Memorial Day throughout the Nation By Jack Mc Cabe

ts the summer of 1865 in

Waterloo, New York, and
druggist Henry C. Welles

had an idea. The Civil War

had just ended, and Welles
idea was to place patriotic

flowers on the graves of soldiers who had died for the

cause. Nothing happened
about this thought until the
spring of 1866, when Welles
brought his plan to Civil War
hero General John B. Murray,
who completely supported the
idea. In a committee run by
Welles and General Murray,
on May 5, 1866, the village of
Waterloo was decorated with
evergreens and mourning
black, along with flags at halfmast. Ceremonies and the decorating of graves took place at

three cemeteries, as residents,

civic society members, and
veterans marched to and from
the grave sites led by General
Murray and martial music.
Waterloo celebrated the
following year on May 5, then
joined with other communities
in holding the observance on
May 30, 1868, in accordance
with General Order Number
11
by
General
John A. Logan, National
Commander of the Grand
Army of the Republic. This
first observance saw flowers

placed on the graves for

Decoration Day of both Union
and Confederate soldiers in
Arlington National Cemetery.
This is one of many stories as to how Memorial Day
began with several cities and
towns claiming to have started
the holiday. Womens groups
say that they were decorating
graves in the South before the
Civil War ended, especially in
a hymn not published until
1867 by Nella L. Sweet called

Married couple gets divorced yet stays together so what changed?

By Mark Charnet

great
deal
has
changed, in fact, a
lot more than you
might think, at first glance.
Firstly, the couples friends,
family and acquaintances are
confused as to why they got
divorced in the first place,
given that nothing has really
changed in their eyes.
However, there is a major
change in the eyes of the state
and federal governments,
employer retirement plans
and the tax treatment of any
former spouse beneficiaries of
any life insurance policies and
annuities. This change is a
really big deal, indeed!
Whether or not this couple resides under the same
roof, they are legally no longer
married in the eyes of the law
and no longer entitled to the
tremendous spousal benefits
at the death of the first spouse.
IRAs allow for a non-taxable
spousal rollover that disappeared with the divorce
decree. A non-spouse, named
as the employers 401k or pension plan beneficiary, will no
longer enjoy the right to rollover the proceeds of the
account into their name taxfree. Ex-spouses can no longer
roll-over the proceeds of a
non-qualified tax-deferred
annuity without paying tax on
the deferred gains in the
account.
Ex-spouses can no longer
take advantage of spousal discounts in the purchase of a
long-term care policy. Ex-

spouses may lose the pension

benefits of their former
spouses pension plan due to
their divorce as well, whether
receiving benefits currently or
at their ex-spouses death.
And if married less than a cer-

tain period of time and

divorced, they might lose
spousal Social Security benefits as well!
State and Federal Estate
Tax rules allow for the tax-free
passing of assets between
spouses; this too would be lost
upon divorce. This one item
may trigger the largest loss to
the survivor of the former

married couple.
These are but a few of
the items that change when a
couple gets divorced and for
all intents and purposes,
remain married as was
before. There may be a lot at

stake that perhaps the attorney forgets to mention when

first approached by a married
individual looking to discuss
divorce.
Upon a divorce, employer retirement plans usually
result in a negotiated settlement to the non-employee
spouse called a Quadro, the
acronym for a Qualified

Domestic Relations Order.

For couples that remain
together yet get divorced, this
could very well be a bitter pill
as the benefits offered by the
current plan may not be surpassed or duplicated in an

