em$loyee at any time after confirmation intends to resi'n he"she shall 'ive three months1
notice in writin' or three months1 salary includin' all allowances to the 5ana'in' Committee.
2. The 5ana'in' Committee shall also be com$etent to terminate the services of a confirmed
em$loyee only in case of abolition of a $ost due to closin' down of school a class or reduction
in the number of sections of a class or discontinuance of a teachin' sub,ect by 'ivin' three
months notice in writin' or three months salary includin' all allowances.
3. The 5ana'in' Committee shall have the $ower to rela+ the $eriod of notice or $ayment of
salary in s$ecial circumstances.
&9! Retire'ent
1. Every em$loyee includin' 9ead of institution shall retire from service on attainin' the a'e of CD.
9owever if the a'e of su$erannuation falls durin' the academic session( the concerned
em$loyee will retire at the end of the academic session.
2rovided further that if such em$loyee is a reci$ient of =ational"State"CBSE Teachers Award.
9e may be considered for a further e+tension of service for two years after attainin' the a'e of
su$erannuation $rovided he is medically fit and is $re$ared to serve the school. The school
mana'in' committee after considerin' such case of e+tension of service( shall forward the
details to the Board.
2. The 5ana'in' Committee may 'rant e+tension as $er rule of State"7T if the em$loyee has no
mental or $hysical disabilities and his"her services are beneficial to the institution.
3. The Board will be informed of such e+tension by the S5C.
&! WorAin, #ay$ and WorAin, Hour$
1. The wor;in' days and holidays will be as $er State 6overnment Schools or <endriya 0idalayas.
2. The wor;in' hours will be such as may be s$ecified from time to time by the 2rinci$al. =ormally
the wor;in' hours will conform to the <endriya 0idyalayas.
3. Aor;in' hours may be different for teachin' and non-teachin' staff as may be s$ecified by the
2rinci$al.
4. As and when re-uired an em$loyee may be assi'ned any s$ecial duty even if it is to be done
beyond the normal wor;in' hours in the interest of the school.
5. An em$loyee is also re-uired to conduct and or'ani)e co-curricular $ro'rammes and $erform
other duties even beyond the normal wor;in' hours.
&%! Nu'-er of Teac"in, 1eriod$
1. =ormally a teacher should be en'a'ed as a whole-time em$loyee e+ce$t in s$ecial cases
because of the nature of a sub,ect where the wor; load does not ,ustify a whole time teacher.
2. Every teacher shall devote in a year not less than 2DD hours to the teachin' of students( out of
which not more than 2DD hours may be re-uired to be devoted for the coachin' in the school
$remises( of wea; or 'ifted students( whether before or after the school hours.
3. 2rovided that if any teacher is re-uired to devote more than 2DD hours to the teachin' of
students( e+tra remuneration shall be $aid to him at such rate as may be determined( by the
mana'in' committee( for every hour in e+cess of 2DD hours devoted by him to the teachin' of
students.
4. #n the case of an aided school( the e+tra remuneration referred to in sub-rule B2%B& shall be
sub,ect to the $revious a$$roval of the 'rant-in-aid authority to -ualify for aid of !J $er cent of
such e+tra remuneration( and in the case of an unaided reco'ni)ed school( such e+tra
remuneration may be recovered from the students at such $ro$ortionate rate as may be
determined by the mana'in' committee.
&&! 5aintenance of Record -y t"e Teac"er$
1. A teacher is e+$ected to maintain the followin' documents and also any other record as may be
s$ecified from time to time.

&0! Attendance of E'1loyee$
1. Every em$loyee is e+$ected to reach the school $unctually and si'n the attendance re'ister on
arrival before the wor;in' of the school be'ins and also mar; the time of de$arture.
2. An em$loyee who has not si'ned the attendance re'ister as above is liable to be considered
absent from duty for that date.
&2! Contri-utory Pro+ident Fund - Pen$ion Sc"e'e
1. Em$loyees e+ce$t those em$loyed in tem$orary vacancies and on $art-time service( will be
re-uired to become members of the Contributory 2rovident 4und Scheme as re-uired under the
em$loyees1 2rovident 4und and 5iscellaneous 2rovisions Act( !J2 or shall be eli'ible for
$ension and 'ratuity( if ado$ted by the school.
