STUDENT INSTRUCTIONS
PREPARATION
A. Memo
Based on your Tutorial 1 discussions and in preparation for Tutorial 2, you need to draft a
short memorandum on the following question:
Please advise Agnes Kwang as to her prospects of success in a suit against UltraVita
based on Carlill v Carbolic Smokes Ball Company. Please provide reasons for your
advice.
The memorandum should be less than 400 words.
Please bring a hard copy of your memo to Tutorial 2. Your memo should be double spaced
and typed. Please do NOT put your names on the memo.
B. Reading
Before Tutorial 2, you should read the following:
1. Interpretation and General Clauses Ordinance (Cap 1)
Please familiarise yourself with this Ordinance. You do not have to memorise it but should
have a general sense of what is included in the Ordinance.
2. Weapons Ordinance (Cap 217)
Please be ready to answer the following questions about the Weapons Ordinance:

Ordinance.
h. What is the purpose of this Ordinance? How do you know this?
i. Why is the list of prohibited weapons put in a Schedule rather than in an ordinary
section? Is putting the list of prohibited weapons in a Schedule the same as putting it
in an ordinary section? If yes, why?
