IN HIGHER EDUCATIONAL INSTITUTIONS, 2009. 1. PREAMBLE: In view of the directions of the Honble Supreme Court in the matter of University of Kerala v/s. Council !rincipals Colle"es and others# in S$! no. %&%'( of %))* dated +*.)(.%)), and that dated -.)(.%))' in Civil .ppeal number --, of %))' and in consideration of the determination of the Central /overnment and the University /rants Commission to prohibit prevent and eliminate the scour"e of ra""in". 2. OBJECTIVE: 0o eliminate ra""in" in all its forms from universities deemed universities and other hi"her educational institutions in the country by prohibitin" it under these 1e"ulations preventin" its occurrence and punishin" those who indul"e in ra""in" as provided for in these 1e"ulations and the appropriate law in force. 3. WHAT CONSTITUTES RAGGING: 1a""in" constitutes one or more of any of the followin" acts2 a3 .ny conduct by any student or students whether by words spo4en or written or by an act which has the effect of teasin" treatin" or handlin" with rudeness a fresher or any other student. b3 Indul"in" in rowdy or indisciplined activities by any student or students which causes or is li4ely to cause annoyance hardship physical or psycholo"ical harm or to raise fear or apprehension thereof in any fresher or any other student. c3 .s4in" any student to do any act which such student will not in the ordinary course do and which has the effect of causin" or "eneratin" a sense of shame or torment or embarrassment so as to adversely affect the physi5ue or psyche of such fresher or any other student. d3 .ny act by a senior student that prevents disrupts or disturbs the re"ular academic activity of any other student or a fresher. e3 67ploitin" the services of a fresher or any other student for completin" the academic tas4s assi"ned to an individual or a "roup of students. f3 .ny act of financial e7tortion or forceful e7penditure burden put on a fresher or any other student by students "3 .ny act of physical abuse includin" all variants of it2 se7ual abuse homose7ual assaults strippin" forcin" obscene and lewd acts "estures causin" bodily harm or any other dan"er to health or person8 h3 .ny act or abuse by spo4en words emails post public insults which would also include derivin" perverted pleasure vicarious or sadistic thrill from actively or passively participatin" in the discomfiture to fresher or any other student. i3 .ny act that affects the mental health and self9confidence of a fresher or any other student with or without an intent to derive a sadistic pleasure or showin" off power authority or superiority by a student over any fresher or any other student. 4. MEASURES FOR PROHIBITION OF RAGGING: 0here are a number of such measures at institution level University $evel :istrict level etc. Some of them that are important for students to 4now are as follows2 ;o institution shall permit or condone any reported incident of ra""in" in any form8 and all institutions shall ta4e all necessary and re5uired measures includin" but not limited to the provisions of these 1e"ulations to achieve the ob<ective of eliminatin" ra""in" within the institution or outside. .ll institutions shall ta4e action in accordance with these 1e"ulations a"ainst those found "uilty of ra""in" and/or abettin" ra""in" actively or passively or bein" part of a conspiracy to promote ra""in". 6very public declaration of intent by any institution in any electronic audiovisual or print or any other media for admission of students to any course of study shall e7pressly provide that ra""in" is totally prohibited in the institution and anyone found "uilty of ra""in" and/or abettin" ra""in" whether actively or passively or bein" a part of a conspiracy to promote ra""in" is liable to be punished in accordance with these 1e"ulations as well as under the provisions of any penal law for the time bein" in force. 0he telephone numbers of the .nti91a""in" Helpline and all the important functionaries in the institution includin" but not limited to the Head of the institution faculty members members of the .nti91a""in" Committees and .nti91a""in" S5uads :istrict and Sub9:ivisional authorities =ardens of hostels and other functionaries or authorities where relevant shall be published in the brochure of admission/instruction boo4let or the prospectus. 