On January 26, 2015, the Pennsylvania State Police (PSP) received your request.
for information pursuant to the Pennsylvania Right-To-Know Law (RTKL), 65 Pa. STAT
ANN. §§ 67.101 — 67.3104, wherein you requested: A list of items purchased by PA State
Police (or other state agencies in conjunction with PSP) between 9/12/14 and 10/31/14
relating to the search for Eric Matthew Frein in Pike and Monroe Counties, Please include
prices for each item purchased as well as which vendor/supplier was used to purchase
them. List would include, but not be limited to: electronic equipment, camouflage gear,
surveillance or field cameras, high-tech gadgets, communications equipment, etc.
A copy of your request is enclosed. By letter dated February 2, 2015, you were
notified in accordance with RTKL section 67.902(b) and 1 Pa. Cons. STAT. section 1908
that PSP required an additional thirty days to prepare this final response to your request.
Your request is granted. Below is a list of items purchased by the Pennsylvania
State Police relating to the search for Eric Matthew Frein:

Please be advised that items which a purchase order had previously been
submitted prior to the incident involving Eric Frein have not been included as these items
were not purchased as a means to apprehend Frein. Additionally, although equipment
from other agencies was used during the search, PSP does not have records of purchases
Page 1 of 2made by outside agencies. Therefore, the PSP has determined it does not have any
records such as you described in its possession, custody, or control. A verification to this
effect accompanies this letter. Pursuant to the decision in Jenkins vs. Pennsylvania
Department of State, OOR Dkt N° AP 2009-0065: "It is not a denial of access when an
agency does not possess records and {there is no] legal obligation to obtain them (see,
e.g. section 67.506 (d)(1)).”
To the extent that your request seeks or may be construed to seek records
pertaining to covert law enforcement investigations, including, intelligence gathering and
analysis, the PSP can neither confirm nor deny the existence of such records without risk
of compromising investigations and imperiling individuals. Under No Circumstances,
therefore, should this final response be interpreted as indicating otherwise. In all events,
should such records exist, they are entirely exempt from public disclosure under the RTKL
and Criminal History Record Information Act, 18 Pa. CONS. STAT. §§ 9101-9183,
In closing, you have a right to appeal this response in writing to the Office of Open
Records, Commonwealth Keystone Building, 400 North Street, 4th Floor, Harrisburg,
Pennsylvania 17120. The appropriate OOR appeal form is available for your use at,
https://www.deed.state.pa.us/public/oor/appealformaeneral.pdf. If you choose to appeal,
you must do so within 15 business days of the mailing date of this response, and send to
the OR: 1) this response; 2) your request; 3) the reason or reasons why you think PSP
wrongfully denied your access to the requested records. (a statement identifying any flaws
in the reasons provided above as to why a requester is not subject fo access the
requested records under the RTKL).

Pennsylvania State Police (PSP or Department), am authorized to prepare
this verification on the Department's behalf in response to PSP/RTKL
Request N° 2015-0058. Accordingly, on this 4th day of March, 2015, | verify
the following facts to be true and correct, to the best of my knowledge or
information and belief:
1. | am familiar with PSP/RTKL Request N° 2015-0058, which is
attached to this verification.
2. Utilizing the information provided, | searched all Departmental
databases, to which | have access, for evidence of any PSP records
that may respond.
3. As a result of my searches, | have identified and retrieved a list of
items purchased by the Pennsylvania State Police related to the
search for Eric Matthew Frein:
