Notes
1.

The developer is required to provide a Performance Bond with a minimum value of


five (5) percent of the estimated cost of the sewerage works. This Bond shall cover
for a minimum period of 12 + 3 months of the Defects Liability Period (DLP).

2.

The developer is required to make good all minor defects identified during the final
inspection within one (1) month period from the date of takeover, failing which
repair work will be carried out by contractors appointed by SSD and all costs
including administration charge will be recovered from the Bond in full.

3.

In cases where the Performance Bond is insufficient to cover repairs, the developer
guarantees full payment of the outstanding differences in cost for remedies within 30
days of SSD notice.

4.

The developer shall ensure that sewerage assets are constructed and handed over in
line with the Authorities requirement. Developer is to ensure that submissions of all
documents in Section A of the checklists are in accordance with SSD requirements.

5.

The Professional Engineer(s) and the Licenced Contractor have to ensure full
compliance with the attached final inspection checklists and the quality of ALL
completed works.
Both are jointly liable for non-conformance with SSD
requirements and are subject to penalisation in accordance with provisions under the
Sewerage Services Act 1993 and other related Malaysian laws.
