Levitt, was defamed by a Morning Sun news report published on Aug. 10, 2014, and demanding an “appropriate retraction.” We have carefully gathered and prepared al relevant documents, transcripts and records related to the story and to the case Levitt v. Felton in order to forward them to our own legal counsel. But in doing so, at least one key question arises that, prior to consulting counsel, we hope you can address in order to assist us with drafting a possible retraction, or at least understanding what you and your client desire from us, It appears that the root of your concern is our reporting that Mr. Levitt created a website called topcollegelawyers.com and then proclaimed himself “College Lawyer of the Year.” Further, it looks like Mr. Levitt disagrees with our reporting that his claim that the honor was bestowed by a “board of directors” reviewing a “list of criteria” that is then spelled out on the website is, in fact, not true. Yet, in reviewing public documents that include evidence, depositions, trial testimony and legal briefs filed with the Isabella County Trial Court, we cannot find anything disproving the reporting made in our story or outlined in the previous paragraph. ‘That said, would you be willing to kindly review those same public records and give us a sample of the retraction you would like us to run, including the specific wording you would like It to say? Upon receipt of your proposed wording, we will be more than happy to further consider your request for a retraction for allegedly defaming Mr. Levitt.
