DIANAPOLIS - MARION COUNTY CITY COUNTY COUNCIL ETHICS COMMITTEE, COMPLAINT RE: LINCOLN PLOWMAN Statement of Facts Lincoln Plowman (“Plowman”) is an elected City-County Councillor representing District 25. Plowman is a swom police officer of the Indianapolis Metropolitan Police Department (“IMPD"). 3. Onoor about February 3, 2010, Plowman was placed on administrative leave with pay from his duties as, an IMPD Major and was required to turn in his badge, gun and car. 4. Plowman is under internal investigation and possibly federal investigation for reasons not known to the public or other City-County Councillors. 5. According to the Department of Public Safety, Plowman may disclose the nature and circumstances of the investigation if Plowman so chooses. Complaint Allegations As a swom law enforcement officer and as an elected City-County Councillor, Plowman must be accountable to the public. “Ethical standards for members of the city-county council are essential to maintaining public trust in the handling of public affairs of the city and county.” Revised Code of Indianapolis-Marion County, Indianapolis (“Rev. Code”) § 151-1121(a). “Its a duty of all councillors to act at all times in the best interest of the public and to avoid any appearance of acting in their own private interest.” Rev. Code § 151-1121(b). “A councillor with an actual conflict of interest shall be disqualified from voting on the matter.” Rev. Code § 151-1122(b)(3). Because the nature of the investigation is unknown, the public and councillors do not know if the investigations relates to Plowman’s work as a councillor, as a law enforcement officer or as a private citizen. This is counter to maintaining public trust and calls into question whether his votes as a councillor may be invalidated due to an actual conflict of interest. ‘The possible invalidation of his votes could cause a significant disruption to the functioning of the consolidated city-county and could possibly create a fiscal impact on the consolidated city- county. Requested Remedy Based on the preceding discussion, because of the possible existence of a conflict of interest and the concern about public accountability, trust and confidence, I hereby request that: 1. Plowman disclose the nature and circumstances of the investigation; and 2. If Plowman refuses to disclose the nature and circumstances of the investigation, Plowman shall take a leave of absence from the council until the conclusion of the investigation. It should be noted that if Plowman takes a leave of absence, the constituents of District 25 will continue to be represented by the At-Large Councillors, and therefore, will not be denied representation.