2. Those eli'ible for $ension shall contribute to 624 as $er 6overnment 3ules.
&4! Re1re$entation$
1. 3e$resentation to the 5ana'in' Committee( Chairman of the Society or 5ana'er may be made
only throu'h 2rinci$al in case of teachers"other em$loyees.
2. The 2rinci$al may submit his re$resentation to 5ana'in' Committee"Chairman of the Society
throu'h his ne+t hi'her u$- 5ana'er"Corres$ondent of the School.
&6! Per'i$$ion to add /ualification$
1. =o teacher shall be $ermitted to a$$ly for addin' -ualifications before com$letin' two years
service.
2. #ndividual cases duly recommended by the 2rinci$al may be considered when due by the
5ana'in' Committee as also under s$ecial circumstances before com$letion of 2 years.
&7! A11lication for Anot"er Po$t
1. =o member of the staff shall a$$ly for em$loyment elsewhere without notifyin' throu'h the
2rinci$al in writin' to the S.5.C.( which may 'rant such $ermission.
2. At the time of a$$ointment each candidate will be re-uired to declare $articulars about all other
a$$lications he"she mi'ht have $ut in for ,obs.
&8! Pri+ate and Ot"er Tuition$
1. =o staff member shall underta;e $rivate or any other tuition without $rior $ermission in writin'
of the 2rinci$al"9ead of the #nstitution.
2. 6rou$ Tuitions in the school shall not be allowed.
09! Lea+e
1. Every em$loyee shall be entitled to such leave as are admissible to the em$loyee of a
corres$ondin' status in 6overnment schools.
2. Encashment"accumulation of leave shall also be allowed as $er 6ovt. rules.
0! .rant of Lea+e
1. 8eave cannot be claimed as a matter of ri'ht.
2. 6rant of any leave shall de$end on the e+i'encies of the institution and shall be at the
discretion of the 2rinci$al"5ana'er.
3. E+ce$t in unavoidable circumstances( a$$lications for leave in writin' shall be made in
advance( a letter or a $hone messa'e 'ivin' reasons should reach the 2rinci$al on the day of
absence. Ahen a $hone messa'e is sent( it should be confirmed in writin' by the subse-uent
day. 5erely a$$lyin' for leave will not mean sanction( until and unless the leave is sanctioned
by the sanctionin' authority..
Note( An a$$lication for leave or e+tension of leave should ordinarily be made in 'ood time
before the date from which the leave or its e+tension is sou'ht. #f any em$loyee does
not a$$ly within seven days of the e+$iry of leave for further leave( or has been absent
from the school without leave for ten school days( the em$loyee may be deemed to
have deserted his $ost.

directly or indirectly in their $ublication or as a sellin' a'ent or canvasser for any
$ublishin' firm or trader.
++ii& As;in' for or acce$t( e+ce$t with the $revious sanction of the society( any contribution or
otherwise associate himself with the raisin' of funds of any ;ind or ma;e any collection
whether in cash or in ;ind( in $ursuance of any ob,ect whatsoever( e+ce$t subscri$tion
from the members of any association of teachers.
2. All the teachers are e+$ected to be e+em$lary in their $ublic and $rivate life. Their loyalty( sense
of dedication and inte'rity of character at all times should be an ins$iration of the youth
committee to their care. The teacher shall attend to his duties with care and commitment( be
$unctual in attendance and dutiful in res$ect of classroom and also for any other wor;
connected with the duties assi'ned to him by the 9ead of the school or the Board. 9e shall
abide by the rules and re'ulations of the school and carry out the lawful orders and also show
due res$ect to the constituted authorities.
