Box 2910 ‘Austin, TX 79768 Re: $B 1628 and HB 3646 Dear Senator Seliger and Representative King: | am writing to respectfully ask you consideration in opposing SB 1628 and HB 3646. | have had some serious problems in dealing with my insurance company, and those problems have really hurt my business. Passing these bills would limit the protections that are needed for policyholders for small businesses like me. Here is a litle background. We are a family owned business that began operations of a grocery store in 1967. The hardware store was opened in 1980. | began with the business in 1979. | am the general manager of the hardware store. We sold the grocery store in 2008. We also added a heavy ‘equipment rental business to the hardware store in 1999. | personally own multiple commercial and residential properties here in Pampa. My family also owns thousands of acres of land, on which we raise crops and cattle. | am a past Chairman of the Board of the Pampa Texas Chamber of Commerce. 1am active in community development and civil affairs in Gray County and the City of Pampa. My wife and | have resided in Pampa for over 50 years and truly enjoy the small town atmosphere. Ihave property damage coverage with Sparta Insurance, a division of Member Insurance. In the Fall of 2011 we received roof damage and did not realize it until we had a snowstorm in February of 2012, We filed a claim with the insurance company and they agreed to pay. We received a small check ‘that wouldn't even cover the roof repairs, leaving the $170,000.00 in damaged inventory out of the ‘equation. It also did not cover the interruption to my business, which was part of my policy. Our own employees spent countless hours cleaning up water and damaged ‘goods and property, as we could not hire additional repairman to address the issue. eel that if $B 1628 or HB 4636 were law, that the policyholders would not have the recourse against insurance companies. | have never filed a lawsult, and was not approached by a storm chasing lawyer. had to hire a firm to enforce an appraisal award the insurance company ‘would not pay, which ic vidiculous. Insurance companies don’t need more protection, businesses like mine do. Giving these adjusters immunity or taking away their incentives to pay me will make going after them impossible. AS | speak with more people, ! hear that there are a lot of people having issues settling their claims with ineurance companies. | don't feel that policyholders in general have changed, but we have seen change in the insurance companies. This is causing more and more claims in the courts. | feel that this vould have a definite impact on the homeowner and business owner and their polices in the state of Texas.
