The Royal 16 Theatre has commissioned Shoshone Strategies & Advisement to

evaluate the possible legal action the complainant (Tommy) may bring upon the Royal 16
Theatre and its consortium, in the form of a class action law suit. The three issues
pertinent to the case are as follows: (1) the matinee price for blockbuster showings; (2)
commercials being shown at the advertised movie show time; and (3) the refund policy of
the theatre.

Our firm performed a legal and statistical analysis of the pertinent issues. Legally
speaking, our firm analyzed if a binding contract was made and if there was fraudulent
misrepresentation on behalf of the Royal 16 Theatre. Our legal analysis made it clear that
the complainant reaffirmed his contract by sitting through all twenty minutes of
commercials and thirty minutes of the movie. Furthermore, the complainant cannot
prove the Royal 16 Theatre violated all six elements of fraudulent misrepresentation. Our
firm also conducted a survey in which we found that six percent of moviegoers
considered the showing of commercials before the actual movie to be intolerable.

After our legal and statistical analysis our firm has concluded that the Royal 16
Theatre should adamantly defend a class action law suit should the complainant pursue
such an action. Our firm also recommends the Royal 16 Theatre advertise the actual
movie show time. Secondly, the Royal 16 Theatre should consider implementing
advertising outside of showing commercials prior to the movie. Finally, the Royal 16
Theatre should establish a refund policy for its unsatisfied customers.
