Cease and Desist Notice

Dear Mr. Rushing:

This law firm represents The Gabel Center, LLC (The Gabel Center, LLC) in
connection with its intellectual property rights. Your use of Gabel Center is a violation of The
Gabel Center, LLCs common law trademark rights, common law service mark rights, and trade
name rights, and demand is hereby made for you to cease and desist any and all use of the
Gabel Center name.
Please be advised that The Gabel Center, LLC will undertake all appropriate steps to
protect its Marks and its associated goodwill. You can avoid legal action by immediately
ceasing and desisting from any and all infringing activity, including the use of Gabel Center
and all promotion and/or marketing of The Gabel Center, LLC. You are hereby put on notice
that Mr. Jerry Bowling and I will be monitoring your use of Gabel Center.
Your use of Gabel Center is easily confused with that of The Gabel Center, LLC and
erodes its distinctiveness and the goodwill associated with the trademark. We expect for you to
promptly resolve this situation and avoid any possible litigation. However, should you fail to
comply with my clients demands, I have been instructed to pursue all means necessary in order
to enforce its legal rights.
Please reply adequately to this letter by 5:00 P.M., Friday, July 31, 2015, wherein you
agree to cease and desist any and all use of the Gabel Center name, in an effort to amicably
resolve this issue quickly. Should you have any questions or concerns regarding anything in this
letter, please do not hesitate to contact me at the address or phone number below.
