1. That I, Mr.

S, of legal age and a resident of Tetuan, Zamboanga City, operate


a small business of selling DVDs, belts, sunglasses, watches and towels near
the BusTerminal at Guiwan, Zamboanga City.
2. That on December 1, 2014, Mr. M, of legal age and a resident of Bis, Cagayan
de Oro City, posted online through social media, in http://www.facebook.com
specifically, that he was selling his car, a 2011 model Honda Jazz, subject to
negotiations.
3. That on the same day at around 9 oclock in the evening, upon seeing his
post, I contacted Mr. M through the said social media site to communicate my
interest in buying his car.
4. That he contacted me back on the same day and initially offered to sell me
his car for six hundred thousand pesos.
5. That I countered his offer and was able to lower the price to five hundred
thousand pesos, to which he agreed.
6. That apart from the agreed price, we also agreed that we would meet at the
Grand Hotel around 1 oclock in the afternoon on Decemeber 5, 2014 at
Cagayan de Oro City where the car is located.
7. That on December 3, 2014, I booked a flight to Cagayan de Oro City and
accomodations for two days at the said hotel.
8. That on December 5, 2014 at around 9 oclock in the morning, I arrived at
Cagayan de Oro City and that I called Mr. M to inform him of my arrival, but
he did not pick up his phone.
9. That I checked in at the Grand Hotel at around 11 oclock in the morning and
again tried to call Mr. M, but again he did not pick up his phone.
10.That during my whole stay in the said hotel in Cagayan, I consequently tried
to contact Mr. M to pursue the deal.
11.That at around 4clock in the afternoon and afterwards, I was no longer able
to reach Mr. M though his cellular phone.

12.That, sensing that the deal would no longer push through, I booked a flight to
Zamboanga City and left Cagayan de Oro City at around 7 oclock in the
evening the following day.
13.That up to this date, despite my several attempts to contact him through the
social media site and his cellular phone, I have not yet to receive any word or
explanation from Mr. M on why he did not honor our deal. Thus, this
complaint.
I pray to this honorable court that, since there has been a perfected consensual
contract between Mr. M and I on December 1, 2014, he be compelled to deliver the
car and pay for the expenses I have incurred in pursuing the deal, and I be awarded
an amount equivalent to the profit I could have earned had I not closed the shop on
Decemeber 5 and 6, 2014, attorneys fee and such other relief the court may grant.
