The Defendant through his counsel moves this Honorable Court pursuant to Fed. R.
Crim. P. 29 for a judgment of acquittal on both Counts One and Two of the Indictment. At the
conclusion of the governments case-in-chief, it failed to present evidence sufficient to prove
beyond a reasonable doubt any of the two counts against Mr. Tazhayakov. In the event the Court
denies Mr. Tazayakovs motion for a judgment of acquittal, in the alternative, Defendant moves
this Honorable Court pursuant to Fed. R. Crim. P. 33 for a New Trial based on the following
reasons: (1) the weight of the evidence in this case is clearly against the verdict as the
Government failed to prove each element of every count beyond a reasonable doubt; (2) the
interests of justice require the granting of a new trial; and (3) errors occurred that require a new
trial. The basis of these motions will be more fully developed when the motions are briefed. In
compliance with this Honorable Courts order on July 21, 2014 and later on July 25, 2014 these
motions will be briefed on or before August 29, 2014.
