An analysis of Thailands Draft Bill on Personal Data Protection pending
before The National Legislative Assembly in January 2015

Abstract
Recently, the personal data of individual have been collected and processed by both
governmental agency and private sector. Such collection and processing affected the right to privacy of
individual because data subject may not be aware or give consent to the collection and processing. Even
if the consent is given, the data have been used in contrary to the purpose notified to the data subject.
The results of literature review indicate that there is no specific law in Thai legal system which can be
directly applied to protect the personal data. However, the National Legislative Assembly which was

established by the interim constitution since 2014 has considered several draft bills to be enacted.
Among those draft bills, the personal data protection draft bill which was approved and proposed by the
cabinet in January 2015 is currently being considered. This research aims at analyzing the draft bill in
order to indicate the problems in its content, scope and element. The results would lead to the
recommendation to amend the draft bill for protecting the right of data subject.
