Subject – Apartments 5I and 5L Tower (5) Tulip at South City Garden

Dear Ayush,

Thank you for your letter dated 20th December 2009 informing me about the
completion of Construction of the Residential Complex. In the same letter South
City mentions they are ready to give us the apartment for possession for
fitments and furnishings.

In the same letter you have also demanded payment for amounts owing to South
City, and this includes the last 10% payment of the Apartment Cost which is only
due upon Possession.

On receiving the letter, my mother and I had the opportunity of visiting the
apartments 5 I and 5 L of Tulip block, which my father (Mr. P.B. Ghosh Dastidar)
and I had purchased respectively.
From our viewing of the apartment, a few things were very evident –
(1) Construction for neither of the two apartments were completed
(2) Features that were promised by South City Garden have not been
provided
(3) There is poor quality of construction work evident at many places in the
two apartments

All of which raises the following concerns –


(4) Why was no Quality Check done by the Engineers to spot and rectify
construction flaws?
(5) Why is South City asking for the 10% Apartment Cost amount when the
apartment is far from being complete, leave alone ready for possession?
(6) By handing over the matter to a Handover Unit, why is South City
attempting to push ownership of Construction related matters to a
different and unrelated set of people?
(7) By declaring the construction as complete and the apartments ready for
possession, why is South City Garden attempting to put the onus entirely
on the apartment owner to point out the items that need to be rectified?
This letter is being sent for the following two reasons –
(a) highlight points related to (1), (2), (3) mentioned above. These follow in
attached enclosures
(b) to mention explicitly that, my father and I will not pay the 10% Apartment
Cost that only becomes due on Possession. Do note that both my father
and I are ok to pay the Amenity Costs listed in your letter
I would urge you to please correct the points mentioned in the enclosures.

Only then will our ‘Dreams’ about our apartments become a reality. Only then
can we even contemplate Velvety Red/Pearly Pink colours, the recliner in the
living room, or even the piano facing the balcony.
