PRELIMINARY INVESTIGATION AND CONSTITUTION


(SUMMARY)
The personal freedom and safety is one of the most important constitutionally secured
personal rights. To those rights and especially with the preliminary investigation and its
limitation from those, is referring the concrete investigation.
At first, we have to say that the preliminary investigation is the beginning
of the prosecution. This investigation is operated on purpose to find out if, and
how the crime was committed.
There are two kinds of preliminary investigation: the ordinary and the
official. They are operated of general or special inquisitorial assistants. The
ordinary preliminary investigation is the beginning of the prosecution after the
demand of the Prosecuting Attorney. The content of it, it doesnt foresee by low
but it should define the punishable act and also the penalty provision which fix
the punishable act.
The official inquiry is excluded from rules. It is operated in cases witch the
law demands, when is for manifest crime or if its in danger of being very late.
The inquisitorial assistances have to inform the soonest the possible the proper
Prosecuting Attorney for the preliminary investigation. If it wasnt necessary to
operate the preliminary investigation but they operated it, comes upon
procedures nullity.
Usually, the policys deduction after the preliminary investigation is
negative for the accused. Also, later they use that negative deduction for him but
this is well known that its abuse for personal rights.
If there are many evidences for obligation quilt for the accused, the preliminary
investigation is not necessary to be done. The Prosecuting Attorney sends him
for hearing.
Finally, the preliminary investigation is an important procedure for
the investigation of crimes evidence. Also, there are Constitutional Rights that
protect everybodys personal freedom and safety until the investigation shows
the obligation quilt of somebody.
