PROCESS OF RECOGNITION (IRA 1967) Claim for Recognition (Sect. 9) Employer must eply within 21 days (Sect 9(3)) ¥ ¥ ¥ Voluntary recognition (Sect. 9 (3) (a)) Refuse to grant recognition Apply to DGIR to ascertain (Sect. 9 (3) (b)) whether the union fulfills ae the requirements or not by ae giving the union a written Commence collective bargaining Give reasons notice. (Sect. 9 (3) (c)) Fails to gi reasons ¥v (sect. 9 Report to DGIR (4)) DGIR Is authorized to: 1. Take any steps to resolve the disputes (Sect.9 (14) 2. Request for necessary info from TU or employer to resolve the dispute. (Sect. 94(2)(a) 3. Refer to the DGTU for decision on the competence of the TU: a. Membership check b. Secret ballot ¥ Ifnot resolved + Refer to Minister of HR. (Sect: 9 (4c). If more than 50% of the employees belong to the union, MOHR will grant recognition (Sect. 9 (5)). Decision cannot be questioned. (Sect. 9(6))