IRA or the recipient spouses

employer 401k plan. This is
one serious area that might be
considered when contemplating divorce, if the future is to
be that the couple remain
together.
Then there are the legal
expenses incurred by both
parties to consider. If there is
no big, glaring, overwhelming

reason or many reasons to get

divorced and after considering
the points brought to light in
this column, maybe planning
a divorce should be postponed, if the couple desires to
remain together as a couple
anyway.
Divorce rate statistics are
very high in our society. Just
ask any school age child how
many of his or her peers parents are divorced and the
numbers may frighten you.
Lets also not forget the cost of
duplication, the purchase of
another home and everything
that goes into it from pots and
pans, sheets and towels, furniture, utility bills and property
taxes too. After contemplating everything involved, you
might even find your spouse a
little more agreeable to live
and work with. If not, you
may always remain friends or
friendly as the case may be.
Divorce is much more
that a legal battle; it has consequences of taxation, income
today and tomorrow as well as
quality of life. In my career,
Ive counted more than a few
couples who were former married couples now living
together, with caring feelings
for each other that would be
better served in the future
when one passes if they
remained married. The good
news is for a few dollars and
an appointment at the courthouse, they can marry again.
Let me know your
thoughts by writing or email-

ing me at the contact info

below. For those that do
divorce where the thought of
remaining a couple would be
out of the question, a meeting
with a financial advisor may
be just as important as the
meeting with the divorce
attorney. To that end, I make
myself available and with no
cost or fee.

Simple techniques to
help you relax

inding ways to relax can

improve life at home and
at the office. While its
not often easy to find time to
slow down, especially for those
men and women juggling the
responsibilities of career and
family, the following are some
simple techniques that dont
take much time but can have a
positive impact on your day.
Take some time out from
multitasking. The ability to
multitask is a cherished commodity for parents and working
professionals alike, but men
and women can benefit from
periodic breaks from their
everyday
juggling
acts.
Something as simple as focusing on a single task for 30 minutes at a time, as opposed to
checking emails while preparing dinner or working on a
project while answering a
clients phone call, can help
lower stress levels and have a
lasting and calming effect on
your nerves.
Make time to meditate
every day. Studies have shown
that meditation can affect the
circuitry in the brain, positioning it to more adequately
respond to illness and stressful
situations. Meditation has the
added benefit of being a relaxing exercise, as meditation
encourages people to sit with
their feet on the floor with
both eyes closed in a relaxing
setting that is free of external
distractions.
Walk away from your desk
and couch. Its well documented that spending too much
time sitting at a desk can have
a negative impact on your
health. In addition to elevating
a persons risk of heart disease
and diabetes, sitting at a desk
all day long has been linked to
repetitive stress injuries, obesi-

ty and back pain,

each of which can
contribute to stressful
living
conditions
that make it difficult
to relax. Men and
women should spend
at least five minutes
each hour walking,
whether they are getting up from their
desk at work or getting off the couch at
home. Doing so takes
little time, but it can
help to relieve stress
at work and at home
and improve your
overall health.
Practice yoga. Yoga is
another activity that can help
men and women relax. Yoga
involves a series of poses that
helps stretch the muscles and

aid their recovery from everyday aches and pains, including

those that often result from
stressful experiences or days at
the office.

IRS warns: Thats not us calling you

ake a deep breath

before responding to
any communication
about your tax return and
verify that the query is actually
from the IRS. Why the need
for caution? The contact may
be from a bogus IRS agent who
intends to steal your financial
identity.
The scam can take many
forms and often starts with an
official-looking e-mail complete with IRS logo that warns
you of a problem with your
return. To correct the situation,
youre instructed to click on an
embedded link. The link sends
you to a website that asks a
series of personal questions.
Answers you supply can be
used to file fraudulent tax
returns or extract money from
your bank accounts.
Another tactic is a phone
call from a fake IRS agent

demanding
information.
Sometimes the phone call will
follow a recent e-mail intended
to make the communication
seem legitimate. The caller
might even know the last four
digits of your social security
number.
Here is what you need to
remember: The IRS will never
initiate contact with you by email.
How can you stay safe
from scams? If you receive an
out-of-the-blue e-mail purporting to be from the IRS, do not
click any link or reply in any
way. If you receive a phone call
about your tax return, do not
provide any personal details.
Simply note the callers information and disconnect.
Whether youre contacted by e-mail, phone call, or
standard mail paper notice,
please call our office immedi-

ately. Well help you determine

if the communication is real
or not and guide you on the
best way to respond.

