Responsible LEO: Approved by: Date canis Officer Report for Incident 13LE01597 Page 4 of 17 Supplement on February 12, 2013 I was dispatched to 1175 East 3200 North(Alpine clinic) on a forgery detair. Upon my arrival I met with Dr. Steven Jones with Alpine clinic. He stated Last night he received a call from the pharmacist at Macey stating he had Judson Bagley their with a prescription for adderall. The pharmacist stated the scrip did not look right and wanted to make sure Dr. Jones had written it on December 31, 2013. Dr. dones advised the pharmacist he had not seen this patient since December 15, 2010. The pharmacist told Mr. Bagley he could not £111 it and he left. A copy of the prescription is attached to this report, Dr. Jones stated the signature is his, but the date has been changed. Dr. Jones ran a DOPL report on Judson Bagley and found he had gotten 5 different prescriptions at a pharmacy in Salt Lake located at 2036 Bast 6200 South on the Following date: 07/06/2012 08/02/2012 10/03/2012 11/13/2012 12/03/2012 A copy of the DOPL report is attached to thie report ast known address and telephone 4 Judson Bagley 4698 North shady View Lane Lehi, utah 84043 Patrol Officer Southwick LpD nanos Officer Report for Incident 13LE01597 Page Sof 17 ‘Supplement Detective B. Kirkham Investigations Lehi Police case # 131801597 SOURCE: I received this case for follow up investigation. I learned that on February 12, 2013 Officer Southwick took a forgery detail regarding a forged prescription being passed at the Nacey's Pharmacy in Lehi, Utah on the night prior (02/11/13). The suspect left the pharmacy and took the fraudulent prescription with him. The pharmacist was able to make a photo copy of the prescription document and contacted the prescribing Doctor before the euspect left. ‘The prescribing Doctor advised that ha hasn't seen the patient in question since December 2010. The Doctor advised that the signature on the prescription document appeared to be his, but the date had been changed. The doctor printed out a DOPL report and gave it to Officer Southwick for the patient. The DOPL was attached to this report. I checked the DOPL report and found that Judeon Bagley has filled multiple prescriptions at several different pharmacies with prescriptions allegedly written by, Steven L. Jones, APRN. ‘The prescriptions were for Amphetamine and Hydrocodone. The DOPL showed four prescriptions at Macey's (Lehi) filled and four prescriptions at Walwart (American Fork) filled in Judson Bagley's name allegedly written and prescribed by Steven L. Jones, APRN. There were also prescriptions filled at pharmacies located in Brighton, Holladay and Draper, Utah under the name Judson Bagley and the prescriber being Steven L. Jones, AORN. CONTACT WITH STEVEN L. JONES, APRN: on 02/14/13 I made contact with Steven L. Jones, APRN at his office located at 1175 Bast 3200 North Lehi, Utah. Steven Jones io the complainant in this case. Steven Jones advised that he received a call from the Macey's Pharmacy on 2/12/13 advising that a male just attempted to pass a prescription that appeared to be fraudulent bearing his name and clinic information as the prescriber. The pharmacy faxed Steven Jones a copy of the prescription that the suspect tried to submit. Steven Jones advised that the patient on the prescription is, Judson axns Officer Report for Incident 19LE01597 Page 6 of 17 Bagley. Jones said that Judson Bagley is a patient he has seen in the past, however, he hasn't seen Judson Bagley since December 2010, Jones said that he has prescribed Bagley medications in the past to include, Anphetamine and Hydrocodone but nothing since at least December 2010. Jones said that any Preseription since December of 2010 would be fraudulent if issued with his information. Steven Jones said that he does issue printed prescriptions for these types of medications, however, they require an original signature from the prescribing Person. Jones advised that the copy of the prescription he received from Nacey's did appear to be his signature, and did have his DEA, NPT and LEC numbers on it well as his name and clinic information, Jones said that by law these types of medications are not allowed refills and are for a one t:ime prescription. Steven Jones gave a written statement that will be attached to thie report. Also Steven Jones provided a prescription printout to show what a prescription from him would look like, Jones wrote "Void" across the signature area on the "test prescription" in blue ink. ‘The test printout prescription and the copy of the prescription provided by Macey's do appear similar with the same prescribing person's information. I also learned that Judson Bagley called Alpine Clinic and made an appointment to visit Steven Jones for 02/22/2013. This call was made by Bagley after he attempted to pass the prescription at Macey's pharmacy in Lehi, The