APPLICATION SEEKING UNBLOCKING OF ACCOUNT NO.010-1250-8, UBL CIRCULAR ROAD, WAZIRABAD DIST RICT GUJRANWALA Respectfully Shewth;- 1. That the titled Reference is pending adjudication before this honorable Court and fixed for 26.08.2015. The applicant in neither accused ncr has any concem with any of the accused. That in connection with the above said Reference, Current account of the applicant No.010-1250-8, UBL Circular Road, Wazirabad, District Gujranwala was blocked by the NAB authorities illegally, unlawfully and without any lawful justification, 3. That the applicant submitted an application u/s 13 of NAO 1999 but the same was rejected vide order dated 24.03.2009, 4 That feeling aggrieved the applicant filed writ petition No 9567/2009 before the Honorable Lahore High Court, Lahore which was dismissed on 19.05.2009 5. That now the applicant prays for unblocking/ un-cautioning of his account, inter-alia on the following grounds GROUNDS a) That according to the list of the Property and accounts being maintained by Syed Sibtul Hassan Gillani alias Double Shah and blocked/fiozen by the NAB inb) °) 4) connection with titled Reference, the account of the applicant is not figuring in the said list and even the name of applicant available anywhere . Hence, blocking of account of applicant is an abuse of authority and abuse of process of law. ‘That the NAB authorities have no lawful justification to block the account of any stranger on ‘the basis of suspicion without any cogent reasons. ‘That the earlier application of applicant was dismissed by the learned Judge Accountability Court No.IV, Lahore, but now the trial of the titled reference is pending before this Honorable Court, While dismissing the application of the applicant, it has been observed by the learned Court that the matter is under investigation. It is submitted with great respect that the investigation had been completed and even the Principal accused has confessed his guilt and was convicted and sentence and the trial of the remaining accused is pending, wherein the name of applicant does not exist anywhere, hence, the account of applicant is liable to be unblocked, enabling him to operate the same. That an amount of about Rs.3,50,000/-is still lying in the bank since long and NAB has no lawful authority to make any claim of the said amount. The applicant has been deprived from his huge amount for no fault on his part, He is innocent person having prestige in the business community and public at large. There was no allegatiol. of embezzlement or defrauding or aiding or assisting the accused of the title reference. Therefore, the blocking of the account is high objectionable. ‘That even during the course of investigation, no relation of applicant with the accused of the titled reference isproved. Even the applicant submitted an application before DG NAB, but to no avail. f) That the applicant reserv his right to take further additional grounds at the time of final arguments.
