The Senate Administrative Rules govern


Senate administrative practice.
They
complement and are of equal authority to the
Rules of the Senate, which govern Senate
procedure. In the interests of good governance,
the administrative rules codify comprehensively
the fundamental principles and rules governing
the internal administration of the Senate and its
allocation and use of resources.

The Senate Administrative Rules are subject


to statute law that applies to the Senate. Of
particular note are the Constitution Acts, 1867
and 1982, the Parliament of Canada Act, the
Members of Parliament Retiring Allowances Act
and the Parliamentary Employment and Staff
Relations Act.

The Senate Administrative Rules are


supplemented by policies, guidelines, opinions,
directives, forms and practices adopted or
implemented by the Senate, the Standing
Committee on Internal Economy, Budgets and
Administration and the Clerk of the Senate.

The Internal Economy Committee is


responsible for the administration of the Senate
Administrative Rules and for giving guidance on
their interpretation to Senators and the Senate
Administration.

The Senate adopted the Senate Administrative Rules on
May 6, 2004. Each section and definition of the Senate
Administrative Rules is therefore followed by the
annotation [2004-05-06], indicating the date of its
original adoption and coming into force. If a section or
definition has been amended, the date of amendment has
been added to the annotation. If the coming into force
date of an amendment differs from its adoption date,
both the adoption and coming into force dates are given
after the relevant section and the coming into force date
is qualified with the abbreviation (cif).
The chart that follows compiles all of the dates on which
the Senate Administrative Rules have been amended.

1. (1) The Senate Administrative Rules are


based upon the principles set out in this chapter,
which are recognized as fundamental to proper
public administration and essential to the good

3. The following principles of parliamentary


life apply in the administration of the Senate:
(a) a Senator has the constitutional rights,
immunities and independence applicable to
that office and the carrying out of the
Senators parliamentary functions, free from
interference or intimidation;
(b) partisan activities are an inherent and
essential part of the parliamentary functions
of a Senator;
(c) a Senator is entitled to receive financial
resources and administrative services to
carry out the Senators parliamentary
functions, at a level and subject to such
terms and conditions as are determined by
law, the Senate and the Internal Economy
Committee;

6. The Senate Administrative Rules apply to

4. Senators act on their personal honour and

in carrying out their administrative functions
unless and until the Senate or the Internal
Economy Committee determines otherwise.

regulation, rule, policy, guideline, practice or
activity that has as its object the amelioration of
conditions of under-represented or otherwise

contract of employment with the Senate,
whether the person is an indeterminate
employee or is a person hired for a specified
period, or is on probation or confirmed in their
position, and includes a person who is deemed
to be an employee for the purposes of an Act of
Parliament or other purpose of law, but only for

person, other than someone excluded by the
Committee upon request, who is
(a) a spouse or a common-law partner;
