These IDs currently fall under the list of acceptable forms of photo ID found in Chapter 6 of the Travel Document Check (TOC) sop. The REAL ID Act of 2005 sets forth certain requirements for State driver's licenses and IDs to be considered acceptable by a Federal agency for official purposes. Driver's licenses and state-issued IDs must be distinguishable as compliant or non-compliant with those requirements. Specifically driver's licenses or state-issued IDs that do not comply with the act will be clearly labeled “not for official purposes,” “not for federal use,” or with: similar language. At this time, TSA accepts both compliant and non-compliant driver's licenses and state-issued IDs. When an individual presents a driver's license or state-issued ID with “not for jot for federal use,” or language imprinted, the TDC officer must accept the ID using the procedures in Section 3.2. In the future, TSA will implement a plan to fully enforce the REAL ID Act, including changing the procedure as to these licenses. Additionally, several states are developing electronic driver's licenses in the form of smart phone applications.