3. The followin' shall not be deemed as a breach of the Code of Conduct.
i) To a$$ear at an e+amination to im$rove his -ualifications with the 2ermission of the
em$loyer.
ii& To become( or to continue to be a member of any reli'ious( literary( scientific or
$rofessional or'ani)ation or coo$erative society.
iii& To or'ani)e or attend any meetin' outside the school hours sub,ect to the condition that
such meetin' is held outside the school $remises.
iv& To ma;e any re$resentation to the mana'ement for the redressal of any bonafide
'rievance( sub,ect to the condition that such re$resentation is not made in rude or
indecorous lan'ua'e.
0&! Ser+ice BooA$ and Confidential Roll$
1. Service Boo; containin' factual record of the em$loyee( salary scale( increments( $romotion(
leave record( any disci$linary action or reward etc. shall be maintained for each em$loyee on
the form $rescribed by the Education *irectorate of the State"7.T. concerned. The si'nature of
the em$loyee shall be obtained for entries in the Service Boo;. Service Boo; should be duly
attested by the 9ead of the school in the case of em$loyees and by the $erson authori)ed " the
5ana'er " Secretary " Corres$ondent in the case of 9ead of the institution.
2. Annual confidential roll shall be maintained by the school for every em$loyee includin' the
9ead of the institution. The confidential roll will contain assessment of wor; of the em$loyee
durin' the academic year includin' the results. Confidential rolls for the em$loyees shall be
written by the 9ead of the institution and for the 9ead of the #nstitution by the 5ana'er "
Secretary" Corres$ondent.
3. Confidential rolls should be maintained in the form $rescribed by the Education *e$artment of
the State"7.T. concerned and should be ;e$t confidential. Any adverse entry in the confidential
roll should be communicated to the em$loyee concerned. The em$loyee concerned may
re$resent a'ainst the adverse entry. The re$resentation will be considered by the ne+t hi'her
authority and if the hi'her authority is satisfied that the adverse entry is not ,ustified the same
shall be e+$un'ed from the AC3.
4. 2ersonal files shall be maintained by the school for each em$loyee. The ori'inal certificate "
de'rees shall be returned to the em$loyees after verification and 2hotostat co$ies ;e$t in the
$ersonal files. School Authorities should not ;ee$ the ori'inal certificate with them.

2. =o order for sus$ension shall remain in force for more than si+ months unless the Committee( for
reasons to be recorded by it in writin' directs the continuation of the sus$ension beyond the $eriod

3. Ahere the 2rinci$al"5ana'er intends to sus$end any of the em$loyee such intention shall be
communicated to the Chairman of the School( 5ana'in' Committee and no such sus$ension shall
be made e+ce$t with $rior a$$roval of the Chairman of the Committee $rovided that the
2rinci$al"5ana'er may sus$end an em$loyee with immediate effect and without $rior a$$roval of the
Chairman of the Committee if he"she satisfied that such immediate sus$ension is necessary by
reason of the 'ross misconduct within the meanin' of the Code of Conduct or involves moral
tur$itude.
2rovided further no such immediate sus$ension or the sus$ension made with the a$$roval of the
Chairman of the Committee shall remain in force for more than a $eriod of fifteen days from the date
of sus$ension unless it has been communicated to the committee and a$$roved by it before the
e+$iry of the said $eriod. Ahere the intention to sus$end or the immediate sus$ension of an
em$loyee is communicated to the committee( it may if it is satisfied that there are ade-uate and
reasonable 'rounds for such sus$ension accord its a$$roval to such sus$ension.
4. An em$loyee shall be deemed to have been $laced under sus$ension by an order of the /School
5ana'in' Committee.
a) with effect from the date. of the detention( if he"she is detained in custody for a $eriod
e+ceedin' forty ei'ht hours on a char'e of an offence which in the o$inion of the committee
involves moral tur$itude?
b) with effect from the date of his"her conviction( if in the event of a conviction for an offence
involvin' in the o$inion of the Committee moral tur$itude he"she is sentenced to a term of
im$risonment e+ceedin' forty ei'ht hours and is not forthwith dismissed or removed or
com$ulsorily retired from service conse-uent on such conviction.
E;1lanation( The $eriod of forty ei'ht hours referred to in this rule shall be com$uted from the
commencement of detention or conviction as the case may be add for this $ur$ose
intermittent $eriods of detention shall be ta;en into account.
