HC 1. By attacking or seizing a vessel on the high seas or in Philippine
Waters
2. By seizing in the vessel while on the high seas or in Philippine waters the
whole or part of its cargo, its equipment or personal belongings of its
complement or passengers
Elements: 1. That a vessel is on the high seas or in the Philippine waters; 2.
That the offenders are not members of its complements or passengers of the
vessel; 3. That the offenders a) attack the vessel or b) seize.
Mutiny unlawful resistance to a superior, or the raising of commotions
and disturbances on board a ship against the authority of the commander
Qualified Piracy QC: 1. Whenever the offenders have seized the vessel
by boarding or firing upon the same; 2. Pirates abandoned their victims
without means of saving themselves; 3. The crime is accompanied by
murder, homicide, physical injuries, or rape
Classes of Arbitrary Detention: 1. Arbitrary Detention, 2. Delay in the
delivery of detained persons to the proper judicial authorities, 3. Delaying
Release
Arbitrary Detention (124) (1) Any public officer or employee (vested w/
authority to detain or order detention but with no legal grounds) (2) detains a
person (3) without legal ground
Detention actual confinement of a person in an enclosure or in any
manner detaining and depriving him of his liberty
Legal grounds (1) commission of crime (2) violent insanity or any other
ailment requiring compulsory confinement of patient in hospital
Delay in delivery of detained persons to proper judicial authorities
(125) (1)offender is a public officer/employee (2) that he has detained a
person for some legal ground (3) he fails to deliver to proper judicial
authorities w/n 12 light penalties, 18 correctional penalties, 36 afflictive
or capital penalties
Delaying Release ((126) E: (1) offender is a public officer or employee
(2) that there is a judicial or executive order for the release of a prisoner or
detention prisoner, or that there is a proceeding for the liberation of such
person (3) offender without good reason delays: (a unduly delaying) service
of notice of such order to the prisoner (b) performance of judicial or
executive order for release (c unduly delaying) the proceedings upon a
petition for release
2nd Elements: (1) offender makes an attack, employs force, makes a serious
intimidation or makes a serious resistance (2) person assaulted is a person in
authority or his agent (3) at the time of the assault the person in authority or
his agent is (a) engaged in the actual performance of official duties (b) or
that he is assaulted byy reason of the past performance of official duties (4)
Offender knows that the one he is assaulting is a person in authority or his
agent in the exercise of his duties (5) there is no public uprising
Indirect Assault (149) Elements: (1) a person in authority or his agent is
the victim of any forms of direct assault defined in Art. 148 (2) That a person
comes to the aid of such authority or his agent (3) Offender makes use of
force or intimidation upon such person coming to the aid of the authority or
his agent
Evasion of Service (157) Elements (1) Offender is a convict by final
judgment (2) he is serving his sentence which consists in deprivation of
liberty (3) he evades the service of his sentence by escaping during the term
of his sentence.
Circumstances qualifying the Offense if evasion or escape takes place
by (1) means of unlawful entry (2) breaking doors, windows, gates, walls,
roofs or floors (3) using picklocks, false keys, disguise, deceit, violence or
intimdation; or (4) Through connivance with other convicts or employees of
penal institution
Violation of conditional pardon (159) contract between CE, who grants
the pardon, and the convict, who accepts it. Since it is a contract the
pardoned convict is bound to fulfill its conditions and accept all its
consequences, not as he chooses, but according to its strict terms.
Elements (1) offender is a convict (2) he was granted conditional pardon by
the CE (3) he violated the conditions
2 Penalties provided (1) Prision correccional in its minimum period if
penalty remitted does not exceed 6y (2) unexpired portion of his original
sentence if penalty remitted is higher than 6y
