Facts:
Petitioners, claiming to be the heirs of an!el "i#era, $led before the co!rt an
application for the iss!ance of an o%ner&s d!plicate alleging that the original cop' of
the title %as lost( destro'ed d!ring the liberation of anila. )he heirs also pra'ed
that the co!rt cancel the t%o enc!mbrances appearing on the certi$cate of title.
*ne of %hich is a claim b' +arcia ,-!dgment debt. le#' !pon e/ec!tion0. And the
other is the appointment of an administrator o#er the estates of an!el.

No. 4ections 159 and 112 of Act No. 697 pro#ide that the co!rt ma', !pon petition,
order the reiss!ance of a d!plicate o%ner&s cop' of title. A memorand!m stating
that it is a mere d!plicate shall be placed on the ne% certi$cate of title. 1t shall be
considered as the original cop'. )he co!rt ma' onl' do so !pon notice to all parties.