Things dont work right because the messages from your brain
which are supposed to tell your body how to work are not going
through your spinal cord completely. Picture an electric circuit with
a dimmer switch that is turned down part way.

hich of course means mostly women will read this. So

when your wife, girlfriend, or significant other hands
you this, read it guys. It could save your life and your
relationship.
Look, Im 58, Ive been receiving chiropractic adjustments for a long
time. I havent had the need for any medication in forty years or
so. And I sure as he** dont need any stinking Viagra or Cialis. And
neither do my male patients who have been getting regular adjustments, and some of them have 15 and 20 years on me!

This is simple guys, it aint rocket science. Everyone knows that

your brain runs your whole body.
That means everything. You know
your spinal cord delivers the messages from your brain to your body
that tell your body to do what you
want it to do and need it to do. If
those messages dont go through
your spinal cord 100%, then your
body isnt working at 100%. That
could mean heart problems, high
blood pressure, stomach issues, or
other parts that dont do their job.

Look, your back might not hurt. But neither do all cavities. Your
spinal bones can be subluxated, which means that your spinal
bones are twisted, pressing on your spinal cord, slowing down messages to your body parts. Having spinal subluxations does not
mean your back will hurt, but it does mean that your body parts
are not getting messages they need in order to work properly.

Zone 3, Page 9

Having subluxations in your spine can be causing all kinds of body

parts to malfunction. It could mean back pain, high blood pressure,
heart problems, indigestion or kidney or liver problems or low
blood pressure in some parts when you need them to have high
blood pressure (a.k.a E.D.)
Get your spine checked guys. Spinal
subluxations can cause all kinds of
health problems. Do it for yourself.
Do it for the beautiful person who got
you to read this.

Call Dr. Gary C. Stewart,D.C. today for

your spinal exam at 973- 835-5773.

Memorial Day throughout the Nation

Sleeping. Maybe it would be

safe to say that Memorial Day
had its start in numerous
places wherever the celebration of the patriotic dead was
carried out.
To go back to its beginnings, the first state to officially recognize what was originally called Decoration Day
was New York in 1873, fol-

aside a day to mark the end of

the war or as a memorial, such
as Sharpsburg, Maryland
(Antietam
Battle-field),
Charleston, South Carolina,
Petersburg, Virginia, and
Columbus, Mississippi.
The popularity of the day
and the use of poppies were
heightened in 1915 with the
December publishing of the
World War I poem In

lowed by all the Northern

states by 1890. However, the
South refused to acknowledge
the observance, honoring
their dead on separate days
until after World War I, when
the holiday changed from
honoring just those who died
fighting in the Civil War to
honoring Americans who
died fighting in any war.

Colonel Dr. John Mc Crea.
Inspired by the poem, Moina

four-line verse extolling the
use of the red flower on graves
and on clothing.
Governor Nelson A.

that the State of New York
officially recognized Waterloo

as the birthplace of Memorial

Day. The Congress of the
United States passed House
Concur-rent Resolution 587
on May 17 and May 19, 1966,
in Waterloos favor. Also, on

Lyndon B. Johnson signed a

recognizing Waterloo.

Monday in May the national

observance of Memorial Day.
This ensured a three-day
weekend for all involved, but
it has come under criticism by
some veterans groups, who
feel that the three days takes
away from the feeling of the
observance. Several southern
states have an additional separate day for honoring the
Confederate war dead, such as
January 19 in Texas, April 26

Get your dog in shape

umans are not the

only animals that
may get a bit pudgy
around the middle and tip the
scale in the wrong direction.
Mans best friend also may put
on some extra pounds, necessitating a workout plan to get
back into shape.
According
to
the
Association for Pet Obesity
Prevention, 53 percent of
adult dogs in the United
States are classified as overweight or obese by their veterinarians. Yet, pet owners are
sometimes unaware that their
prized pooches are overweight.
Overweight dogs and
cats face some of the same

health risks as overweight

men and women. Musculoskeletal problems, such as
degenerative joint diseases,

and back problems have been

linked to obesity, as have
heart disease and respiratory
problems. Diabetes and heat

