Adjournment 2of2 Resolutions REGULAR MEETING 22 OCTOBER 2014 BOARD OF EDUCATION LODI, NEW JERSEY RESOLUTION RESOLUTION RE: ‘SCHOOL DISTRICT REPORTING OF HARASSMENT/INTIMIDATION/BULLYING OFFERED BY TRUSTEE: ‘SECONDED BY TRUSTEE: WHEREAS, the Lodi Board of Education has recelved the Superintendent's report Of incident(s) of Harassment/Intimidation/Bullying (*HIB") within the District; and WHEREAS, the Board has the opportunity to review the Superintendent's ‘recommendations with respect to the Incident(s) of HIB. NOW, THEREFORE BE IT RESOLVED, that the Board may or may not accept the Superintendent's recommendations, BE TT FURTHER RESOLVED, that pursuant to N.J.A. 18A:37-15(d), the building Principal shall inform the applicable parents/quardians of the students involved in these ‘incidents with the folowing information within five (5) school days ofthis Board meeting: 1. The nature ofthe investigation; 2. ‘Whether the District found evidence of HIB; 3. Whether discipline was imposed; 4. The heath history and immunization record shall be removed fom the student's health record and placed in the student's mandated record upon graduation or termination and kept ‘according tothe schedule set forth in NJLA.C. 6A:32+78. ‘The transfer of student health records when a student transfers to or from a school district shall be in accordance with NJ.A.C. 6A:16-7.1 et seq. ‘Any Board of Education employee with knowledge of, or access to, information that identifies a student as having HIV infection or AIDS; information obtained by the school’s aleohol or drug program which would identify the student as an aleohol or drug tse, or information provided by a secondary school student while participating in a school-based alcohol or drug counseling program that indicates parent, guardian, oF other person residing in the student's household is dependent upon or illegally using a substance shall comply with restrictions for sharing such information in accordance with NJAC. 6A:16-2.4(b) through (e) and as required by Federal and State statutes and regulations ‘Access 10 and disclosure of information in a student's health record shall meet the requirements of the Family Education Rights and Privacy Act (FERPA), 20 USC. § (232g, and 34 CFR Part 99, incorporated herein by reference, as amended and supplemented, and N.J.A.C. 6432-7, Student Records The schoo! district shall provide aecess tothe student's health record to licensed medical personnel not holding edueational cenfication who are working under contract with or as employees of the school district only to the extent necessary to enable the licensed ‘medical personnel to perform their duties. Scctolarial or clerieal personnel under the supervision of the certified school nurse shall be permitted access to those portions ofthe student health record necessary for entry and recording of data and for conducting routine