5. Ahere $enalty or dismissal( removal or com$ulsory retirement from service im$osed u$on an
em$loyee is set aside or rendered void( in conse-uence of( or( by a decision of a court of law(
and the disci$linary authority on a consideration of the circumstances of the case decides to
hold further in-uiry a'ainst such em$loyee on the same alle'ations on which the $enalty of
dismissal( removal( or com$ulsory retirement was ori'inally im$osed such an em$loyee shall be
deemed to have been $laced under sus$ension by the committee from the date of ori'inal order
of dismissal( removal or com$ulsory retirement and shall continue to remain under sus$ension
until further orders?
2rovided that no such further in-uiry shall be ordered unless it is intended to meet a situation
where the court has $assed an order $urely on to technical 'rounds without 'oin' into the
merits of the case.
6. An order of sus$ension made or deemed to have been made in these rules shall continue to
remain in force until it is modified or revo;ed by the Committee.
7. Ahere an em$loyee is sus$ended or is deemed to have been sus$ended and any other
disci$linary $roceedin' is commenced a'ainst him durin' the continuance of that sus$ension(
the Committee may for reasons to be recorded by it in writin'( direct that the em$loyee shall
continue to be under sus$ension until the termination of all or any such $roceedin'.
8. An order of sus$ension made deemed to have been made under these rules may( at any time
be modified or revo;ed by the Committee.
9. Su-$i$tence allo<ance( An em$loyee under sus$ension shall( in relation to the $eriod of
sus$ension( be entitled to the followin' $ayments( namely.
a) A subsistence allowance at an amount e-ual to one half of the $ay last drawn by himM
her and in addition to such $ay( dearness allowance at an a$$ro$riate to be $aid in the
same manner as the salary?
b) Any other com$ensatory allowance admissible from time to time on the basis of $ay of
which the em$loyee was in recei$t on the date of sus$ension.
2rovided that the em$loyee shall not be entitled to the com$ensatory allowance unless the
Committee is satisfied that the em$loyee continued to meet the e+$enditure for which such
com$ensatory allowance is admissible.
2rovided that where the $eriod of sus$ension is e+tended beyond three months( the Committee
shall be com$etent to vary the amount of subsistence allowance for the $eriod subse-uent to
the $eriod of first three months as follows.
i) The amount of subsistence allowance may be increased by a suitable amount(
not e+ceedin' fifty $ercent of the subsistence allowance admissible for the
$eriod of the first three months if in the o$inion of the Committee to be recorded
in writin'( the $eriod of sus$ension has been $rolon'ed due to reasons not
directly attributable to the em$loyee.
ii& The amount of subsistence allowance may be reduced by a suitable amount not e+ceedin'
JDP of the subsistence admissible durin' the $eriod of first three months( if in the o$inion of
the A$$ointin' Authority( the $eriod of sus$ension has been $rolon'ed( due to reasons to be
recorded in writin'( directly attributable to the sus$ended em$loyee.
iii& =o $ayment of subsistence allowance shall be made unless the em$loyee furnishes a
Certificate to the effect that he"she is not en'a'ed in any other em$loyment( business(
$rofession or vocation.
2rovided that in the case of an em$loyee dismissed( removed or com$ulsorily retired from service(
who is deemed to have been $laced or to continue to be under sus$ension and who fails to $roduce
such a certificate for any $eriod or $eriods durin' which he"she is deemed be $laced or continue to
be under sus$ension( he"she shall be entitled to the subsistence allowance and other allowances
e-ual to the amount by which his"her earnin's durin' such $eriod or $eriods as the case may be fall
short of the amount of subsistence allowance and other allowances that would otherwise be
admissible to him"her. Ahere the subsistence and other allowances admissible to him"her are e-ual
to or less than the amount earned by him "her nothin' in this $roviso shall a$$ly to him"her.
10. Ahere sus$ended em$loyee is e+onerated after disci$linary $roceedin's or where any criminal
$rosecution a'ainst a sus$ended em$loyee ends with an honorable ac-uittal( the salaries and
allowances of such em$loyees minus the subsistent allowance received by him"her shall be $aid to
him"her from the date on which he"she was sus$ended.
