Section I. Chapter 40 of the Code of Ordinances of the City of Warwick is hereby amended to
add the following:
Sec. 22-79. - Refuse container maintenance.
a)
It shall be unlawful to maintain open refuse containers or receptacles or containers
which are inadequate for the volume of refuse generated at the premises which the containers
serve. It shall be the responsibility of the property owner and/or tenant and/or person in
responsible charge of the premises to assure that containers are adequate and covered, and that
the area surrounding the containers is kept free and clear of garbage, refuse, rubbish, trash and
litter. It shall be unlawful for any owner and/or operator and/or tenant to allow such garbage or
refuse containers or receptacles to be overloaded or the contents thereof to remain in unsecured
containers. In the event the contents of such containers shall become blown or scattered upon any
public street or way, or upon or over nearby premises, the owner and/or operator and/or tenant of
the premises served by such container or receptacle shall be responsible for gathering up any
such blown or scattered material.
b)
It shall be unlawful for any person to dump litter, trash, rubbish, garbage or any refuse
into a refuse container without the permission of the owner, lessee or renter of the refuse
container.
c)
Penalties for violation of this ordinance shall be in accordance with Sec. 1-4 of the Code
of Ordinances.
Section II. This Ordinance shall take effect upon passage and publication as prescribed by law.

Section I. Chapter 56 of the Code of Ordinances of the City of Warwick is hereby amended to
add the following:
Sec. 56-5. Bid procedure.
(a)
Submission of bids.
(1)
All bids shall be submitted in a sealed enclosure and clearly marked as such. Bids
opened inadvertently due to lack of proper identification shall be immediately
resealed, and a log of such occurrences maintained by the purchasing agent.
(2)
All bid submissions from corporations, limited liability companies and other legal
entities shall include a certificate of good standing dated no more than thirty (30)
days prior to the date of the date upon which the bids will be opened.

Bid opening meetings.


Bids shall be opened at a public meeting at the time, date and place contained in
invitation to bid. The purchasing agent shall prepare and post an agenda notice at
least five days prior to the scheduled meeting date.
The opening of bids shall be in the order established by the posted agenda and the
agenda shall continue uninterrupted until completion.
Once an agenda item has been reached and any bid on that agenda item has been
opened, no other bid on that agenda item will be accepted and any such bid shall
be deemed late.

(c)
Determination of lowest responsible bidder. In determining the lowest responsible
bidder, the awarding authority, consistent with section 6-12 of the Charter, shall consider:
(1)
The ability, capacity and skill of the bidder to perform the contract or provide the
service required.
(2)
Whether the bidder can perform the contract or provide the service promptly, or
within the time specified, without delay or interference.
(3)
The character, integrity, reputation, judgment, experience and efficiency of the
bidder.
(4)
The quality of performance of previous contracts or services.
(5)
The previous and existing compliance by the bidder with laws and ordinances
relating to the contract or service.
(6)
The sufficiency of the financial resources and ability of the bidder to perform the
contract or provide the service.
(7)
The quality, availability and adaptability of the supplies or contractual services to
the particular use required.
(8)
The ability of the bidder to provide future maintenance and service for the use of

The ability of the bidder to provide future maintenance and service for the use of
the subject of the contracts.
The vendors location alone is not a criteria, but the total cost of a purchase shall
be considered when evaluating the lowest qualified bidder. Total cost includes:
handling/shipping fees and transportation surcharges connected to the initial
purchase and any follow-on maintenance or training needs.

(d)
Award to other than low bid. When a bid is awarded to other than the lowest bid, a
full and complete statement of the reasons therefor shall be prepared and maintained by the
purchasing agent for bids between $1,000.00 and $2,500.00 and shall be placed on the public
record of the city council for bid items in excess of $2,500.00.
(e)
Authorization of further negotiation. When proposals for bid are submitted to the
city, and, in the opinion of the city council finance subcommittee, further negotiation with the
low bidder may result in a decrease in the price bid for the bid item as specified, the city council
finance subcommittee may authorize the finance director to negotiate with the low bidder only,
such negotiation to occur prior to the awarding of the bid. The finance director, in any case in
which he/she has been authorized to negotiate pursuant to this subsection, shall report to the city
council finance subcommittee at the business meeting next following said authorization.
Section II. This Ordinance shall take effect upon passage and publication as prescribed by law.

RESOLUTION TO THE GENERAL ASSEMBLY SUPPORTING HOUSE BILL


2015 H 5044 REGARDING TAXATION OF DEVELOPMENT PROPERTY
Resolved that,
WHEREAS, the health, safety and welfare of the citizens of the City of Warwick are
matters of paramount importance to the City Council; and
WHEREAS, Rhode Island General Laws 44-5-12 addresses the Levy and Assessment of
Local Taxes; and
WHEREAS, House Bill 2015 H 5044 proposes to amend that law to exempt new
construction on development property, as defined in the proposed amendment, from taxation
while the property is unoccupied or on the market for sale; and
HEREAS the City Council desires to support the proposed amendment as furthering

the public health, safety and welfare of the citizens of the City of Warwick.
NOW THEREFORE, BE IT RESOLVED the Warwick City Council endorses passage of
House Bill 2015 H 5044.

The City Clerk is hereby directed to forward a copy of this Resolution to the Senators and
Representatives from the City of Warwick.
This Resolution shall take effect upon passage.

RESOLUTION AUTHORIZING THE PONTIAC RECLAMATION, LP TO ACQUIRE
AN EASEMENT ACROSS KNIGHT STREET FOR THE INSTALLATION OF A
STORMWATER DRAIN TO THE PAWTUXET RIVER
RESOLVED THAT:
WHEREAS, Pontiac Reclamation, LP is the Owner of the a parcel of land commonly
referred to as Cranston Sanitary Landfill, and
WHEREAS, in connection with necessary work being performed on the landfill in
coordination with the Rhode Island Department of Environmental Management (RI DEM), a
stormwater collection system must be constructed, and
WHEREAS, it is necessary to cross Knight Street, a public right-of-way located within
the City of Warwick, with a stormwater drain to discharge runoff to the Pawtuxet River, and
WHEREAS, it is necessary to obtain a Physical Alteration Permit from the City of
Warwick Department of Public Works prior to performing any work within the City right-ofway, and
WHEREAS, Pontiac Reclamation, LP has requested a drainage easement from the City
of Warwick to install and maintain a stormwater system in accordance with the attached Deed
of Easement.
NOW, THEREFORE, BE IT RESOLVED, that the Warwick City Council hereby
authorizes Pontiac Reclamation, LP to install the proposed improvements across Knight Street
and further that Mayor Avedisian is hereby authorized to execute the attached Deed of Easement
and any other necessary documents on behalf of the City of Warwick to grant the easement.
This Resolution shall take effect upon its passage.
