After reviewing all of the information regarding the alleged policy violations and the results of the predisciplinary meeting conducted on DATE, there is sufficient evidence to show that you were sleeping on the job. This letter is to inform you that you are discharged from your position as a Project Manager with this agency as of 3:00 p.m., DATE. This action is based on your failure to adhere to the following policy: DOC Policy 1.3.2, Guidelines for Employee Performance and Conduct V. PROCEDURES: A. On-the-Job Performance Employees are responsible for performing duties as specifically assigned either orally or in writing, and as guided by the Code of Ethics and Department policies. C. Unacceptable Performance and Conduct 11. Failure to remain alert and vigilant while on the job. Your disregard for this policy has been specifically demonstrated when on DATE you were found sleeping in the perimeter vehicle, an armed post, while on duty. You never notified your supervisors regarding possible not feeling well or a need to be relieved from your post. Your negligence in carrying out your duties jeopardizes the safety and security of inmates, staff, and the public. For this reason and your probationary status I am terminating you from your position as a Correctional Officer with Montana Department of Corrections. You may provide a written response to this letter. You may also file a grievance in accordance with the provisions of your collective bargaining agreement.
