tenantsandownedbypetitionerNicolasManaayandhiswifeanda5hectare
ricelandworkedbyfourtenantsandownedbypetitionerAugustinHermano,
Jr.ThetenantsweredeclaredfullownersoftheselandsbyE.O.No.228as
qualifiedfarmersunderP.D.No.27.
ThepetitionersarequestioningP.D.No.27andE.O.Nos.228and229
ongroundsinteraliaofseparationofpowers,dueprocess,equalprotectionand
theconstitutionallimitationthatnoprivatepropertyshallbetakenforpublic
usewithoutjustcompensation.
TheycontendthatPresidentAquinousurpedlegislativepowerwhenshe
promulgatedE.O.No.228.Thesaidmeasureisinvalidalsoforviolationof
ArticleXIII,Section4,oftheConstitution,forfailuretoprovideforretention
limits for small landowners. Moreover, it does not conform to Article VI,
Section25(4)andtheotherrequisitesofavalidappropriation.
EminentdomainisaninherentpoweroftheStatethatenablesittoforcibly
acquireprivatelandsintendedforpublicuseuponpaymentofjust
compensationtotheowner.Obviously,thereisnoneedtoexpropriatewhere
theowneriswillingtosellundertermsalsoacceptabletothepurchaser,in
whichcaseanordinarydeedofsalemaybeagreeduponbytheparties.Itis
onlywheretheownerisunwillingtosell,orcannotacceptthepriceorother
conditionsofferedbythevendee,thatthepowerofeminentdomainwillcome
intoplaytoasserttheparamountauthorityoftheStateovertheinterestsofthe
propertyowner.Privaterightsmustthenyieldtotheirresistibledemandsofthe
publicinterestonthetimehonoredjustification,asinthecaseofthepolice
power,thatthewelfareofthepeopleisthesupremelaw.
