OFFENCES AND

PENALTIES UNDER THE


I.T Act, 2000

Damaging
Computer/System/Data/Network
The offence :Under Section 43
Without the permission of the owner or person in charge of a
computer system
Securing access to the system
Downloading data or copying them
Computer contamination/injecting virus
Denial of access to other authorized persons
The Penalty :Compensation up to Rs. 1 crore to the person affected.

NON COMPLIANCE WITH REPORTING


SYSTEM
The offence:1. Under Section 44 (a), Failure to furnish any document/return or report to the
controller of certifying authority.
Compensation of Not exceeding Rs. 1.5 lakh for each failure.
2. Under Section 44 (b), Failure to file any returns or furnish any information,
books or other documents within the given time.
Compensation of Not exceeding Rs. 5000 per day during the period of noncompliance.
3. Under Section 44 (c), Failure to maintain books of account or record.
Compensation up to Rs. 10,000 per day
4. Under Section 45, Violation of any rules or regulations for which no specific
penalty is provided elsewhere in the Act.
Compensation up to Rs. 25000 to the affected person or a penalty up to Rs.
25000

TAMPERING
Under Section 65
Tampering with Computer source document concealing, destroying,
altering.
The Penalty:Imprisonment up to 3 years or fine up to Rs. 2 lakh or both.

HACKING
Under Section 66 (02)
Hacking with computer system causing wrongful loss or damage to
public or any person
Deleting , altering, destroying any information residing in the
Computer.
The Penalty:Imprisonment up to 3 years or fine up to Rs. 2 lakh or both.

TRANSMISSION OF OBSCENE
MATERIAL
Under Section 67
Publishing or transmitting obscene material in electronic form
The Penalty: Imprisonment up to 5 years and fine up to 1 lakh for first
conviction.
Imprisonment up to 10 years and fine up to 2 lakh for second
and subsequent convictions.

MISREPRESENTATION TO
CONTROLLER OF CERTIFYING
AUTHORITY
Under Section 71
Misrepresentation of material facts to the Controller of certifying
authority to obtain Digital Signature Certificate.

FALSE INFORMATION IN DIGITAL SIGNATURE


CERTIFICATE
Under section 73
Publishing Digital Signature Certificate with false particulars.
The penalty:Imprisonment up to 2 years or fine up to Rs. 1 lakh or both.

BREACH OF CONFIDENTIALITY
Under Section 72
Securing access to electronic record and disclosing information.
The Penalty:Imprisonment up to 2 years or fine up to Rs. 1 lakh or both.

MISUSE OF DIGITAL SIGNATURE CERTIFICATE


Under Section 74
Creating a Digital Signature Certificate for any fraudulent or unlawful
purpose.
The Penalty:-
