This Decree is an amendment to the NRCD 360.

Membership of the SMC was

changed to be the Chairman who was now Lt. Gen. F.W.K. Akuffo as the Chairman
and other people to hold offices which are the same as those present in the NRCD
360.
Section 8(10) of the NRCD 360 was substituted : whenever the Chairman is unable
to perform his functions as Chairman until the time when he will be able to perform
those functions, his functions will be performed by the remainder of the members of
the SMC together provided that there are not less than four of the members
present.
Sections 9 to 13 were substituted as follows:
Section 9: The executive power of the state shall vest in the SMC and shall be
exercised in accordance with this decree and any other law for the time being in
force. A commissioner shall hold office at the pleasure of the council subject to the
terms and conditions as the council may direct and the SMC was to assign
responsibility for any subject or department of State to any member of the NRC (the
executive council as seen in NRCD 360) and who shall discharge the duties subject
to any general policy laid down in relation thereto by the SMC.---just the same thing
as seen before.no exercise of such responsibility shall be questioned in

and those same things as seen before.
In the case of an emergency, the Chairman of the SMC shall have power to appoint
another person to exercise the functions of another commissioner. The exercise of
any of the executive powers of the state or of any functions of the SMC may be
signified under the hand of a commissioner if not signified by the Chairman. The
SMC could delegate any of the executive powers to another member of the SMC or
to any commissioner or to another person.
Any enactment in existence before the commencement of this decree shall have
effect subject to such modifications as may be necessary to give effect to the
provisions of this decree.