Alpine Clinic originally scheduled an appointment for Bagley, however, they later cancelled the appointment with him due to the circumstances. MACEYS PHARMACY: T made contact with Macey's Pharmacy manager. I was able to obtain information from them for any prescriptions filled by Judson Bagley, written by Steven L, Jones, APRN. I was able to obtain original prescription documents for four separate prescriptions filled by Bagley. These prescription documents were written using Steven l. Jones, APRN from Alpine Clinics information. I examined the prescription documents and could sce that the documents appeared to be copies from an original prescription document. The signatures on the prescriptions were in blue ink and they vere clearly not original. signatures. ‘The dates on all four prescriptions were different. The pharmacist advised that when a customer picks up a prescription for these types of drugs, some type of customer TD is required by the pharmacy employee at time of pick up. In all four of these transactions the customer (Judson Bagley) used a driver license as the ID type showing "ID Value" 014930065001. I checked Judson Bagley's Utah Driver License number and it is, The following list is the four forged prescription documents provided by Macey's xpos Officer Report for Incident 13LE01597 Page 7 of 17 Pharmacy written with Alpine Clinic/Steven L. Jones, APRN information to Judd Bagley; 1, Dated 05/04/2012 for Lortab 7.5mg, Disp: #30. This prescription was filled on 05/10/2012 and picked up on 05/10/2012 8:47:04 by customer Judson Bagley using Driver License as ID type. 2. Dated 10/29/2012 for Adderall IR 30mg, DIsp: #30. This prescription was filled on 11/03/12 and picked up on 11/03/2012 1:15:27 PN by customer Judson Bagley using a driver license as ID type. 3. Dated 08/30/2012 for Adderall IR 30mg, Disp: #30. This prescription was Eilled on 09/15/12 and picked up on 09/15/2012 9:42:23 AN by customer Judson Bagley using a driver license as ID type 4, Dated 12/11/2012 for Adderall IR 30mg, Disi filled on 12/15/12 and picked up on 12/15/2012 6: Bagley using a driver license as ID type. #30. This prescription was 2:15 PM by customer Judson 5. This prescription was attempted to be filled on 02/11/13, however, the pharmacist thought it looked strange so he took a photo copy of the prescription document and called the doctor. The customer took the original prescription document and left the store when the pharmacist said he was calling the doctor to confirm the prescription. The prescription document is dated 01/13/2013 for Adderall IR 30mg, Disp: #30. This prescription did not get filled. EVIDENCE FROM MACEY'S / SURVEILLANCE: I gathered the original prescription documents and the photo copied prescription document as well as the drug reports that correspond to each prescription fron Macey's Pharmacy as outlined above. Those documents were booked as evidence at the Lehi Police Department. I made photo copies of the documents to be included in this report. T made contact with Macey's Loss Prevention officer regarding any surveillance available for the transactions at the pharmacy on the dates in question. The surveillance system was not working on 02/11/13, He was able to show me surveillance video for the 12/15/12 transaction, however, the system had purged all other previous recordings. I was unable to obtain a copy of the surveillance fron Macey's due to technical problems with the surveillance system. I did view the surveillance video on Macey's surveillance monitor. The surveillance showed on 12/25/12 at approximately 18:03:51 a male with dark hair wearing a red and white coat approach the pharmacy window. The male waited in the pharmacy area until the prescription was filled. The male obtained the prescription from the pharmacy and left the store. 1 took photographs of the surveillance monitor exon Officer Report for Incident 13LE01597 Page 8 of 17 with a digital camera to capture images of the suspect WALMART PHARMACY: I noticed that the poPL report for Judson Bagley shoved four prescriptions filled on separate occasions at the American Fork Walmart Pharmacy. All four of these prescriptions were issued by Steven L. Jones, APRN. I responded to the Walmart Pharmacy and made contact with pharmacist, Claudia Mielsen. I explained the situation to Claudia and I obtained all four original prescription documents from the Walmart Pharmacy under the name Judson Bagley issued by Steven L. Jones, APRN. After examining the original prescription documents from Walmart Pharmacy I found them to be very similar to the forged prescription documents passed to the Macey's Pharmacy. The prescriptions were written to dudd Bagley and issued with Alpine Clinic, Steven 1,. Jones APRN information. The signatures on the documents were in blue ink and were clearly not original signatures. It appears that the signatures have been photo copied from an original signature. ‘The following list is the four forged prescription documents provided by Macey's Pharmacy written with Alpine Clinic/Steven L. Jones, APRN information to Judd Bagley; 1A. Dated 06/04/2012 for Lortab 7.5mg Disp:#15. This prescription was filled on 06/14/2012. 