or exercise intolerance are

other side effects of being
overweight.
But a pets weight is not

the lone indicator of how

healthy the animal is, and the
ideal weight can vary from
dog to dog. A body condition
score is helpful in determining
a pets ideal body weight.
Some indications a dog may
not be at a healthy weight
include:
-a belly that hangs below the rib
cage area
-a belly that moves when the dog
moves, unless the dog is pregnant or has just given birth
-inability of the owner or vet to
feel the dogs ribs in the rib cage
-a waddle of skin on the neck of
dogs where excess skin isnt
indicative of the breed
-no visual indication of dogs
waist

-inability of the owner or vet to

feel the bones near the base of
the tail
-a less active lifestyle, including
avoiding exercise and play
-excessive panting
Keeping a dog in shape is
one of the best things you can
do for your pet. But what if
your dog already has packed
on a few unnecessary pounds?
Its time to start a canine fitness routine and follow some
other guidelines.
Talk to your veterinarian.
Obesity could be the result of
eating too much or inactivity,

How to make your renovation a successful, positive experience

By Scott McGillivray

n the United States, renovation spending has more

than doubled since the
late 1990s, reaching nearly
$65 billion last year alone.
Oftentimes the investment a
homeowner makes is substantial, both financially and emotionally. The stakes are high.
Thats why its imperative that
the job is done well from start
to finish. There are a number
of steps a homeowner can take
to ensure a positive experience and a successful outcome, including:
1. Know your goal. Ask the
question, What is this renovation designed to accomplish? More functionality?

4. Opt for a general contractor and trades that are

experienced, licensed and
insured. Dont hesitate to
check credentials and references. Get recommendations
from family, friends and colleagues who have had work
done and were satisfied with
the results.
5. Start with quality building
materials. When it comes to
home renovation and construction, the adage, its
whats on the inside that
counts seems apt. While
homeowners tend to get
caught up in the aesthetics of
a project, such as finishings
and paint colors, the key to a

Storage? Living space? If a

homeowner doesnt know
where theyre going with the
renovation, chances are
theyll never get there.
2. Do your research. In most
things, knowledge is power,
and knowing what to expect,
in advance, can keep expectations in check. Investigate
options, budgets and timelines, and arrange financing in
advance.
3. Hire professionals. Be sure
that they are happy to work
with you to meet your budget
and achieve your vision.
Communicate clearly and
often to ensure understanding
on both sides.

successful renovation often

lies in what you wont see.
Investing in quality behind
your walls will ensure durability, comfort and safety for
years to come.
6. Focus on the basics. This
includes quality electrical,
plumbing, HVAC, framing
and drywall. Dont underestimate the importance of insulation - especially in a basement renovation. Not all
insulation is created equal.
Opt for insulation that is fireresistant, sound absorbent and
resistant to mold, mildew,
bacterial growth, and rot. In
my renovations, I like to

use products like Roxuls

7. Develop a good plan. This
includes preparing for the

unexpected. Setting aside a 20

percent contingency fund will
help bring you to the finish
line when unanticipated
issues creep up.
Lastly, the key to a successful renovation includes
patience. Living in a construction zone - or alternately

rewarding than the end result,
which can bring years of

5 signs your home insulation is not working

ome insulations can lose

performance over time,
sustain damage or simply
no longer meet updated building codes. Its an issue that can
be costly, because if your
homes insulation isnt doing its
job, you could be wasting
money and resources.
You dont have to be a
trained professional to know
you have a problem. Here are
several signs that your insulation is lacking:
1. Energy bills - High energy
bills are the biggest red flag,
especially relative to the size,
age or condition of the home. If
you have a run-away energy
bill, your insulation may need
to be upgraded. This can be the
case, even in a newer home.