02! Penaltie$
1) The followin' $enalties may( for 'ood and sufficient reasons( includin' the breach of one or more of
the $rovisions of the Code of Conduct may be im$osed u$on an em$loyee.

a) 3etirement of the em$loyee in accordance with the $rovisions relatin' to
su$erannuation( retirement?
b) 3e$lacement of a teacher who has not -ualified on the date of his"her a$$ointment by a
-ualified one?
c) *ischar'e of an em$loyee a$$ointed on a short-term officiatin' vacancy caused by the
'rant of leave sus$ension or the li;e.
04! Procedure of I'1o$in, 5inor Penalty
=o order in case of a minor $enalty shall be made e+ce$t after informin' the em$loyee of the $ro$osal
to ta;e action a'ainst him"her and the alle'ation on which such action is $ro$osed to be ta;en and
e+ce$t after 'ivin' to the em$loyee an o$$ortunity to ma;e any re$resentation a'ainst the $ro$osed
action.
06! Procedure for I'1o$in, 5aBor Penalty!
1. =o order im$osin' on any em$loyee any ma,or $enalty shall be made e+ce$t after an in-uiry is
held as far as may be( in the manner s$ecified below.
a) The disci$linary authority shall frame definite char'es on the basis of the alle'ation on
which the in-uiry is $ro$osed to be held and a co$y of the char'es to'ether with the
statement of the alle'ations on which they are based shall be furnished to em$loyee
and he"she shall be re-uired to submit within such time as may be s$ecified by the -
disci$linary authority but not later than two wee;s( a written statement of his " her
defence and also to state whether he"she desires to be heard in $erson?
b) :n recei$t of the written statement of defence( or where no such statement is received
within the s$ecified time( the disci$linary authority may itself ma;e in-uiry into such of
the char'es as are not admitted or if it considers it necessary to do so( a$$oint an
in-uiry officer for the $ur$ose?
c) At the conclusion of the in-uiry( the in-uiry officer shall $re$are a re$ort of the in-uiry
recordin' his findin's on each of the char'es to'ether with the reasons thereof?
d) The disci$linary authority shall consider the re$ort of the in-uiry and record its findin's
on each char'e and if the disci$linary authority is of o$inion that any of the ma,or
$enalties should be im$osed it shall .-
i& furnish to the em$loyee a co$y of the re$ort of the en-uiry officer( where an in-uiry has
been made by such officer?
ii& 'ive him"her notice in writin' statin' the action $ro$osed to be ta;en in
re'ard to him"her and callin' u$on him"her to submit within the s$ecified time( not
e+ceedin' two wee;s( such re$resentation as he"she may wish to ma;e a'ainst the
$ro$osed action(
iii& on recei$t of the re$resentation if any( made by the em$loyee( the disci$linary authority
shall determine what $enalty( if any should be im$osed on the em$loyee and
communicate its tentative decision to im$ose the $enalty to the Committee for its $rior
a$$roval?
iv& after considerin' the re$resentation( made by the em$loyee a'ainst the $enalty( the
disci$linary authority shall record its findin's as to the $enalty( which it $ro$oses to
im$ose on the em$loyee and send its findin's and decision to the Committee for its
a$$roval and while doin' so the disci$linary authority shall furnish to the em$loyee all
relevant records of the case includin' the statement of alle'ations( char'es framed
a'ainst the em$loyee( re$resentation made by the em$loyee( a co$y of the in-uiry
re$ort( where such in-uiry was made and the $roceedin's of the disci$linary authority.
2) =o order with re'ard to the im$osition of a ma,or $enalty shall be made by the disci$linary
authority e+ce$t after the recei$t of the a$$roval of the Committee.