2A. Dated 08/30/2012 for Adderall IR 30mg, Disp: #30. This prescription was filled on 09/03/2012. 3A, Dated 01/02/2013 for Adderall IR 30mg, Disp: #30. This prescription was filled on 01/06/2013. 4X, Dated 01/31/2013 for Adderall IR 30mg, Disp: #30. This prescription was filled on 02/02/2013. EVIDENCE FROM WALMARY / SURVEILLANCE: I contacted walmart Loss Prevention Department regarding surveillance video of oxnea Officer Report for Incident 13LE01597 Page 9 of 17 the prescription transactions at their pharmacy. I spoke to Loss Prevention Associate, Nick Jackson. Nick advised that he would have surveillance for 02/02/13, however, the surveillance system has purged the other recordings due to time frame. The pharmacist gave me information that on 02/02/13 the suspect passed the prescription at the drop-off window at approximately 14:33 hours. I viewed the surveillance video for that date and approximate time with Nick. The surveillance showed a male at the pharmacy drop-off counter at approximately 14:30 hours. The male had dark hair, eye glasses and wae wearing a red jacket. ‘The suspect also had a young female (6-8 years old) with dark or dirty blonde hair wearing a white and dark stripped shirt with him. T recognized the suspect male as being Judson Bagley from a Utah Driver License photo. The surveillance also captured the male suspect and young female leaving the store together. I gathered a CD-R disc containing the surveillance footage from Walmart. I took photo copies of the original prescription documents and they will be attached to this report. ‘the original prescription documents and the CD-R containing surveillance footage were booked as evidence at the Lehi Police Department. SUSPECT: I will attempt to locate suspect, Judson Bagley regarding these crimes. Nothing further at this time. oxaans Officer Report for Incident 13601597 Page 10 of 17 ‘Supplement Detective B, Kirkham Investigations Lehi Police case # 131801597 FOLLOW UP / ARREST: on the morning of 03/19/13 I responded to Judson Bagley's home address in attempts to locate him. Sergeant Ferrell was with me as a back-up officer. T rang the doorbell on Judson's home located at 4698 North Shady View Lane Lehi, Utah. T was greeted at the door by a male. I recognized the male as Judson Bagley from a driver license photo and surveillance images. I addressed the male by saying "Sudson" and he acknowledged my greeting. I introduced myself and sgt Ferrell and asked if he would speak with me at the Lehi Police Department. Judson agreed and asked if he could get dressed. 1 advised Judson that he was under arrest and that he could get dressed so long as I followed him into his home. Judson grabbed his wallet and other personal items. Judson also indicated that he knew what this was regarding and said that he had an appointment with his doctor today to discuss the issue. I walked Judson outside hie home and down the street to where my police vehicle was parked. T placed handcuffs on Judson with his hands behind his back and checked the cuffs for proper fit and double lock. Judson was transported from there to the Lehi Police Department. for an interview. INTERVIEW WITH JUDSON BAGLEY: ‘The interview was conducted by me in the Lehi Police Department interview zoom. I started by confirming his name as Judson Bagley. Judson advised his DOB of + si and gave his current address of 4698 North Shady View ane Lehi, Utah. I told gudson that he was in police custody and I advised him of his rights. Judson advised that he undarstocd his rights. I asked Judson why he thinks he is here today? Judson stated that he takes medication to deal with "focus issues". He said that for a long time he took it (medication) at a certain level and then decided he was going to try and live life without it. He said that he did this for a while and then decided that he was doing his family a disservice and his profession and coworkers. He said that he decided to start taking it again so he visited a nurse practitioner to prescribe the medication to him. Judson said that the nurse practitioner he started seeing was not oxnana Officer Report for Incident 13LE01597 Page 11 of 17 willing to prescribe him the dose of medication that has historically worked for him. He said that "she (nurse practitioner) just kinda didn't want to budge and I got kinda frustrated". He said that he took it into his own hande to make up the deficit. Judson said that he didn't want to continue doing this and said that at the beginning of the year he made a plan to stop doing it. He said that this type of thing is