When I arrived | made contact with Tschosik, who stated that his fiance, Baesler became upset with him after they got home {from the bar and began throwing items at him. Tschosik stated that one of the items that Baesler threw at him was a candle that was in a glass jar. Tschosik stated that the jar struck him on the forehead, ‘causing injury and pain. Tschosik stated that while Baesler was throwing items at him she was ‘screaming “fuck you" repeatedly. Tschosik had died blood on his face from his forehead to his mouth and there was also blood throughout the kitchen of the residence. ‘Tschosik stated that earlier in the night he was at the bar with Baesler. Tschosik stated that Baesler got extremely intoxicated and when they returned to his residence she became upset with him and began {trashing his residence and throwing items at him. Tschosik stated he does not know why Baesler became upset. | observed at least three candles that were similar in shape and size, lying on the floor of the kitchen and Tschokic did not know which candle he was struck with, but he stated she threw all of them at him. Mandan PD Officer informed me that due to probable cause for arrest, an arrest was made on Kirsten Baesler. 1411 hrs., I made contact with Mandan PD Officer and custody of Kirsten Baesler was relinquished to me. A transfer of custody was completed with the Mandan PD Officer. Officers placed our own handcuffs on Baesler and removed the Mandan PD Officers handcuffs. Baesler was searched prior to placing her in the rear of our patrol car. Officers transported Baesler to the PD due to the fact she stated she would talk with officers about the incident. Ladvised Baesler of her Miranda warning which she stated she understood and said she would speak with officers. 1419 brs., upon arrival at the PD, Officers escorted Baesler to the booking room where I was informed Det. Spotts was en route to conduct an interview with Baesler. At this time I again read Baesler her statement of rights and she signed the waiver of rights form stating she would waive her rights at this time and speak with Det. Spotts. While in the booking room Baesler was allowed to make multiple phone calls to her son and a friend by the first name of Candy. It should be noted that throughout the booking process Baesler had to make her way to the restroom due to the fact she was feeling sick. Upon completion of booking, which included mug shots and fingerprints, Baesler was escorted upstairs to the interview where we met with Det. Spotts who was going to conduct the investigation and gather facts of the case from Baesler. While Det. Spotts was speaking with Baesler I waited outside the interview room until Det. Spotts was completed with his interview. Upon Det. Spotts finishing his interview, he advised she could be transported to BCDC to be held on the charge of simple assault domestic violence. Baesler was escorted by officers back out to the sally port and placed in the rear of the patrol car. She was transported to BCDC. Upon arrival at BCDC, she was escorted to the booking room where a search of her person was conducted. Upon completion of the transfer of custody paperwork Baesler was left in the custody of BCDC staff. It should be noted Baesler was interviewed, transported and escorted without incident. When Tarrived I made contact with the victim, Tschosik. Tschosik informed me he had been assaulted by his fiance’ Baesler. Tschosik stated he was drinking with his girlfriend, Baesler, Stark and Bunk at the Pier earlier in the night. Tschosik stated after they had got done drinking at the Pier they went back to his residence which is 1138 Southport Loop. Tschosik stated almost right away after getting to his residence, Baesler became irate. Tschosik stated Baesler began throwing drinks and other items around the residence. Tschosik stated while she was doing this he was standing behind his counter in the kitchen. Tschosik stated Baesler was yelling and screaming, “Fuck You” to him repeatedly. Tschosik stated Baesler then grabbed candles that were sitting on the kitchen table and began throwing them at him. Tschosik stated one of the candles struck him in the face, which caused injury and pain. Tschosik had dried blood on his face. The dried blood appeared to come from his forehead where he had a small laceration and the blood ran all the way down the side of his nose to his mouth. There was also blood throughout the kitchen, on the floor, and blood spatter on the kitchen cabinets. Tschosik also had a tear underneath his right arm pit in his sport coat. Tschosik stated Baesler was drinking Whiskey at the Pier and he stated she becomes confrontational after drinking Whiskey and he does not know why she was upset and why she assaulted him and threw items around his residence. Photos were taken of the residence and placed into evidence. Tschosik stated he wanted to pursue charges against Baesler for assaulting him. Tschosik stated he believes she was throwing the candles at him and she did it intentionally. . I was contacted at my residence by Lt. Trom. He requested assistance with investigating adomestic assault that had occurred earlier in the morning. I was informed that there was probable cause to arrest the suspect in the case, Kirsten Baesler. It was reported that she had thrown a candle and ht the victim in the head causing injury. I was told that Patrol had not located Baesler or witnesses to the incident as they all had left the scene prior to police arrival. 111Shrs. I arrived at the BPD and met with Lt. Trom. I received a copy of the preliminary report. Iwas told that Todd Tschosik had contacted the BPD and was upset that nothing had been done with the report yet. He said that they were at the Pier Bar prior to going over to Todd’s residence. Jason said that Kirsten made a scene at the bar prior to them leaving. He said that she was telling Todd that none of her co-worker’s or her kid’s liked him. Jason said that Todd and Kirsten were verbally fighting in the bar. He said that this was nothing new and they do it all the time. Jason said that he gave the two aride home. He said that Terry Bunk, also went to the residence. Jason said that when they arrived Kirsten fell asleep on the couch for a little bit. He said that ‘when she awoke she was upset and started yelling. I was contacted and informed that Mandan PD had located Kirsten Baesler and was meeting with the BPD to transfer custody, see Officer Berger’s supplement. I did speak with Officer Berger as he brought Kirsten to an interview upstairs at the BPD. He said that she was mirandized and agreed to speak with me. He said that she was stomach sick and may need a garbage can. I then met with Kirsten Baesler. The interview was recorded on DVD. I informed Kirsten that I was told that she was read her rights and asked if she would be willing to speak with and she said yes. A summary of the interview is as follows. Kirsten