Dear Ms. Paguirigan,
With regard your concern on special leave for women under the Republic Act
9710 and Department Order No. 112-11, it is worthy to note that an employee,
whether daily paid or monthly paid, is entitled to such for two (2) months with full pay
based on her gross monthly compensation. Gross monthly compensation refers to
the monthly basic pay plus mandatory allowances fixed by the regional wage boards.
Further, per Department Order No. 112-A, for purposes of determining the
period of leave with pay that will be allowed to a woman employee, the certification
of a competent physician as to the required period of recuperation shall be
controlling.
For further inquiries and legal assistance, please personally visit the
Department of Labor and Employment - Regional Office IV-A located at 4/F
Andenson Bldg. II, Brgy. Parian, Calamba City, Laguna or call us at (049) 545-0294.
Truly yours,
ATTY. ALVIN M. VILLAMOR
