Conclusion
The marriage rules in the Serbian Orthodox Church have been brought after the law of
Orthodox Church and the Serbian Orthodox Church Constitution in 1933. In the period of
rules bringing, which have been in parts completely different comparing with the Civil Law of
the kingdom of Serbia and there was a dispute between the Civil law derogation by the
churchs marriage rules. According our project research we found out that the Rules could not
derogate the civilian law system, as it is not possible that the rules of one confession can not
change or cancel the state law regulative. However, the period between 1933 and 1945 was a
period when the church courts were arbitrated and the period of civil law derogation as the
Church was accepting its own marriage rules upon the civil law regulations. The marriage
could be canceled till the unrecognizable level for the church- as the blood relationship may
be- so the marriage rules describe and explain it. If the person with the mental illnesses
married we have the interest collision between the marriage rules and the legal code. The
legal code can not recognize the marriage and the marriage rules say it can be rebut. The
lawyers congress of Yugoslavia, which was held in 1931, pointed on problem of managing
marriage rules by churches and confessions instead of the state suggesting on the civil
regulation which will be the same for all religions and confession.