not something you can just stop, and referred to it as being like "falling off a cliff". He said his plan was to stop doing it in February. He said that he printed off the wrong prescription and it was one that he had used the month before and the pharmacy noticed it. He said that after the pharmacy noticed the prescription wasn't right, he figured the police would be in contact with him. He said that he figured he would make it as easy for “you guys" as possible. We said that the next day he called the doctor who's nane/prescription he was using and made an appointment to see him. Judson said that this was Doctor Jones. We said that he was going to go tell him (Dr Jones) what was happening. He said that he wasn't able to get an appointment for two weeks with the doctor. He said then the day before the appointment with the doctor he received a phone call from the receptionist who cancelled the appointment and told him it was due to a pending investigation Dr Jones won't see you. He said the receptionist told him it was Detective Kirkham investigating. He said that he tried to contact me and said he wanted to make the investigation easy so the police didn't have to do a bunch of searching and was going to tell me everything and get it over with. Judson went on to explain that what he is doing was not for Fuphoria or anything of the sort, he said that sometimes at work it is tuff to stay focused on his job and tasks at hand. He said that he also sees Dr Annette Ephroni and is scheduled to see her in May. He explained that Dr Bphroni is his legitimate prescriber of Adderall. Judson said that he actually has an appointment scheduled today with Dr Ephroni and he said he was going to discuss this issue with her. Further talking with Judson he again explained that he had a hard time focusing on is job and tasks required at his job. Judson said that one of his tasks at work is reviewing contracts. He said that he would begin reading the contracts and would find himself not being able to concentrate on what he was reading or doing. Ke said that is when he started obtaining more medication by forging prescription documents so he could medicate himself to the level he felt was needed. Judson said that he didn't like having to do this because of side effects the extra medication was causing with him as well as he knew it vas illegal. He said that when he first started doing thie it was only meant to be for a month or so to get by, then it became the normal. Judson said that he knew he didn't want to continue doing this so he made a new year resolution to stop and he also went to his boss and told him that he is not suited for the position he was doing at work. He said that his boss has given him a new assignment at work that he will be much more suited for. J asked Judson when the last time he saw Dr Jones. Judson stated that the last time was in 2010. I asked Judson if Dr Jones was prescribing these medications at the time. He said yes. Judson explained that the only reason for seeing Dr Jones was due to a special occasion where he could not get into his other doctor. gudson said that Dr Jones wrote him a prescription and he took it to get anos Officer Report for incident 13L.E01597 Page 12 0f 17 filled. gudson said that something wasn't right with the way Dr Jones filled out the prescription document so the pharmacy wouldn't fill it. He said that he took a photo of the prescription document with his phone to email to Dr Jones to show him the problem with the prescription. Judson said that sometime later he realized that he had a photo of the prescription on his phone. He said that thie was about the same time as he was trying to figure out what to do. Judson said that he got thinking "you know I probably could just take this thing and change it in such a way that I could...so anyway, I just happened to have an image of that prescription in my phone". T asked Judson if this was the only tine that Dr Jones had prescribed him Adderall? Judson said that he could not for sure say that was the only time. I asked Judson about the Hydrocodone? Judson responded by explaining that he Like to do Radnar relay races. He said that while participating in one of those races in 2011 he broke a bone in his foot. He said that he continued the race even with a broken foot. Judson said that it was horrible. Judson said that last year he ran three of these types of races. He said that he decided he needed something for pain especially if he ended up breaking any bones again. He said that he delayed going to a physician. Judson said that he just altered the prescription document again for the Lortab. He said that Dr Jones did not ever prescribe any Lortab to him. He indicated that he altered the prescription document he had to say Lortab. He said that all of the Lortab prescriptions would correspond within a few days of one of the races he