07! Pay'ent of Pay and allo<ance$ on Rein$tate'ent
1) Ahen an em$loyee who has been dismissed( removed or com$ulsorily retired from service is
reinstated as a result of a$$eal or would have been so reinstated but for his retirement on
su$erannuation Q5ile under sus$ension $recedin' the dismissal( removal or com$ulsory
retirement as the case may be( the Committee shall consider and ma;e a s$ecific order.-
a) with re'ard to the salary and allowances to be $aid to the em$loyee for the $eriod of his
absence from duty includin' the $eriod of sus$ension $recedin' his dismissal( removal
or com$ulsory retirement as the case may be? and
b& Ahether or not the said $eriod shall be treated as the $eriod s$ent on duty.
2) Ahere the Committee is of o$inion that the em$loyee who had been dismissed( removed or
com$ulsorily retired from service has been fully e+onerated( the em$loyee shall be $aid the full
salary and allowances to which he would have been entitled had he not been dismissed(
removed or com$ulsorily retired from service or sus$ended $rior to such dismissal( removal or
com$ulsory retirement from service( as the case may be.
2rovided that where the Committee is of o$inion that the termination of the $roceedin's
instituted a'ainst the em$loyee had been delayed due to reasons directly attributable to the
em$loyee( it may( after 'ivin' a reasonable o$$ortunity to the em$loyee to ma;e
re$resentation( if any( made by the em$loyee( direct( for reasons to be recorded by it in writin'(
that the em$loyee shall be $aid for the $eriod of such delay only such $ro$ortion of the salary
and allowance as it may determine.
3) The $ayment of allowance shall be sub,ect to all other conditions under which such allowances
are admissible and the $ro$ortion of the full salary and allowances determined under the
$roviso to sub-rule L8%2& shall not be less than the subsistence allowance and other admissible
allowances.
08! #i$ci1linary Co''ittee
1) #n case the em$loyee wishes to a$$eal a'ainst the order of the *isci$linary Authority( the
a$$eal shall be referred to a *isci$linary Committee. The *isci$linary Committee shall consist
of the followin'.
a) The Chairman of the School 5ana'in' Committee or in his absence any member of the
Committee( nominated by him.
b) The 5ana'er of the school( and where the disci$linary $roceedin's is a'ainst him"her
any ot"er $erson of the Committee nominated by the Chairman.
c& A nominee of the Board a$$ro$riate authority. 9e" she shall act as an adviser.
d) The 9ead of the school( e+ce$t where the disci$linary $roceedin' is a'ainst him"her( the
9ead of any other school nominated by the CBSE or *irector of Education in case the
Act so $rovides.
e) :ne teacher who is a member of S5C of the school nominated by the Chairman of the
Committee.
2) The *isci$linary Committee shall carefully e+amine the findin's of the #n-uiry :fficer reasons
for im$osin' $enalty recorded by the *isci$linary Authority and the re$resentation by the
em$loyee and $ass orders as it may deem fit.
CHAPTER->III
INTERPRETATION REPEAL AN# SA>IN.
29! Inter1retation
1. :n any -uestion as to the inter$retation of any $rovision of these Bye-laws( the decision of
Chairman shall be final.
2! Re1eal and Sa+in,
1) The e+istin' $rovisions re'ardin' affiliation re'ulations and any notification or orders issued
there under are hereby re$ealed by these bye-laws( $rovided that.
i) such re$eal shall not affect the $revious o$eration of the said re'ulations or any
notifications or orders made( or anythin' done( or action ta;en( there under
ii& Any $roceedin' under the same 3e'ulations $endin' at the commencement of these
Bye-laws shall be continued and dis$osed of( as far as may be( in accordance with the
$rovisions of these Bye-laws( as if such $roceedin's under these Bye-laws.
iii& =othin' in these Bye-laws shall be construed as de$rivin' any $erson to whom these
Bye-laws a$$ly( or any ri'ht of a$$eal which had accrued to him under the re'ulations(
notifications or orders in force before the commencement of these Bye-laws.
iv& An a$$eal $endin' at the commencement of these Bye-laws a'ainst an order made
before such commencement shall be considered and orders thereon shall be made in
accordance with these Bye-laws as if such orders were made and the a$$eals were
$referred under these Bye-laws.
2) As from the commencement of these Bye-laws any a$$eal or a$$lication for review a'ainst any
orders made before such commencement shall be $referred to or made under these Bye-laws
as if such orders were made under these bye-laws.

