MUNICIPAL ORDINANCE NO. 011-2011

AMENDING SOME SECTIONS OF ORDINANCE NO. 01-2001, AS AMENDED,
OTHERWISE KNOWN AS THE TOWN FIESTA ORDINANCE OF GUINOBATAN,
ALBAY.

Be it ordained by the Sangguniang Bayan of Guinobatan, Albay, in session assembled,

that:
Section 1.

Amendatory Provisions:
a. Section 3, paragraph (a) is hereby amended to read as follows:
a. All spaces intended for dry goods, plastic and glass wares and other
similar items which measures 2m x 4m each shall be rented by way of
package deal to intended and qualified applicants at the rate of Php6,400.00
per space of inclusive of regulatory fees and charges except electric
consumption. However, spaces intended for Guinobatan Traders shall be
duly considered and shall not be covered by package deal.

Provided further, that in the event that the package deal is not feasible as
there is no taker or interested trader-applicant, the awards committee has
the authority to device a scheme on how they can profitably award/ sell the
spaces for interested vendors/ traders, in the most reasonable and most
advantageous manner to the LGU.
b. Section 4, paragraphs (a) and (b) are also amended to read as follows:
a. All spaces intended to be rented out by the Municipal Government shall
be awarded by an awards committee composed of the following:

Municipal Mayor

Municipal Treasurer

SB Chairman Committee on Trade,

Industry & Economic Enterprises

SB Chairman Committee on Finance,
Budget & Appropriations
b. The schedule of dates for the awarding of all the spaces to be rented out
by the LGU shall be determined/ fixed by the Awards Committee between
the last week of June and second week of July of every year by way of
committee resolution.
Section 2.

Separability Clause. If, for any reason or reasons, any part of provision of this
Ordinance shall be held to be unconstitutional or invalid, other parts of provisions
hereof which are not affected thereby shall continue to be in full force and effect.

Section 3.

Repealing Clause. Any Ordinance, or part or parts thereof which are inconsistent
with any of the provisions of this Ordinance are hereby repealed or modified
accordingly.

Section 4.

Effectivity. This Ordinance shall take effect immediately upon its approval.