participated in. He said that he didn't abuse the Lortab and only used then for pain. Ke pointed out that he originally was getting 30 Lortab pills per race then decided he didn't need that many and altered the last prescription for Lortab to only be 15 quantity. (I was able to confirm this by looking at the prescription documents 1 seized from the pharmacies) . Z asked Judson about how he would change the prescription document each time? Judson said that he would change the date and another field called the transaction ID to coincide with the proper date and also changed the type of Aderrall from xR to IR. I showed Judson the photo copy that T had of the prescription was passed at Macey's Pharmacy on 02/11/2013. This is the prescription that the pharmacy realized something wasn't quite right with and took a photo copy and contacted Dr Jones. Judson admitted that he was the person who passed that prescription and he took the original document that he passed out of the store with him that day. Judson said that he didn't keep that prescription document and he thinks he threw it away. I asked Judson how many times he filled at Macey‘s? He replied he didn't know. I went over all of the places Judson had filled prescriptions at with Dr Jones' information. Judson acknowledged using them at Macey's (Lehi), Walmart (American Fork), The Medicine Center in Holladay, Dan's Brighton. Judeon stated that the Medicine Center Pharmacy in Holladay and Dan's Brighton are pharmacies in clos proximity to his place of employment. Judson admitted that any prescriptions on the record with Dr Jones’ information are prescriptions he printed. T asked Judson if he had any other prescription images from other doctors? Judson said oxas (Officer Report for Incident 13LE01597 Page 13 0f 17 that he only has and has only been using Dr Jones’ information. I showed Judson the surveillance images that I obtained from Macey's and Walmart. Judson acknowledged that the suspect in the photo was him and said that the young female with him in the photo from Walmart is hie daughter. I showed him the photo from Macey's surveillance, he also acknowledged that the suspect in the photo was him. I asked Judson about the image of the fraudulent prescription he has. Judson said that he has images of all or most all the prescriptions saved on a thumb drive. Judson had the flash drive with him and consented to allow me to take the images from his thumb drive. T was able to obtain the documents from his thumb drive and save them to a police computer. The file was then erased from his thumb drive prior to giving it back to him. gudeon was present when this took place and watched the computer screen as we obtained the file from his thumb drive. 3 asked gudson how he was paying for the prescriptions and if his insurance company was paying for then? Judson said that he used cash to pay for all of the prescriptions. He said that his insurance company did not pay for any of the prescriptions. Ne said that he was trying to keep the paper trail to a minimum. He said that he was paying about $45 to $60 for the Adderall and $4 to $15 for the Lortab. During the course of this investigation and interview, Judson expressed his desire to change and not do thie type of thing anymore. He explained that he has a steady job with a reputable company and works to support his wife and children, Judson was very respectful with police and was very cooperative with this investigation. ‘The interview was both audio and video recorded. Please refer to the interview Dvp and watch it in ire entirety to have a complete understanding of the interview. EVIDENCE: ‘The original copy of the interview DvD was booked as evidence at the Lehi Police Department. Copies of the original interview DvD will be sent to the Prosecutor's Office. oxnona Officer Report for Incident 13LE01597 Page 14 of 17 The file taken from Judson Bagley's thumb drive of the images of the forged Prescriptions was burnt to a DVD and booked as evidence at the Lehi Police Department. Copies of this DvD with be sent to the Prosecutor's Office. ‘concLustoN: I did not locate a criminal history for Judson Bagley and he stated that he has never been arrested in the past. Judson has only one local police involvement where he was a complainant in a detail reported to Lehi Police. Due to these circumstances and Judson's cooperation I decided to refer him to the Utah County Attorney's Office for charges, Judson was transported back to his home and was released. CHARGES: I will be referring this report to the Utah County Attorney's Office. I will be requesting that Judson Bagley be summoned for the following charges; -9 Counts of Prescription Forgery, $8-37-8 Third Degree Felonies. These charges are based on the four prescriptions passed to the Anerican Fork Walmart pharmacy and the five prescriptions passed to the Lehi Macey's pharmacy.