its time for an upgrade. But be

careful, as certain types of older
insulation, such as Vermiculite
insulation,
may
contain
asbestos. If youre unsure, do
not disturb it and hire a professional to conduct testing
and/or removal. This should
not be a do-it-yourself job.
5. You detect pests and/or
moisture - Insulation - and
your building envelope - can
be compromised by the presence of pests. Moisture is an
even bigger obstacle to optimal thermal performance, as
some types of insulation can
sag or collapse when damp,
leaving voids and causing air
to flow in and out of the
building envelope.
While some solutions

2. Drafts - Do you need to put

on a sweater even with the
heat on, or does your air conditioner run incessantly without
making enough of a difference?
Thats a sign of a deficiency in
your building envelope.
3. Inconsistent temperatures Is it warm in one room, but
cold in another? Are your walls
or interior closets cold to the
touch? Its possible that while
your whole home may not need
attention, certain rooms may
need to be addressed.
4. Condition of insulating
materials - Consider the age of
your insulation. Would it stand
up to todays building codes? Is
it in good shape or is it crumbly? If your insulation has
degraded or isnt performing,

may be more complicated,

requiring the opening of the
existing wall cavities, others
can be addressed more easily.
The best way to improve thermal performance and increase
energy efficiency is to upgrade
attic
insulation.
Laying
Comfortbatt insulation over
existing material to achieve a
minimum depth of 16 inches,
or an R-value of R50, is a simple DIY project that can generate immediate results. To fully
assess your home and explore
remediation solutions, consider hiring a professional home
energy auditor to evaluate your
homes energy performance.
Even in a new home, the
results may be surprising.

to home. Smaller parks may

not have every attraction, but
they do boast a variety of
activities and rides that can
keep children occupied for
hours. Remember that amusement parks reach peak capacity when kids arent in school.
It may be wise to vacation at
off-peak times to avoid the
crowds and save time spent
waiting in line.
Choose places of cultural
impact. Family vacations do
not need to be limited to riding roller coasters. Children
can learn a lot and take away
lasting memories from vacations that open childrens eyes
to something new. Visiting a
large city, such as Los
Angeles, New York, Chicago,
or Atlanta, can be a vacation
in education. Metro areas
boast attractions that can
excite children, including tall
buildings, museums and public transportation hubs just
waiting to be explored.
Families venturing internationally may want to see the
cultural centers of Rome,
London or Athens.
Consider a family resort.
If a beachside adventure is
your familys idea of the perfect retreat, explore your
options with regard to family
resorts. For an all-inclusive
price, these resorts may couple
food packages with accommodations and activities to keep
families happy. Check with
popular hotel chains to see if
they offer all-inclusive packages in destinations your family wants to visit. Parents who
are pressed for time often find
all-inclusive resorts offer great
values and dont involve too
much advanced planning.
Go off the grid. A memorable family vacation does
not have to be spent in the
heart of it all. Booking a

campsite location and then

spending a few days in the
great outdoors allows families
to get back to nature while
enjoying an inexpensive vacation. Families can camp in
lodges or basic cabins, or
rough it outside in a tent.
Some families enjoy the benefits of renting an RV and visiting various campsites on their
vacations. Let the activities
unfold as you explore different
trails and backroads along the
way.
Family-vacation season
is around the corner. No matter where travelers end up, the
ultimate goal should be to
have fun, experience something new and spend quality
time together with loved
ones.

but it also can be a sign of a

serious condition. If a routine
exam and blood work come
up normal, then you can
begin a plan for helping Fido
shed the weight.
Consider a new food. There
are many different types of
foods on the market, including low-calorie options. Some
foods contain extra fiber to
help the dog feel fuller without having eaten as much.
Also, look for foods with lean
protein sources without grains
and other filler.
Break up the feeding
schedule. Instead of one
large meal a day, feed your
dog two or three smaller portions of food, which will help
keep his metabolism going

all day long.

Become joint joggers.
Jogging with a dog can
become an enjoyable pastime
that enables you both to get
exercise and stay in shape.
Take up swimming. Many
dogs are natural lovers of
water, and swimming is an
effective, low-impact exercise.
Teach your dog tricks.
Physical tricks, like fetching a
ball or rolling over, can keep
dogs active.
Go for long walks. Take
your dog with you wherever
you go. The more he or she is
up and moving, the less
chance there is to sleep and be
lazy.

