PETITIONERS REQUEST FOR FURTHER RELIEF
Comes now the petitioner, pro se, requesting from This Court further relief in this
matter which has been remanded from the Court of Appeals.
Petitioner respectfully requests This Court issue an order directing the Respondent
to refund monies paid by Petitioner to Respondent.
Respondent appears disinclined to appeal the matter further as the time for fling a
Notice of Appeal has passed.
Pursuant to PHILLIPS (BOBBIT) v. PHILLIPS No. E2012-01957-COA-R3-CV
(April 30, 3013) Petitioner contends that This Court has the authority to grant, and
Petitioner is entitled to, an order for restitution of monies collected by Respondent
from Petitioner.
As PHILLIPS reveals, Respondent collected funds from Petitioner without due
process and in violation of Petitioners constitutional rights.
An order to return Petitioners monies is not an attempt or avenue to reach the state
treasury. An order to return Petitioners monies is, however, an avenue for
Petitioner to reacquire his personal property currently in the possession of the state.