The benefits of Article BD%& of #ndian Constitution can be claimed by the community only on $rovin' that it is
a reli'ious or lin'uistic minority and the institution was established by it. The -uestion of $roof in a Court of
8aw is re'ulated by the $rovisions of the #ndian Evidence Act. This act re-uires that when there is written
document( other evidence is to be e+cluded but if there is no written document( other evidence is admissible.
%! O-Bect of E$ta-li$"'ent of 5inority Educational
In$titution$
it is not always necessary that the ob,ects for which a minority may establish an educational institution must
include the conservation of its lan'ua'e( scri$t or culture. Article BD% &only em$hasi)es that the body
establishin' and administerin' an educational institution belon's to a minority based on reli'ion or lan'ua'e.
#t says nothin' about the character of education to be im$arted by them. 9ence an institution will be a
minority institution even if it im$arts secular education. :nce it is $roved to be a minority institution( the
character of education to be im$arted and of administration will be at the choice of those who can administer
it. #n these matters( the choice cannot be of anyone also.
&! Fulfill'ent of Statutory ReDuire'ent$ for $eeAin,
Reco,nition
An #nstitution see;in' reco'nition must fulfill the statutory re-uirements concernin' the academic standards(
the -ualifications of teachers( and of the students see;in' admission. #t must have the financial resources
and the ca$ability to run on a sustained basis. Ahen the a$$lications see;in' reco'nition are not cosidered
favorably( 'rounds of re,ection must be communicated to the educational institutions fillin' such a$$lications
so as to enable them to overcome obstacle to their early reco'nition.
0! 5ediu' of in$truction in 5inority Educational
In$titution$
The State 6overnment or the 7niversity is not em$owered to $rescribe the medium of instruction to be
followed by minority educational institutions. 9owever( in case of institutions receivin' 'rants -in- aid( there
are certain standards or $roficiency to be observed. =o decision( within our ;nowled'e lays down that
teachin' of a State lan'ua'e com$ulsorily is within such conditions for 'rant of aid. But if such a condition is
laid down( the institution receivin' the aid will be well advised to observe it.
2! Con$titution of .o+ernin, Bodie$ in 5inority
Educational #nstitutions
The 5inority educational institution must be free to induct com$etent and re$uted individuals from other
communities in the 5ana'in' Committees "6overnin' Bodies. The minority character of an institution is not
im$aired so lon' as the constitution of the 5ana'in' Committee "6overnin'( Body $rovides for an effective
ma,ority to the members of the minority community.
The State should not have any $ower( directly or throu'h the. 7niversity( to direct the constitution of the
'overnin' bodies in a manner so as to de$rive a ma,ority of the effective administration of its educational
institutions. 9owever( the State or the 7niversity may lay down 'eneral 'uidelines to ensure that only1
-ualified $ersons find a $lace in the 6overnin' Bodies.
4! #i$ci1linary Control o+er Staff in 5inority Educational
In$titution$
Ahile the mana'ements should e+ercise the disci$linary control over staff( it must be ensured that they hold
an in-uiry and follow a fair $rocedure before $unishment is 'iven. Aith a view to $reventin' the $ossible
misuse of $ower by the mana'ement of the 5inority Educational #nstitutions( the State has the re'ulatory
$ower to safe'uard the interests of their em$loyees and their service conditions i eludin' $rocedure for
$unishments to be im$osed.
6! Ad'i$$ion of Student$ in 5inority Educational
In$titution$
The minority educational institutions must have the freedom to 'ive s$ecial consideration to the students of
their own community in matters of admission. 6overnment should not insist on admission in these institutions
bein' thrown o$en to all strictly in order of merit. The 6overnment cannot enforce the rules if reservation in
favor of Scheduled Caste( Scheduled Tribes and other bac;ward communities for admission of students in
these institutions.
#n 'rantin' admission to the children belon'in' to the minority community itself( rules of natural
,ustice and fair. $lay must be a$$lied and donations or other e+traneous factors should not be allowed so as
to discriminate a'ainst the less advanta'ed children from the same minority community.
