sanctioned by Administration Section.
Administration endorses a copy of the
leave sanctioned to Cash Section. On
receipt of the sanction, Cash Section
stops her Transport Allowance for
August. Shiela claims that she is
entitled for Transport Allowance and
submits an application requesting that
she be paid Transport Allowance for
August.

leave
is
mentioned
at
the
paragraph
one
of
the
clarification part of the Transport
Allowance rules.

Clarification

Absence from duty means absence from

Headquarters/Place of posting due to any


of the reasons such as leave, training,
tour, etc. If a Government Servant is
absent from Headquarters/Place of posting
for a full calendar month, she will not be
entitled to any Transport Allowance
during that calendar month. If the
absence covers more than one calendar
month, it will not be admissible for
calendar month(s) wholly covered by the
absence. If the absence does not cover
any
calendar
month(s)
in
full,

Whats the solution?


Shiela was on leave for 45 days from 2nd

August to
15th September, 2012.
Therefore, it is clear that she was not on
leave for the full calendar month of August.
Hence, as per the clarification part of the

Transport Allowance Rules, Transport


Allowance should be admissible to
her.

Competent Authority
Under

Secretary-in-charge
of
Administration as the Head of Office, will
be the competent authority to decide the
case.