said that she and Todd went to a benefit dinner located at the Seven Seas. She said that after the dinner they went to the Pier Bar because Todd lives near there. She said that when they left the Pier, Terry Bunk drove them to Todd’s, as she had left her car at the Pier. asked Kirsten if there was an argument at the Pier. She said that Todd gets very jealous and someone had written “shot” on a napkin that she received. She said that Todd thought someone was talking about him or vaiting her notes. She said that his friends even told him to not get so worked up and suspicious of everything. I asked Kirsten what her relationship was with Todd and she said that they were engaged. Kirsten said that she had been concemed for quite some time as she noticed red flags. She indicated that she ‘was referring to drinking, physical and psychological behaviors. He said that he didn’t even know Todd called the police. Terry said that those two fight a lot, which he has seen in person and heard from other people. Terry said that he did find her phone kind of stuffed in the passenger seat. He said that he brought Kirsten’s phone back to Todd at his residence. Terry said that Jason had called him the next morning and filled him in that Todd had called the Police. ‘Terry said that when they left the residence he stopped at his house for a while because he was watching his son’s dog and it needed to be let out. He said that Kirsten had two martinis and Todd had two martinis, 4 Jameson, and a shot. He said that Todd didn’t pay his tab that evening and had one of his neighbors come in and pay it. Russ said that Todd and Kirsten sat at the bar right away when they arrived and eventually moved to a table, He said that Terry and Jason were also sitting at that table. Russ said that there were about 12 people total in the bar. Tasked Russ if he noticed any arguing at the table. When we got to my house Kirsten laid down on the couch. | started to make chicken salad sandwiches for Terry Bunk and Jason Stark. 2. Kirsten Baesler decided to get off the couch because Jason, Terry and | were talking about the reason why she got so upset at the Pier. A question was asked by a guy to Kirsten at the Pier. “When are you going to move in with this guy?” “And, when are you going to marry him” My response was, “Kirsten that is a good question”. She became very upset with me because she felt that | did not back her. | said, what you are talking about? She said, | have been backing you all night to your friends and the first time that you have a chance to back me. What do you do? You throw me under the bus. | said, I did not throw you under the bus. it was a question that was asked to you. After getting off the couch she came over to the counter, picked up the chicken salad sandwich and threw it all over the floor and some ended up on Jason. Jason was upset that she threw the food all over my floor and was upset that some had landed on him. After Jason told her to clean up the food Kirsten was upset at him because he called her a crazy fucking bitch. She was upset and got in his face and said, “Starky, if you ever go into politics 1 will fucken destroy youl!! At that time Jason became very irritated and fired back at her letting her know how he felt about her. They were arguing at each other for about 2-5 minutes. After being extremely upset, Kirsten then decided to take a full drink that had about 12-16oz in it and threw itall over my kitchen hardwood floor. The drink was beside my electric incent candle that was filled with melted wax. Before she grabbed the drink she knocked over the melted wax which landed all over my counter and also on the floor. | could not believe how crazy she was getting. She was totally out of control. Furious at me for supposedly for not backing her and now upset at Jason because he lit her up for the comment of having him destroyed if he ever got into politics. 4. After she threw the drink all over my kitchen floor is when I told her to get the hell out of my house. | told her that she is crazy! At that time she started throwing all of the Yankee candles that were on my kitchen table. | was standing in the kitchen right behind my counter in front of my refrigerator. She intentionally threw about 3 of the candles in my direction and of the three ‘hit my nose. The other candles thrown in my direction bounced off of my kitchen cabinet doors causing scuff marks on the doors. The other ones were thrown towards my dining room area in which she hit the wall with one of the candles causing plaster to fall off the wall in an area of roughly 2"x6". 5. Atthat time | was very upset. | told her that she needs to leave now. | told her that she can take a taxi or start walking. She wouldn't leave. | told Terry that she can leave on her own and that he does not need to give her a ride since he had been drinking at the bar as well. At this time KB WASSI ‘was standing by the door and | was standing between KB and Terry. | tried to hold Terry from ‘walking out the door. After a few seconds I let him go and walked back up to the kitchen and stood on the west side of my table. KB still did not leave my house. She was still furious and filled with anger. Instead of leaving my house at that time she walked up the two steps back into my kitchen. At that time | walked back over behind my counter in front of my refrigerator. At that time she got in my face and said to me, “Fuck You ,Fuck You, Fuck You, Fuck 30 or more times. She wanted me to react. But, I didn’t. She knew that she was wrong by doing and ‘throwing all the things that she did. But, she was not done. She then decided to walk over to my table and stood there for a bit. Still swearing and calling me names with an angry raging craze. ‘At that time | was standing on the west side of my kitchen table. | knew she was going to throw the 6 valentines gift bags that were filled with valentine’s gifts for her. in one of the bags was a glass picture frame of us. At that time Jason decide to hold me. | wanted to grab the bags before she had a chance to throw them. As expected she threw all 6 bags off the table in ragel! She was totally out of control! After she vented in anger, Terry and Kirsten walked out the door and left. At that time Jason let me go. I told him that she was going to throw the bags, why did you hold me back, He said that | would have gone after her. | said, no, | would not havel | said, that! Just wanted to grab the bags so that she could not have had a chance to thrown them. The only thing that she did not throw from the table were the 3 Valentine’s Day cards that | bought for her. This has not been the first time that Kirsten has displayed her anger, rage, crazed and violent outburst behaviors towards me. Years ago she attacked me and bit a piece of my lip off in ‘August, 2012. | had to have reconstructive surgery on my lip that was performed by Dr. Bronson at Sanford Health. Todd Tschosik
