At a recent hearing, Judge Kathryn Solorzano requested to see evidence of Pauley Perrette's obsessive internet postings and "tweets" about me, which have incited hundreds of third party violent threats against me, as part of Ms, Perrette’s decade-long internet harassment campaign, all of which has been previously withheld from this court. Pauley Perrette’s online hate campaign consists of countless violations of Penal Code 652m(a), of which I am the victim, and which are far more egregious than what I was charged and convicted for. A summary of Pauley Perrette's extensive hate campaign in violation of the California Penal Code, is provided herein, which has escalated since the trial. 1 ask the court to consider this in all future proceedings, including a hearing for sentence modification (I was not allowed to speak prior to being sentenced), HISTORY In 2004 I cut off all contact with Pauley Perrette and filed for divorce. I had my attorney inform Ms, Perrette in a polite letter, which specifically requested "private resolution rather than public litigation” in order "to avord public disclosure of our private differences". (Exhibit 1) Instead, she did the opposite. Pauley Perrette refused to accept the divorce papers and immediately launched an internet "hate campaign" against me on her personal blog, where she began inciting violent threats against me from unwitting "NCIS" fans by comparing me to such things as Hurricane Katrina, Apartheid, and the Holocaust, and comparing herself to victims of the Holocaust. (Note: previously, assistant city attomey Elizabeth Gertz denied the Holocaust posting to this court, falsely telling Judge Solorzano it did not exist, however, she has since been exposed publicly by a news organization for making that false statement to the court, and has been forced to admit that Ms. Perrette did indeed publish public internet postings comparing me to the Holocaust, and comparing herself to Holocaust victims.) For years | refused to sespond or speak publicly about Ms, Perrette's online harassment, but she continued. By 2006 she was doing defamatory interviews with the national media, in which I was the sole subject matter. (Exhibit 2). As a result, Lhad begun to receive death threats from numerous third parties, and duped NCIS fans began public discussions about the "best" way to murder me in order to inflict the most pain (Exhibit 3), Even my attomey became a victim of this third party harassment, and informed the court of it on the record. The relevant selection from that transcript is provided as Exhibit 4 Ms, Perrette acknowledged that the consequence of her actions was third party harassment and violent threats, but signed a Declaration stating "7 have no control over my fans" (Exhibit 5). In an attempt to stop Ms Perrette’s harassment and the violent threats, I filed a defamation lawsuit, L.A.S.C. case #BC358141. Ms. Perrette had the lawsuit dismissed by an anti-SLAPP motion, successfully arguing that it was "in the public interest" to publicly discuss our divoree In 2008, after having remained completely silent while being victimized for four years by Ms, Perrette's relentless online hate campaign, and in fear for my physical safety, I finally began to respond publicly to the false accusations and th ted violent threats. I also reported her to the LAPD Threat Management Unit, Because Ms, Perrette had made extortionate threats to "Star Crazy" me, I provided them Ms. Perrette's "one page" treatment for her "Star Crazy" storyline, in which the "female television actress" "gets a restraining order” so she can “staik him’ and have him falsely arrested, and then "calls journalist" to publicize herself as a “victim” and incite her fans to commit violence. Just as. witness Courtney Washburn testified at the trial, I told the detective that Perrette had threatened to execute this storyline against me if I filed for divorce, and I showed the detective where Ms. Perrette had written the phrase "For everv Jodie Foster there is a John Hinkley, you just have to find him" referring to Ronald Reagan's attempted assassin who stated he did so to impress the aciress. Subsequent to making my police report, Ms. Perrette sent me one of several handwritten death threats, stating unequivocally “/ WILL KILL YOU”. 1 provided Ms, Perrette’s handwritten death threat to the LAPD and filed a police report. (Exhibit 6) PAULEY PERRETTES TWITTER HATE CAMPAIGN Ms. Perrette then escalated her harassment campaign and inciting of violent threats onto Twitter.com. Amplified by the success of “NCIS”, there are over a half million "followers" who subscribe to and receive each of her defamatory “tweets”, With Perrette’s knowledge and encouragement, these incendiary posts are then re-tweeted many times As an example, in March 2012, Perrette went on a twitter rampage about me, again falsely claiming to be a "victim" of a "sialker", Perrette escalated the violence she was inciting by telling NCIS fans that she was going to leave the show and move, because she had "no protection from her stalker", etc. Although all of this was false, Ms. Perrette's tweets successfully incited hundreds of NCIS fans to post violent threats against me, (Exhibit.7) Perrette’s tweets about me were then published by the National Enquirer (Exhibit 8), confirming the public knows she is speaking about me, and resulting in further violent threats. In October 2012, Perrette tweeted to NCIS fans, claiming that the reason she refuses to personally interact with them is her "big bully stalker" was "posing as tons of fans", and its "why she can’t reply" to them. Again this is utterly and patently false, but predictably it incited more violent threats (Exhibit 9) In January 2013, Pauley Perrette continued falsely promoting herself as a "survivor of domestic violence" and even began falsely insinuating she was a victim of "rape", (Exhibit 10). Again, Perrette was successful in inciting a wave of violent threats. Page 2 of 4In August 2014, Perrette further escalated her defamatory hate campaign, by tweeting claims that I was now actually "ferrorizing" her AND NCIS fans. Again she claimed that "young girls" who didn't like her online were actually me "posing" with "fake accounts" and "harassing" NCIS fans. Perrette actually started directing her tweets AT ME. speaking to me in the first person and addressing me as "you". Again, this was all false, defamatory, and incited a wave of hate and violent threats. (Exhibit 11) In September 2014, Perrette continued escalating her hate campaign, falsely tweeting that she endured “years of sexual and physical abuse". (Exhibit 12) Again this is false, defamatory, and incited violent threats. It also incited actual physical assaults against me In October 2014 Ms Perrette’s tweets were again published by national media, exposing Perrette for “heaping abuse on her ex via twitter”. (Exhibit 13) Recently, in December 2014, Ms, Perrette continued inciting more violent threats on twitter, falsely telling NCIS fans that they were “involved in a serious personal problem” which she identified as her “stalker” and “predator”. (Exhibit 14) Pauley Perrette continues inciting violence to this very day. Just recently, June 6. 2015 she published another post falsely publicizing herself as a “victim” of a brand new never before mentioned, defamatory, and incendiary allegation complete with a depiction. of alleged bruises and physical injury which she bizarrely drew upon her own flesh with a pen, then photographed it, and published it.. (Exhibit 15) ‘Ms. Perrette continues to (ab)use her fame in interviews to incite further violence by falsely telling NCIS fans about her “stalker” that is “ruining it for everybody”, again inciting them by making the clear inference that if it wasn’t for me she would be interacting with them. (Exhibit 16) ‘The violent threats which Ms. Perrette incites make direct references to physically assaulting me, murdering me, the use of firarms, and showing up at my home. Many are so severe, they themselves violate California Penal Code 653M (Exhibit 17) Despite the longstanding valid Los Angeles Superior Court ruling that there was never any violence during our marriage, and the fact that both Ms. Perrette and her attorneys agreed with that fact at the time, Ms, Perrette now actually markets herself victim _of “domestic violence" to promote her career. Perrette has done this so prevalently that in some places the actual show NCIS is marketed SOLELY based upon Perrette’s legal “battle” against me. Check it out now! #NCIS on AXN” " (Exhibit 18) ‘Ms. Perrette also sends false and defamatory Twitter messages about me to the editors of news organizations, calling me a “stalker” and calling them a “tool of a psychopath stalker” for publishing proof she committed perjury at the trial. Ms, Perrette’s displayed mental state is terrifyingly disturbing, as she incoherently rants that the media “have no mom” and “have no God” if they don’t follow along with her hate campaign. (Exhibit 19) Page 3 of 4CONCLUSION Pauley Perrette has instigated, initiated and sustained an extensive Intemnet hate campaign for over a decade, which she continues to maintain and escalate to the present day. In doing so she has routinely incited countless violent threats against me, and incited actual violent assaults against me Countless instances of Pauley Perrette’s tweets violate California PC 653m, and have been reported numerous times to the LAPD, however, assistant city attorney. Elizabeth Gertz has refused to prosecute Ms. Perrette for her ongoing criminal activity, effectively encouraging her and perpetuating the violence, necessitating the preparation of a federal lawsuit for a violation of my civil rights, and a “sustained pattem of selective enforcement and prosecution of the law”. Pauley. Perrette’s tweets, and the rest of her extensive Internet hate campaign, are far more egregious than what I was convicted for, and have resulted in not just a “fear” of “third party harassment”, but actual third party harassment, acfual violent threats, and ‘actual physical violence, (Ms, Perrette even shamelessly misuses well-intentioned populist internet catchphrases like “#NoHate” and “#NoNegativity” to cloak and fuel her obsessive ulterior agenda and long term negative hate campaign.) Judge Kathryn Solorzano has repeatedly, and rightly, stated “This is not a stalking case”, “Mr. Shivers is not a stalker” and “Mr. Shivers has never been charged with stalking”, and Ms, Perrette has also been warned by other judges to stop saying that, but Pauley Perrette continues to make such false, defamatory and inflammatory statements, with the full intent and effect of inciting hatred, violent threats and violent actions, just as she threatened “For every Jodie Foster there isa John Hinkley, you just have to find him” It should be remembered that, as shown here in Exhibit 1, I initially filed for divorce and had an attorney attempt dignified and amicable private resolution, avoiding any public discussion whatsoever, and that I suffered YEARS of harassment and comparisons to things such as the Holocaust in complete silence, before finally speaking out in self defense, and only after myself and my family were the victims of an unending stream of violent threats, systematically incited by Pauley Perrette, which she continues to this day, showing no sign of stopping.
