DANT 0852 District 2 05/18/2015 Collier County Sheriff's Office, Naples, FL Page 4 of 5Incident Report NARRATIVE REPORT NUMBER: 1500013563 ON 05-18-2015 AT APPROXIMATELY 1218HRS, YRB DEPUTIES AT GULF COAST HIGH SCHOOL REQUESTED ADDITIONAL BACK--UP UNITS RESPOND IN REFERENCE 0 A LARGE GATHERING OF UNRULY STUDENT WHO WERE UNLAWFULLY ASSEMBLING. I ARRIVED ON SCENE AT APPROXIMATELY 1225HRS AND WAS ABLE TO LOCATE THE DEPUTIES REQUESTING ASSISTANCE IN THE AREA OF THE CAFETERIA. THE DEPUTIES HAD THE SITUATION CONTAINED BUT I OBSERVED NUMEROUS STUDENTS (APPROXIMATELY 30-50) STILL GATHERED IN THE IMMEDIATE AREA REFUSING TO GO BACK TO CLASS. I WAS INFORMED THAT OUR MISSION WAS TO GET THE STUDENT MOVING AND BACK TO CLASS. I HEARD AN EMPLOYEE OF THE SCHOOL TELL SEVERAL STUDENTS NEAR A DOOR TO GO BACK TO CLASS BUT THEY WERE NOT COMPLYING. I ATTEMPTED TO CLOSE THE DOOR BUT A WHITE MALE STUDENT (LATER IDENTIFIED BY FL D/L AS PUSHED THE DOOR OPEN AND BEGAN COMING AT ME IN AN AGGRESSIVE MANNER. AS I WAS IN THE PROCESS OF CONDUCTING A LAWFUL INVESTIGATION AND WAS HINDERING MY ABILITY TO CONDUCT IT BY NOT COMPLYING WITH MY REQUEST TO GO BACK TO CLASS, I GRABBED HIM IN AN EFFORT TO PLACE HIM UNDER ARREST FOR OBSTRUCTION OF JUSTICE. AS I WAS EXPLAINING THIS QUICKLY TO AND ATTEMPTING TO HAND-CUFF HIM, HE BEGAN TO TENSE, BRACE AND ATTEMPT TO PULL AWAY FROM ME. THIS WAS INCREASINGLY TENSE BASED ON THE FACT THAT NUMEROUS OTHER STUDENTS WERE NOW ATTEMPTING TO GET INVOLVED AND FURTHER HINDER OUR ATTEMPTS TO QUELL THE SITUATION. I WAS ABLE TO HAND-CUFF (DOUBLE-LOCKED) AND BRING HIM TO MY PATROL CAR. HE WAS THEN TRANSPORTED TO NUC WITHOUT FURTHER INCIDENT AND CHARGED WITH OBSTRUCTION OF JUSTICE AND RESISTING ARREST WITHOUT VIOLENCE. NARRATIVE PL J. I was driving a fully marked patrol vehicle and wearing a full class B uniform. I responded to Gulf Coast High school (7878 Shark Way) as the youth relations Deputy had requested backup via radio due to a large disturbance. The following were my observations and actions: As I entered the school, I first noticed a very chaotic scene with students appearing agitated moving about everywhere. I could smell pepper spray in the air. I continued into the courtyard where I observed a group of Deputies attempting to control an individual. I saw several other subjects sitting down being treated by Deputies for pepper spray exposure. I observed the suspect, later identified as start to approach the group of Deputies trying to hand cuff the other student. I attempted to stop him in fear of him attacking the Deputies or even simply agitating the situation more. Cpl Browning from youth relations intercepted him before I made contact. I observed him tell that he needed to leave the area and go to where he was supposed to be. relunctantly walked away. A few minutes passed and the Deputies had managed to secure the other student. A Deputy began to walk the student through the door to the foyer when I saw coming towards the Deputy's back from the right. As the Deputy passed through the door, came between me and the Deputy. As was directly behind the Deputy and fearing for the safety of the Deputy, I grabbed his backpack to stop him and told him not to get near the Deputy. immediately snatched away from me and said don't grab me. I told him again to stay away from the Deputy and he replied that I pushed him. I maintained control of his left arm, but I felt him start to pull away. As he was now physically resisting me as well as ignoring/refusing my lawful commands, I elected to place him in handcuffs to stabilize the situation. I attempted to turn him around and he began to push and pull as well as try to break free from my grasp. We spun around as I tried to control him and I was finally able to secure him in handcuffs using the wall to assist me. The handcuffs were double locked and one finger spacing was verified. Based on interjecting himself into the situation repeatedly and after being warned, thereby causing the diversion of manpower, creating an officer safety risk, and then physically resisting me, he was subsequently charged with obstruction of any officer. He was turned over to Sgt Mel Gonzalez to be processed and transported to the jail without further incident.
