Noel Manley 910 69" Street Darien, IL 60561 March 30, 2015 Complaint Manager clo Hinsdale Township High School District 86 Administration Building 5500 South Grant Hinsdale IL 60521 re: Uniform Grievance complaint versus Superintendent Bruce Law To the Complaint Manager: The evening of March 12, 2015, my wife and I parked in the north lot at Hinsdale South High School and walked toward the north entrance of the building. We ‘were present for the purpose of attending our daughter’s opening night performance of The Crucible in the school auditorium. As we approached the building, we noticed two people (one student we recognized as Marissa duPont, and an adult we did not recognize, but later learned is Mary Sullivan) standing just north of the building entrance. We could see they were approaching people as they walked from the lot to the doors. As we drew nearer, we could see they were, in fact, distributing campaign material for a slate of candidates for election April 7" to the office of Member of the District 86° Board of Education, Specifically, the literature supported candidates Jennifer Planson, Kathleen Hirsman and Bill Carpenter. My wife is currently a sitting Board Member (whose term is not expiring), and chairs the Board Policy Committee. She is, therefore, highly knowledgeable of Board policy and passionate about compliance issues. We agreed the activity we were observing is prohibited by Board Policy(ies), and approached Ms, Sullivan. We questioned her right to distribute political campaign materials on Distriet 86 property, advising that it is prohibited by Board Policy, and that they should re-locate off school property. Ms Sullivan maintained she was lawfully present, and claimed, to the best of my recollection, in these words: “We have permission to be on the grounds.” (Emphasis added.) At a Board of Education meeting on March 23, 2015, Ms. Sullivan * Hinsdale Township High School District 86 (District $6). again maintained she had been given permission to distribute campaign materials by the school administration, Marissa duPont, who also participated in the distribution of literature on District 86 school property, claims to have contacted Superintendent Law on Friday March 13, 2015, and to have an e-mail in response in which Superintendent Law purported to have no knowledge of any Policy prohibiting such activity (and implying that no action would be taken to bar distribution activity in the future). Complaint is, therefore, hereby made against District 86 Superintendent Bruce Law for failure to conduet himself per the strictures of District 86 Policy, including without limitation, Policy 3:40! in that he failed to uphold District Policies 8:30, 4:20, and possibly other policies, by purporting to grant permission to Mary Sullivan, Marissa duPont and others acting in concert with her, to distribute political campaign materials on District 86 property. CONCLUSION. | ask that investigation be made into the circumstances specified herein, that findings be reported to the District 86 Board of Education that Superintendent Bruce Law has violated Board Policy as I have stated herein, and that the Board of Education will thereupon take the action necessary and proper to remedy said violation. " Policy 3:40 provides in part, “The Superintendent is the District’s Chief Executive Officer and is responsible for the administration and leadership of the District schools in accordance with Board of Education policies and directives.” (Emphasis added.)