0he application for admission enrolment or re"istration must be accompanied by an .nti 1a""in" affidavit si"ned by a student in a prescribed format and another .nti 1a""in" .ffidavit si"ned by a !arent//uardian. >Both these Affidavits can be downloaded from the Web 3 .ny distress messa"e received at the .nti91a""in" Helpline shall be simultaneously relayed to the Head of the Institution the =arden of the Hostels the ;odal ?fficer of the affiliatin" University if the incident reported has ta4en place in an institution affiliated to a University the concerned :istrict authorities and if so re5uired the :istrict @a"istrate and the Superintendent of !olice and shall also be web enabled so as to be in the public domain simultaneously for the media and citiAens to access it. ?n receipt of the recommendation of the .nti 1a""in" S5uad or on receipt of any information concernin" any reported incident of ra""in" the Head of institution shall immediately determine if a case under the penal laws is made out and if so either on his own or throu"h a member of the .nti91a""in" Committee authorised by him in this behalf proceed to file a Birst Information 1eport >BI13 within twenty four hours of receipt of such information or recommendation with the police and local authorities under the appropriate penal provisions. 0he Commission shall maintain an appropriate data base to be created out of affidavits affirmed by each student and his/her parents/"uardians and stored electronically by the institution either on its or throu"h an a"ency to be desi"nated by it8 and such database shall also function as a record of ra""in" complaints received and the status of the action ta4en thereon. 0he Commission shall include a specific condition in the UtiliAation Certificate in respect of any financial assistance or "rants9in9aid to any institution under any of the "eneral or special schemes of the Commission that the institution has complied with the anti9ra""in" measures. .ny incident of ra""in" in an institution shall adversely affect its accreditation ran4in" or "radin" by ;..C or by any other authorised accreditation a"encies while assessin" the institution for accreditation ran4in" or "radin" purposes. 0he Commission may accord priority in financial "rants9in9aid to those institutions otherwise eli"ible to receive "rants under section +%C of the .ct which report a blemishless record in terms of there bein" no reported incident of ra""in".
5. ADIMINISTRATIVE ACTION IN THE EVENT OF RAGGING: 0he institution shall punish a student found "uilty of ra""in" after followin" the procedure and in the manner prescribed here in under2 0he .nti91a""in" Committee of the institution shall ta4e an appropriate decision in re"ard to punishment or otherwise dependin" on the facts of each incident of ra""in" and nature and "ravity of the incident of ra""in" established in the recommendations of the .nti91a""in" S5uad. 0he .nti91a""in" Committee may dependin" on the nature and "ravity of the "uilt established by the .nti91a""in" S5uad award to those found "uilty one or more of the followin" punishments namely8 a3 Suspension from attendin" classes and academic privile"es. b3 =ithholdin"/ withdrawin" scholarship/ fellowship and other benefits. c3 :ebarrin" from appearin" in any test/ e7amination or other evaluation process. d3 =ithholdin" results. e3 :ebarrin" from representin" the institution in any re"ional national or international meet tournament youth festival etc. f3 Suspension/ e7pulsion from the hostel. "3 Cancellation of admission. h3 1ustication from the institution for period ran"in" from one to four semesters. i3 67pulsion from the institution and conse5uent debarrin" from admission to any other institution for a specified period. !rovided that where the persons committin" or abettin" the act of ra""in" are not identified the institution shall resort to collective punishment. .n appeal a"ainst the order of punishment by the .nti91a""in" Committee shall lie >i3 in case of an order of an institution affiliated to or constituent part of a University to the Dice9 Chancellor of the University8 >ii3 in case of an order of a University to its Chancellor. >iii3 in case of an institution of national importance created by an .ct of !arliament to the Chairman or Chancellor of the institution as the case may be. =here in the opinion of the appointin" authority a lapse is attributable to any member of the faulty or staff of the institution in the matter of reportin" or ta4in" prompt action to prevent an incident of ra""in" or who display an apathetic or insensitive attitude towards complaints of ra""in" or who fail to ta4e timely steps whether re5uired under these 1e"ulations or otherwise to prevent an incident or incidents of ra""in" then such authority shall initiate departmental disciplinary action in accordance with the prescribed procedure of the institution a"ainst such member of the faulty or staff. !rovided that where such lapse is attributable to the Head of the institution the authority desi"nated to appoint such Head shall ta4e such departmental disciplinary action8 and such action shall be without pre<udice to any action that may be ta4en under the penal laws for abetment of ra""in" for failure to ta4e timely steps in the prevention of ra""in" or punishin" any student found "uilty of ra""in".
