This proposal is submitted after preliminary discussion with opposing counsel, anticipating that every material witness will be scheduled for deposition. PROPOSED ORDER SETTING DISCOVERY, MOTION and HEARING DEADLINES and TRIAL DATE THIS CAUSE having come on to be heard on the Motion of the State of Florida to set a discovery schedule, and this Court having solicited proposed timelines for same from both parties, and otherwise being duly advised in the premises, HEREBY ORDERS as follows’ 1. DISCOVERY ORDER AS TO EXPERT WITNESSES a) b) ° ) O) Depositions of expert witnesses listed by the State of Florida shall be completed no later than August 31, 2010 Evidence review by any defense expert witnesses shall be completed no later than September 30, 2010. ‘The Defendant shall list all expert witnesses she intends to call at hearing or trial, provide any reports prepared by those expert witnesses and file any motions related to the forensic/scientific evidence no later than October 31, 2010. Depositions of expert witnesses listed by the Defendant shall be completed no later than January 31, 2011 Motions related to the forensic/scientific evidence shall be heard no later than January 31, 2011 2. DISCOVERY ORDER AS TO LAW ENFORCEMENT WITNESSES » » Depositions of law enforcement officers or employees shall be completed by September 30, 2010. All non-forensic/scientific evidentiary motions shall be filed no later than October 31, 2010 and heard no later than January 31, 2011. 3, DISCOVERY ORDER AS TO ALL OTHER WITNESSES a ») All other witnesses shall be listed no later than August 31, 2010. Depositions of all other witnesses shall be completed by October 31, 2010. 4, GENERAL DISCOVERY ORDER Once a witness becomes known to the Defendant, she shall decide within 30 days whether the witness will be listed pursuant to FRCP, 3.220 (d)(1)(A). In no event shall any witness be listed, by either party, outside the time limits provided in this order. Ttwill be the burden of the listing party to show good cause for any delay to this Court 5. ORDER AS TO ALL OTHER MOTIONS Non-forensic/scientific legal motions requiring no testimony before the court shall be filed and heard no later than January 31, 2011 6. ORDER AS TO PENALTY PHASE WITNESSES a) _ All Non-expert witnesses to be called for penalty phase only shall be listed by August 31, 2010 and depositions completed by October 31, 2010. b) All Defense expert witnesses for penalty phase shall be listed and reports provided by December 31, 2010 and depositions completed by February 28, 2011. ©) Any State rebuttal expert witnesses shall be listed by March 31, 2011 and depositions completed by April 30, 2011 7. THIS CAUSE IS HEREBY SET FOR TRIAL BEGINNING MAY 2, 2011. Time and location to be determined by further order of this Court. THIS ORDER DOES NOT SUPERCEDE OR NEGATE ANY PREVIOUSLY ORDERED DISCOVERY DEADLINES.
