In a previous article the Perform-
ance Based Code (PBC) was discussed
and an explanation was given about
the new acronyms used in the code.
As indicated, this article will attempt
to answer the question, “How does
it all work and where do 1 fit in as
an inspector?”
The Flow Chart: an Introduction
‘An explanatory flow chart appears
as Appendix F in ASME. A17.7-2007/
CSA B44.7-07 and shows the role of
the authorities having jurisdiction
(AH) in the New Technology Process.
The location and size of the AH)
function box on the chart are not
representative of the importance of
the AHJ. Just as in ancient times ("All
roads lead to Rome”), here all
processes go through the AH). Let's
first look at the process,
New Technology of the First Kind
Three options are provided for
complying with the PBC. The first
pertains to equipment or systems
that comply with the ASME A17.1/
CSA B44 Safety Code for Elevators
and Escalators. Compliance is usually
very clear, and this option serves to
establish equivalence between
AIT.7/B44,7 and A17.1/B44, The AH]
of regulatory authority will typically
issue permits for installation or alter
ation as appropriate. The flow chart
shows that there isa direct path from
the new product design to the AHJ
and finally to installation.
New Technology of the Second Kind
‘The second option provided by
the PBC is one where portions of the
system comply with the A17.1/B44
Code but other portions do not
comply ot are not addressed by that
code. in this case, those portions that

comply with the code are identified
by the manufacturer. Those that do
not comply or are not addressed by
the code proceed through the evalu-
ation process beginning with the
identification of the global essential
safety requirements (GESRS), then the
performance of a risk assessment
(RA) with the identification of the
appropriate safety parameters (SPs)
where applicable, the mitigation of
risks and the preparation of the code
compliance document (CCD). The CCD
is then presented to the accredited
elevator/escalator certification organ
ization (AECO). The AECO evaluates
the CCD to determine if the proper
procedures have been followed and
the technical contents of the docu-
ment are sound and verifiable and
that the design is safe. If the CCD is
accepted by the AECO, a certificate
of conformance (COC) is issued to
the manufacturer, If the CCD is not
accepted by the AECO, the documents
are returned to the manufacturer to
correct noted shortcomings in the CCD
or to provide information required by
the AECO. This process will be
repeated until the AECO approves
the CCD, and a COC is granted. The
‘manufacturer then takes the COC to
the AH) or Regulatory Authority who
will review the documents and issue
the appropriate permits
New Technology of the Third Kind
The third option provides a
process for meeting all GESRs in the
PBC. In this case, all components
proceed through the evaluation
process described above and shown
‘on the flow chart, This option is
more applicable to components than
complete elevator systems.Performance-Based Code
There is one very’important characteristic of the over-
all process that should be noted; everything goes through
the AH). Also contained within the notes on the flow
chart is the recognition that the AH) may, based on its
abilities and resources, provide the certification function
in its jurisdiction in lieu of an AECO.
‘The process provided by the PBC is so much better for
the AH, which will not need to continue to enforce pre-
vious versions of Section 1.2 of the AI7.1/B44 code and
allow variances and provide equivalent safety rulings for
new technology applications.
