Appeal Decisions, the Standing and Mootness in Administrative Litigation and the Authority of State Responsibility. However the 7th Paragraph of Administrative Appeal Act is clearly inconsistent with the 15th
Paragraph of the Administrative Procedure Act. According to this Article the 15th Paragraph of the Administrative Procedure Act includes the
content of Transfer of Assignment of Competence. In another words,
this Paragraph is same as the concept Delegation in German law.
The reason for placing Legislation in the 15th Paragraph of Administrative Procedure Act misunderstands the Assignment of Competence as the concept Mandat in German law. The 7th Paragraph of
Administrative Appeal Act is not suitable and should be modified.
