Artifact 2 Reflection

In the assignment Current Case Assignment, Fernandez vs. California, I

have gained knowledge about the practical of the law under certain
situation. The court gives the right to the officers to search and seizure the
place without any search warrant. At the beginning, when I skim the article, I
feel warrantless search should not be allowed. However, after I get engage
with the case, my perspective turns different way. I totally agree with the
Supreme Court decision that allows the officers to do search without warrant
under certain condition. The inspection of Fernandezs apartment has been
followed by the strong justification. The officers have been following
Fernandez quite long to make sure that he commits the robbery with his
gangs. Moreover, the report from Lopez about the misconduct treatment that
Fernandez has done to him makes the assumption about Fernandez stronger
that he commits the crime. When the officers chase him to his apartment,
the officers also figure out that Roxanne got injured and bloody. All of this
matter convinces the officers to take him under arrest. In order to make the
valid assumption, the officers came back to the apartment where Fernandez
and Roxanne live to find the evidences. As the result, they found the strong
evidence that related him with his crime.
This assignment also open up my knowledge about the 4 th Amendment
does not violate under the certain circumstances. The Fernandezs argument
that says he has the right to refused the search without warrant is invalid
since he is no longer in the apartment; moreover, the oral and written

agreement from Roxanne who is a tenant is valid since she is in there at that
time. Looking at the different case, such as Randolph vs. Georgia makes me
realize the distinction between the 4th Amendment has violated or not.
Randolph refused the searchless warrant because his presence as a tenant is
valid when the officers want to inspect his apartment. Overall, I am really
interested in analyzing the case since it is new things for me to know more
about the practical of law in the U.S. I have gained more in critical thinking in
this assignment.
