Conclusion

Presently in the corporate sector it is necessary to be in line with the international trade law
aspects, especially when dealing with international business. United Nations Convention on
Contracts for the International Sale of Goods (CISG) is an Act which is there to handle that
aspect in terms of law.

In this report the major aspects such as the introduction on the Article 11 of the CISG which is
about the A contract of sale need not be concluded in or evidenced by writing and is not subject
to any other requirement as to form. It may be proved by any means, including witnesses. has
critically analyzed.

Furthermore in terms of electronic contracts the report elaborated its viewpoints by taking
account of the facts such as E-mail, World Wide Web, Acceptance in unilateral contracts,
Jurisdiction and communication of acceptance, Electronic Signature, Electronic Conveyance etc.
Under this review the Other articles related to Article 11 also been reviewed as CISG does not
directly explained about electronic transactions as internet and other advance electronic means
were not invented at the time CISG was adopted, similarly there is no specific limitation
mentioned in the CISG on entering to an agreement of sales of goods. However by considering
the few CISG article discussed about the electronic means, one of the strong articles is article 13:
For the purposes of this Convention writing includes telegram and telex.

Other than the articles in CISG, there are many laws adopted in order to address contracts
developed by electronic means such as United Nations Convention on the use of electronic
communications in international contracts (New York, 2005) and UNCITRAL Model Law on
Electronic Signatures (2001) which is about a model law that facilitate with electronic signature which
can be equivalent to the hand written signature also been reviewed in detailed manner.

Finally, as an overall context of the Article 11 of CISG the above given facts under the report
critically evaluate the cost vs. benefit analysis thus gives an outline as the drafting of the article
includes some gaps and but the higher volume of excluding factors.
