Closure of an Establishment

The detailed procedure for closure of the establishment:

1. Notice as per enclosed draft should be displayed in the Notice Board of the Site Office,
simultaneously endorsing copies of the same to all the concerned authorities. Copies of
Notice are to be sered either by hand or by registered post !ith ac"no!ledgment due and
receipts are to be presered.
#. The follo!ing benefits must be paid on the date preceding to the date of closure to all the
!or"ers !ho !ill be completing continuous serice of one $%1& year or more on the day
immediately preceding the date of closure.
a. One month's !age in lieu of notice.
b. 1( days aerage pay of eery completed years of continuous serice or any part
thereof in e)cess of si) months.
*. Notice of retrenchment in +orm ,-. $Copy enclosed& must be sered by personal serice
or by registered post !ithin * days of the date of retrenchment to the follo!ing
authorities:
a. Secretary to the /oernment of 0est Bengal.
b. 1abour Commissioner, /oernment of 0est Bengal.
c. Conciliation Officer, 0est Bengal.
d. Employment Officer, 0est Bengal, -urtha Bhaan, Salt 1a"e.2
3. Serice Certificate in +orm 45 should be issued to all the !or"men in the enclosed
format.
66 -lease note that serices of all the !or"men employed for 7ob88. should be terminated after
paying the aboe benefits. 9n case, you re:uire serices of some of these !or"men for other 7ob,
you can appoint them afresh.
9t is also adised that all the !or"men should be retrenched on the same date.