The time has come for grill

masters to gear up

rilling season has

returned for the millions of people who
live in regions where grilling is
unlikely to happen during the
winter months. While standard
fare like hot dogs and hamburgers may suffice for backyard
barbecues with lots of friends
and family, when the party is
smaller, grill masters may want
to up their games and try their
hands at something new. Tri tip
steak is cut from the bottom of
the sirloin and is popular on
the West Coast of the United
States, but this cut, which is
suited to marinating and rubbing, can be enjoyed anywhere.

Those who want to give

tri tip steak a shot may find it
sold as bottom sirloin roast in
their local grocery store or
butcher shop. But once you
find the right cut, the following
recipe for Grilled Tri Tip with
Black Olive Aioli courtesy of
Bill Niman and Janet Fletchers
The Niman Ranch Cookbook (Wiley) is sure to please
you and your guests the next
time you fire up the grill.

cooking.
Prepare and light a charcoal grill for direct cooking.
Add the olives to the aioli
and season with cayenne.
When the grill is at its
hottest (when the coals are red
and glowing and its too hot to
hold your hand over the grill
for more than a couple of seconds), remove the tri tip from
the marinade, wipe off any
excess marinade, and season on
both sides with sea salt. Place
the steak on the cooking grate
directly over the coals, cover
the grill, and cook, turning
once, for about 20 minutes, or
until a thermometer inserted
into the thickest part reads 130
F for medium rare. Transfer to a

cutting board and let rest for 5

to 10 minutes.
Cut the tri tip into thin
slices across the grain and

Century 21 Crest Real Estate establishes

Crest Gives Back initiative

F
Thinking of selling?...
Consider one of the
Top Selling Agents
from these pages.

or the past 40+ years, if

you ask local residents
about Century 21 Crest
Real Estate, you will most
likely hear of the exemplary
treatment they received when
purchasing their home here in
Pequannock/Pompton Plains.
But there is another story you
may also hear....one in which
a group of giving and generous
individuals who care about
the communities they serve.
The professionals at
Century 21 Crest Real Estate
have been volunteering their
time and giving generously to
various
Township
and
Community programs for
decades. To honor these pro-

fessionals,
Owner/Broker
Patricia Wojtyszyn has established the Crest Gives Back
initiative. I have been proud
of the generosity of this group
of professionals for years.
Crest Gives Back gives us
the opportunity to acknowledge their altruistic endeavors.
Whether it be flag planting along the Turnpike for
Memorial
Day,
serving
Thanksgiving Dinner at New
Bridge Services or volunteering at Grains of Hope and
Relay for Life. In addition to
supporting Township athletes,
the Pequannock Valley
Rotary, Boys and Girls Club,

the local FBLA chapter, and

helping out local families in
need, Century 21 Crest Real
Estate has been there through
the years. The bottom line is
that we really care about our
community. When you think
about it, it makes sense. We
are in the business of helping
people realize their dreams of
home ownership. We really
get to know these people
they become friends, and they
are important to us. said
Marie
Episale,
Broker/
Manager.
Recently, over a dozen
Century 21 Crest Real Estate
agents and their families volunteered their time to pack-

age meals for Pequannock

Grains of Hope, an organization that addresses world
hunger by providing food to
those in need. This years
event benefited Haiti and the
New Jersey Food Bank. The
event was introduced to
Century 21 Crest Real Estate
by real estate agent, Addie
Scattaglia. When asked why
this event is so importan
to her, Addie responded,
Everyone who gets involved
with this event comes away
feeling that it was very worthwhile, and knowing that they
have done something to make
others lives a little bit better
now that they have food for

their families. As much as

153,600 meals were packed in
5 hours, which surpassed our
goal. It is wonderful to watch
our community come together
to help others. I look forward
to this event every year.
Century 21 Crest Real
Estate is located at 142 Rt. 23
North in Pompton Plains.
